SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
Option 1 - Willow Lake Court
APPROVE the location of Water Well 1 B at Willow Lake Court site, and
DETERMINE that the project is a California Environmental Quality Act Class 3 Categorical
Exemption, and DIRECT the Public Works Director to prepare contract plans and specifications
for construction, and
DIRECT the Director of Community Development to file a Notice of Exemption with the County
Clerk, and DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee
to the County Clerk for filing of the Notice of Exemption.
Option 2 - Existing Well Site 1, Discovery Bay Boulevard
APPROVE the location of the Water Well 1 B at existing Water Well 1 site located on Discovery
Bay Boulevard, and
DETERMINE that the project is a California Environmental Quality Act Class 2 Categorical
Exemption, and DIRECT the Public Works Director to prepare contract plans and specifications
for construction, and
DIRECT the Director of Community Development to file a Notice of Exemption with the County
Clerk, and DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee
to the County Clerk for filing of the Notice of Exemption, and
DIRECT the Public Works Director to proceed to conduct an evaluation of the Centex Service
Agreement and to consider negotiations of a possible amendment.

Board with a renegotiated service agreement with Centex Homes to
address the concerns of staff on this matter.

11. Financiallmpact:
There is no impact on the General Fund. The developer, Centex Homes, will pay for the
installation of the new well. Ongoing maintenance and operation are paid through the Sanitation
District 19 water and wastewater service charges.
III. Reasons for Recommendations and Background:
There is a serious need for improvement to the water supply system in Discovery Bay. The
Discovery Bay community relies on five water wells for all public water purposes including
household uses, irrigation and fire suppression. Water Well 1A is failing and it has been
estimated that there is less than five years service remaining. Also, due to failures, Water Well
4 has less than one-third of its design capacity.
Since 1991, the existing Water Well 1A in Discovery Bay has experienced operational problems,
including excessive sand infiltration, excessive manganese production and iron bacteria fouling
the screen filter in the well casing. When operated at maximum capacity sand is pumped into the
pipes and eventually into houses. Manganese introduces black water with particles that are
difficult to remove from plumbing fixtures. There have been several attempts to repair Well 1A,
but most were successful only for a short period of time. Due to these operational problems, use
of Water Well 1A is avoided and is only used in case of emergencies.
There are approximately 3,100 dwelling units connected to the water supply system in Discovery
Bay. As documented in the Discovery Bay West Environmental Impact Report, the water demand
for the existing Discovery Bay community of 3,100 dwelling units is 5,250 gallons per minute
(gpm). At build out of approved developments within the existing Discovery Bay community, there
will be approximately 4,100 dwelling units requiring 6,000 gpm.
The existing wells have a 4,150 gpm capacity. Should Well 1A fail, the system capacity would
be reduced to approximately 3,150 gpm. A replacement of Well 1A will increase the reliable
supply capacity from 3,150 gpm to approximately 4,650 gpm. This is still short of the required
5,250 gpm, however, there is a plan to restore the capacity of Well 4 through the Conditions of
Approval for the Discovery Bay West Project. The replacement of Wells 1A and 4 will increase
the reliable capacity to at least 6,150 gpm.
On July 11, 1995, the Board directed staff to report back on July 25, 1995, with a comparison of
two alternate water well sites. The following presents the significant advantages and
disadvantages of the two optional sites. In addition, the attached chart (Exhibit A) includes
advantages and disadvantages of the top four sites presented to the Discovery Bay Municipal
Advisory Council
Alternative 1 - Willow Lake Court:
Advantages: The site is technically superior according to evaluations and opinions expressed
by the consultants. The site meets regulatory approval because it is separated from local
sewerage facilities.
Disadvantages: There has been a threat of litigation if the site were to be located on the road
median island. There could be delays and added costs in getting the well sited, constructed and
operating if an inverse condemnation suit were to be filed. The delays associated with litigation
of this type would be two to five years. Based on the testimony during the July 11, 1995 Board
of Supervisors meeting, the award (if the plaintiff were successful) could range from $0 to more
than $750,000, plus attorney's fees, loss of property value and interest charges.
Alternative 2 - Existing Well 1 Site:
Advantages: The site is already used for a well and a replacement well will have no additional
impact on the environment.
Disadvantages: One well has already failed at this site, and a second is failing. A new well at
this site presents a risk to the community due to the uncertainty of completely sealing the existing
wells on the site. In the event there is a cross contamination from the upper brackish water
aquifer to the drinking water aquifer, the community will again have a substandard water supply
and be forced to locate and fund another replacement well at an estimated cost of $475,000.

Alternative 2 - Existing Well 1 Site: Disadvantages Continued:
Considering the history of wells and performance risks at this site, representatives of Centex
Homes, Delta Diablo Sanitation District, and County staff, find the Centex Service Agreement
does not contemplate or address issues such as risk, liability and yield at this site. An evaluation
and a possible amendment to the agreement may be necessary to further define requirements
of each party.
IV. Consequences of Negative Action:
Installation of the new water well, as required by the conditions of approval for the Centex Homes
development, would not be implemented. The existing system would continue to be undersup-
plied and at risk to meet fire flow demands.

We understand that you are going to recommend one of two well sites in the north end of
Discovery Bay in your meeting on July 25, 1995. The purpose of this letter is to provide
information pertaining to this decision and our existing Service Agreement, dated August 16,
1994.
The Service Agreement requires Sanitary District 19 to provide a well site and for Centex
Homes to drill a well. . The north end sites which you are now considering have been
evaluated by the Consultant. In his opinion, a well on these sites will produce far less than
required by the Agreement. If any of these sites are chosen, it will be necessary to amend
the Agreement. -These constraints were brought to the attention of the M.A.C. when all
potential well sites were analyzed and the recommendation was made.
Therefore, if you select a north side site, Centex Homes requests that you also direct your
staff to prepare the necessary amendment to the Service Agreement so that it will be
consistent with the consultant's report on the feasible production at the site.
Making these changes will enable County staff and Centex Homes to provide a new water
well which will benefit the Discovery Bay community.
