VIEW SANITARY DISTRICT CONTRA COSTA COUNTY, CALIFORNIA RESOLUTION NO. 866-95 IN THE MATTER OF CALLING THE GENERAL DISTRICT ELECTION ON NOVEMBER 7, 1995, FOR THE ELECTION OF DIRECTORS The District Board of Mt. View Sanitary District does hereby resolve: 1 . The General District Election will be held within the District on November 7, 1995, for the election of directors. The Contra Costa County Board of Supervisors is requested to consolidate the General District's Election with the General Election in Contra Costa County to be held on November 7 , 1995. The County Clerk is requested to issue declaration of candidacy papers to interested persons. 2 . The offices that are up for election on November 7 , 1995, the present incumbent and whether the term is a full term or short term are as follows : Office Incumbent Term Director Arthur J. Castro Full Term Director Ernest D. Pasley Full Term Director Dorothy M. Sakazaki Full Term 3 . The qualifications to be a candidate for director pursuant to the Sanitary District Act of 1923 is that the candidate be a resident voter in the Mt. View Sanitary District. 4 . The cost of publication of candidate's statement shall be paid by the candidate pursuant to Election Code Section 10012. The prorated share of estimated cost of the candidate's statement shall be collected at the time of filing a candidate's statement. 6 . This Resolution shall constitute the District's regulations to govern the described election. The Secretary is instructed to send certified copies of this resolution to the Board of Supervisors of Contra Costa County as the District requests that the General District Election be consolidated with the General Election on November 7, 1995, and to Stephen L. Weir, County Clerk, with the request that a copy be given to each candidate as the District's regulations affecting candidates and be delivered to each candidate, along with nomination papers. The foregoing Resolution was adopted by the Board of Directors of Mt. ATTESTED: PHIL BA H DR,Clerk Of the Board oSupervisors d County Administrator J By - >DeautY CC : County Clerk Elections Superintendent of Schools 4 GOVERNING BOARD OF THE LAFAYETTE ELEMENTARY SCHOOL DISTRICT RESOLUTION NO. 20-94 RESOLUTION ORDERING SCHOOL BOND ELECTION, SETTING FORTH THE SPECIFICATIONS THEREOF AND REQUESTING CONSOLIDATION WITH OTHER ELECTIONS WHEREAS, the Governing Board (the "Board") of the Lafayette Elementary School District (the "District") is generally authorized to order elections within the District and to designate the specifications thereof, pursuant to Education Code Sections 5304 and 5322; and WHEREAS, the Board is specifically authorized to order elections for the purpose of submitting to the electors the question of whether bonds of the District shall be issued and sold for the purpose of raising money for the purposes hereinafter specified, pursuant to Education Code Sections 15100 et seq.; and WHEREAS, the Board deems it necessary and advisable to submit a bond proposition to the electors which, if approved by two-thirds of the votes cast, would permit the District to issue the bonds; and WHEREAS, it is desirable that the election to determine whether said bonds shall be issued and sold be consolidated with such other election or elections as may be held on the same day in the same territory or in territory that is in part the same; NOW, THEREFORE, BE IT RESOLVED THAT THE FOLLOWING ORDER OF ELECTION AND SPECIFICATIONS OF THE ELECTION ORDER IS HEREBY ADOPTED: Section 1. Pursuant to Education Code Sections 5304, 5322 and 15100 et seq. a special election shall be held within the boundaries of the Lafayette Elementary School District on November 7, 1995, for the purpose of submitting to the registered voters of the District the following proposition: sF2-"7sa.1 "Shall the Lafayette Elementary School District be authorized to finance the repair and renovation of Lafayette elementary schools and classrooms; repair leaky roofs; make seismic and safety upgrades; provide safe electrical wiring and adequate outlets; upgrade failing and inefficient heating, ventilation, and lighting systems; construct facilities and renovate deteriorating classrooms, libraries, science and computer laboratories, and school facilities by issuing up to $27,300,000 of bonds at interest rates not to exceed the limit set by law?" All of the purposes enumerated in the foregoing proposition shall be united and voted upon as one single proposition. Said bonds proposed to be issued and sold shall bear interest at a rate per annum not exceeding the statutory maximum, payable at the time or times permitted by law, and the number of years the whole or any part of the bonds are to run shall not exceed 25 years from the date of the bonds or the date of any series thereof. Section 2. Pursuant to Section 15124 of the Education Code and Section 18 of Article XVI and Section 1 of Article XMA of the Constitution of the State of California, the above proposition shall become effective only upon the affirmative vote of two-thirds of those electors voting on the measure. Section 3. The foregoing specifications of the Election Order are made pursuant to Education Code Section 5322, and the County Superintendent of Schools and the County Clerk of the County of Contra Costa (the "County") are hereby requested to take all steps to call and hold the election in accordance with law and these specifications. Section 4. Pursuant to Education Code Section 15121 and Part 3 (commencing with Section 10400) of Division 10 of the Elections Code, the County Superintendent of Schools and the Board of Supervisors of the County are requested to order consolidation of said school bond election with such other elections as may be held on the same day in the same territory or in territory that is in part the same. Section 5. The Board of Supervisors of the County is authorized to canvass the returns of the election pursuant to Section 10411 of the Elections Code. Section 6. The Clerk of this District is hereby directed to deliver, no later than July 7, 1995 (which date is not fewer than 123 days prior to the date set for the election), two • certified copies of this resolution and order to the County Superintendent of Schools and one certified copy to the County Clerk, and shall file a certified copy of this resolution and order with the Clerk of the Board of Supervisors of the County. Section 7. The County Superintendent of Schools is hereby requested to prepare and execute a Formal Notice of School Bond Election and consolidation order in substantially the form attached hereto as Exhibit A (the "Formal Notice"), and to deliver the SF2-"754.1 2 Formal Notice and a copy of this resolution and order no later than July 10, 1995 (which date is not fewer than 120 days prior to the date set for the election), to the County Clerk. Section 8. The County Superint6ndent of Schools is hereby requested to call the election by causing said Formal Notice to be posted in accordance with Section 5362 of the Education Code no later than August 9, 1995 (which date is not fewer than 90 days prior to the date set for the election), or to otherwise cause said notice to be published as permitted by law.
