E. Wisenberg, Jr. (applicant ) from County Planning Commission decision denying Delta Coves project Final Dev. Plan 3024-82 and Tentative Subdivision Map 6013, Bethel Island area This being the time fixed for hearing the appeal of Delta Coves from the County Planning Commission denial without prejudice of Development Plan 3024-82 to create 495 single family residential units, 65 townhouses, 140 berths and commercial areas and common open space; and tentative map for Subdivision 6013; and Mr. Harvey Bragdon, Assistant Director of Planning, having reviewed for the Board the time schedule of the various appeals on the aforesaid projects; and having advised that the County Planning Commission had denied the application, without prejudice, inasmuch as the time allowed for action on the Final Development Plan and Tentative Subdivision Map application had expired on August 24, 1983, including an extension of time, and that no further extensions are permitted, and there was not enough time left to complete the EIR process and to certify the EIR, as supplemented, as adequate and then take action on the project; and Mr. L. E. Wisenberg, Jr. having appeared and having urged the Board to take the matter under submission, thereby staying time and allowing applicant time to finish the EIR process; and Supervisor Torlakson having commented that he wished to be certain that if the Board considered following this alternative, that the Board would not forfeit its rights because of time limits having expired; and Mr. Wisenberg having agreed to confirm in writing that he was authorizing an extension of time for the Board to act upon his appeal and waiving the time limit provisions of AB 884 (Chapter 4. 5, Government Code Section 65920 ff. ) and Mr. Jasper J. Sipes, P. 0. Box 85, Bethel Island 94511, representing S.O.S. Citizens for Sensible Planning, having appeared and urged -that the Board uphold the County Planning Commission' s decision to deny, without prejudice; and Ms. Constance Brady, 2690 Taylor, Bethel Island, representing S.O.S. , having appeared and requested that in the event the Board decides to grant the appeal, the matter be continued to provide S.O.S. 's attorney an opportunity to consult with County Counsel; and Mr. Jerry Donahue, 3506 Stone Road, B. O. Box 115, Bethel Island having discussed the status of the the U S Army Corps of Engineers permit for the project; and -201 As recommended by Supervisor Torlakson, IT IS BY THE BOARD ORDERED that its hearing on the appeal of L. E. Wisenberg, Jr. (applicant) from County Planning Commission decision denying Delta Coves project Final Development Plan 3024-82 and Tentative Subdivision Map 6013, Bethel Island area, is CONTINUED to' October 18, 1983 at 2: 30 p.m. IT IS FURTHER ORDERED that the applicant and his attorney are DIRECTED to submit a letter extending the time limit provisions of AB 884 (Chapter 4. 5, Government Code Section 65920 ff) to allow completion of the CEQA process and a complete decision on his applications. 1 h9reby eartify that this Is a true and correct copy o1 an action taken and entered on the minutes of the Board of Superviso/re�onn the date shown.
