Martinez,Executive Director DATE: August 8, 1995 SUBJECT: AWARD CONTRACT FOR ADMINISTRATION BUILDING ROOFING REPLACEMENT,CENTRAL OFFICE,CA011001, 3133 ESTUDILLO STREET,MARTINEZ,CALIFORNIA TO EXTERIORS BY DESIGN,INC.D.B.A.:CALIFORNIA COMMERCIAL ROOFING SYSTEMS IN THE AMOUNT OF $115,579.00. SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: ACCEPT request to withdraw bid for the Administration Building Roofing Replacement, Central Office, CAO 11001, 3133 Estudillo Street,Martinez,California from Ellis Roofing Co.;and AWARD roofing contract for the Administration Building Roofing Replacement,Central Office,CAO 11001,3133 Estudillo Street,Martinez,California to Exteriors By Design,Inc.: d.b.a.: California Roofing Systems,in the amount of $115,579.00;and AUTHORIZE the Executive Director of the Housing Authority of the County of Contra Costa to execute the contract with Exteriors By Design,Inc.: d.b.a.: California Roofing Systems upon receipt of satisfactory performance and payment bonds and certificates of insurance;and ORDER that in accordance with the project specifications and/or upon signature of the contract,any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned;and ORDER that the Executive Director is authorized to sign any escrow agreements prepared for this project to permit substitution of securities for moneys withheld by the Housing Authority to ensure performance under the contract,pursuant to Section 22300 of the Public Contracts Code;and Pursuant to Public Contract Code Section 4114,DELEGATE the Board's functions under Public Contracts Code Sections 4107 and 4110 to the Executive Director or his designee. II. FINANCIAL IMPACT: This project is fully budgeted and funded under the Housing Authority's Comprehensive Grant Program,Phase 702. No general fund moneys will be used. III. REASONS FOR RECOMMENDATIONBACKGROUND The Housing Authority received bids for the subject project on July 19, 1995. Four bids were received. The apparent low bid,Ellis Roofing subsequently requested that their bid be withdrawn,claiming a clerical error. Staff has reviewed this claim and believe it to be valid and we are therefore recommending that the request be accepted. The second low bidder was Exteriors By Design,Inc.: d.b.a.: California Roofing Systems in the amount shown above. The bid was responsive and in conformance with the bid documents. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not to award this contract delays may occur which could jeopardize the HUD funds allocated to the project.
