BACKGROUND On July 12, 1983 your Board referred to the Finance Committee a report prepared by the County Administrator on the proposed establishment of a Municipal Advisory Council for the Oakley area, as requested by the Oakley Boundary Committee. Subsequently, our committee has discussed this matter on several occasions with county staff and representatives of the Oakley Boundary Committee, LIB-11, Oakley Fire Protection District, Oakley Sanitary District, and Oakley Water District. It is the committee ' s opinion that establishment of the Municipal Advisory Council will be of benefit to the Oakley area residents in that it will provide a local community forum to facilitate discussion and the develop- ment of recommendations on public services, land use, boundary changes, and other matters impacting on the Oakley community. The proposed resolution to establish the Oakley Municipal Advisory Council provides that the Council members shall be appointed by the Board. This procedure will avoid the cost of conducting an election. The attached resolution sets forth the details of the Council' s powers and duties . McPeak ACTION OF BOARD ON October 11, 19 � APPROVED AS RECOMMENDED X _ OTHER X— Board members discussed various issues involved in the establishment of Municipal Advisory Councils (MACS) , such as size of the community, county cost, demonstrated need, spheres of influence, etc. , and the need to explore and develop guidelines on these issues . (Continued on next page) 187 Supervisor Torlakson advised that the boundaries of the Oakley MAC basically follow Sellars Avenue on the east, County Service Area LIB-11 on the south, the sphere of influence of Antioch on the west side, and Dutch Slough to the north. He noted that the Local Agency Formation Commission (LAFCO) has referred to a subcommittee the question of ultimate status of the area east of Antioch between Highway 4/Highway 160 north-south line and County Service Area LIB-11 and Antioch sphere line to the east . (This area includes Dupont . ) He indicated that pending the outcome of the LAFCO review, the boundaries of the Oakley MAC may or may not be enlarged, and therefore indicated that he could not see any reason to delay the establishment of the Oakley Municipal Advisory Council. Following further discussion with a general consensus being reached to approve the Oakley MAC, the Board ADOPTED Resolution No. 83/1106 establishing the Oakley Municipal Advisory Council. In its desire to adopt guidelines pertinent to the establish- ment of Municipal Advisory Councils , the Board also: 1. REFERRED to the Local Agency Formation Commission, the Finance Committee (Supervisors Torlakson and McPeak) the Internal Operations Committee (Supervisors Fanden and Powers ) , and the County Administrator the following issues : development of guidelines for consideration of Municipal Advisory Councils in other communities, including county cost parameters , size of community, demonstrated need and interest, etc . These issues should be explored and developed further and brought back to the Board as soon as possible . Appointments to the Oakley MAC will be deferred until the Board receives a report on these issues . 2. DIRECTED LAFCO to initiate the dissolution of County Service Area LIB-11. 3. DIRECTED the Clerk of the Board to immediately begin recruitment for the seven appointments . Letters are to be sent to the Board of Directors of the Oakley Sanitation District, the Oakley Water District, and the Oakley Fire Protection District reauesting nominations to fill the designated positions assigned to represent said jurisdictions . The recruitment process should be completed in about one month. Creation of Oakley Municipal Advisory Council . Pursuant to the authority granted by Section 31010 of the California Government Code, the Oakley Municipal Advisory Council is hereby created. 2. Membership. The Council shall consist of seven (7) members who shall be residents of the Oakley community, as described in Attachment A to this Resolution, and who shall be appointed by the County Board of Supervisors . For the initial Council only, four (4) of the members shall be appointed from persons nominated by the Boards of Directors of the Oakley Fire Protection District, Oakley Sanitary District, Oakley Water District (Improvement District #1) , and the Citizens Advisory Committee for County Service Area LIB-11, respectively. 3. Term of Office . The Council members shall serve two (2) year terms except that for the the initial Council, the Board shall, by lot, select three (3) members who shall serve one (1) year terms and four (4) members who shall serve two (2) year terms . 4. Council Duties and Powers. The Council shall advise the Board on: a. Services which are or may be provided to the Oakley community by the County or other local governmental agencies . Such services include, but are not limited to, public health, safety, welfare, public works, and planning. b. The feasibility of reorganizing the existing special districts serving the Oakley community in order to more efficiently provide public services such as , but not limited to, water, sewer, fire, and park and recreation. The Council may: a. Represent the Oakley community before the Local Agency Formation Commission on proposed boundary changes affecting the community. b. Represent the Oakley community before the County Planning Commission and the Zoning Administrator on land use and other planning matters affecting the community. In this regard, the Council shall cooperate with other planning advisory bodies in the east county area in order to avoid duplication and delay in the planning process . ,8 Resolution No. 81/1106 IL 2. C. Provide input and reports to the Board, County staff or any County hearing body on issues of concern to the Oakley community. It is understood that the Board is the final decision making authority with respect to issues concerning the Oakley community and that the Council shall serve solely in an advisory capacity. Except as specified above, the Council may not represent the Oakley community to any state, . county, city, special district or school district, agency or commission, or any other organization on any matter concerning the community. 5. Compensation. The Council members shall serve without compensation of any kind and the Board shall not provide funds for the payment of Council meeting stipends or reimbursement of Council members ' expenses. 6 . Staff and Financial Support. The Board shall provide no ongoing professional or clerical staff support to the Council or provide funds to pay for any of the Council' s operating costs. However, County staff will provide the Council with information and reports on matters of interest to the Council. 7. Council Establishment Not Subject to Vote . The issue of establishment of the Council shall not be an election item submitted to the voters of the Oakley community. B. Council Operation. Within the parameters of this Resolution, the Council may organize itself and operate as it determines but shall hold regular meetings at least monthly at an established time and place.
