Recommended Action: ESTABLISH a Preapplication Review Committee, APPROVE the following preapplication review process for development applications submitted to the Growth Management and Economic Development Agency, ESTABLISH a fee schedule for the implementation of the program, and REPORT back to the Board in one year on the effectiveness of preapplication review and its effect on the quality of applications submitted and any time or cost savings involved. H. Financial Impact: Applicants will be charged a fee for the Preapplication Review Process. In addition, the information received during the Preapplication Review should allow applicants to submit a more complete application, which will likely result in reduced staff time and reduced cost to the applicant during the subsequent processing of the application. M. Reasons for Recommendations and Background: One of the tasks assigned to the Growth Management and Economic Development Agency(GMEDA), was to form a Preapplication Review procedure for development applications. The preapplication review process would be voluntary and would assist applicants in preparing an acceptable and complete application package. In addition, it would provide an opportunity for applicants and property owners to determine the requirements and costs associated with developing their property. The committee would meet with the applicant, review the project and provide a written summary of the basic requirements that the project would have to satisfy before development would be permitted. The comments generated by the committee would be based upon the information available and will be as complete as possible. No representations or guarantees of project approval would be made, however, since the application would be subject to the public hearing process through the Planning Agency. Comments from the committee would allow the applicant to determine the approximate costs and feasibility of their proposed project. If applicants follow through with their project, they would receive a credit of 25 percent of the preapplication review fee toward the application fee. The credit would only be applied against the Community Development and Public Works portion of the application fee and would not change the fee structure of the fire districts, Health Department, Building Inspection or other agencies who participate in the preapplication process. The Community Development Department has been using a Preapplication Review Process on a trial basis over the past six months. Staff has met with applicants on several projects and the feedback has been positive. GMEDA staff has been meeting recently with representatives of the engineering community, development community, and the BIA to discuss ways of improving our service. All of the representatives at these meetings have supported the formation of a Preapplication Review Process. IV. Consequences of Negative Action: No Preapplication Review Process would be established as recommended in the Formation Report of the Growth Management and Economic Development Agency. In addition,the time savings for the applicant and GMEDA staff and the prospect of more complete development applications, would not occur. V. Exhibit: The following is an outline of the Preapplication Review Process: 1. Preapplication Review Process a. The process is for subdivisions (major and minor), land use permit, and development plan applications. b. The process is voluntary and not mandatory. C. The Preapplication Review Committee will meet on a regular basis. d. The applicant requests a preapplication review at the Application and Permit Center. e. The applicant submits their project proposal to the Application and Permit Center for review by the Preapplication Review Committee and pays the preapplication review fee. f. The applicant and staff agree on a date and time to meet with the Preapplication Review Committee, usually within three weeks after the submittal of the project proposal. g. The preapplication project is assigned to a planner in Community Development. Copies of the project proposal are distributed to the Committee members who are asked to respond back to the planner within two weeks. h. The committee meets with the applicant who makes a short presentation of the project and answers any questions raised by the committee members. The committee advises the applicant of processing and environmental review requirements that will likely be imposed on the development of the property. Alternatively, for small projects, the planner may package the comments from the committee members and add any comments regarding environmental review requirements, and send them to the applicant. If the applicant has no questions or comments, then there may be no need for the committee to meet. i. A summary of the discussion at the meeting will be transmitted in writing to the applicant by the Application and Permit Center. The applicant will have ten days to respond with any comments or corrections. j. The applicant receives a 25 percent credit from the preapplication review fee against their development application fee that is in effect at the time of application, if they subsequently file an application within six months. The six month time period may be extended by the Zoning Administrator. k. Staff may test the experimental streamline approaches initiated within this process at no additional cost to the applicant. f FORMATION OF A PREAPPLICATION REVIEW PROCESS July`25, 1995 Page Three 2. Committee Membership The Preapplication Review Committee consists of the following representatives: 1. Community Development 2. Public Works 3. Building Inspection 4. Fire Services 5. Health Services Department 6. Redevelopment Agency(when applicable) 7. Water, Sanitary, and other appropriate special district representatives when needed. 3. Preapplication Review Fee I The fee schedule for preapplication review is as follows: a. Minor Subdivisions,Minor Land Use Permits, and Minor Development Permits $475.00 b. Major Subdivisions up to 100 lots $715.00 C. Major Subdivisions 101 lots to 250 lots $950.00 d. Major developments such as a shopping center, $1,000.00 industrial development, large scale residential development etc, will be charged time and materials (T&M) and a deposit taken of$1000.00. i 4
