SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: APPROVE the Federal Communications Commission(FCC)Forms 393, 1200 and 1210 submitted by Century Cable of Northern California for the Basic Service Rates effective after September, 1993. FINANCIAL IMPACT: None. BACKGROUND: On or about June 4, 1994, Century Cable of Northern California(Century) submitted to the County an FCC Form 393; on or about August 15, 1994, Century submitted an FCC Form 1200; and on or about March, 1995, Century submitted an FCC Form 1210, which is a quarterly pass through of certain external costs for the basic service tier. Since additional time was needed for review of these forms, the Board adopted accounting orders to extend the review time until July 25, 1995. Patricia Burke, Cable TV Administrator and Paul Abelson, Systems Accountant reviewed the FCC Forms. In staffs opinion these applications were prepared in accordance with the FCC's instructions and the amounts appear reasonable (letter attached). On the FCC Form 1200, Century was above permitted from July to September, 1995 for a total of approximately $.50. However, from September to April, 1995, Century charged a rate $.12 per month less than permitted. This would total $1.08 per subscriber that they could have charged but did not, resulting in a net refund of zero. Therefore, staff recommends that no refund be ordered for the FCC Form 1200 and that the Board approve the FCC Form 1200. Contra Costa County Auditor-Controller's Office To: Pat Burke, Cable Franchise Administrator From: Paul Abelson, Systems Accountant ' Date: April 4, 1995 Re: Century Cable 393, 1200 & 1210 Rate Application Reviews I have reviewed Century Cable's Form 393 Rate Application package dated Sept 1, 1993, the form 1200 dated July 14, 1994, and the form 1210 dated August 15, 1994, for internal consistency and completeness. Deloitte & Touche performed some testing of the first two prior to Century's submittals, and I have relied in part on their work. Century provided us with additional documentation requested, including a representation letter stating there were no year end adjustments discovered subsequently which would have affected the amounts submitted in the application. Deloitte&Touche performed a review for the express purpose of assisting the company and franchise authority (us) in evaluating management's assertions about Century's compliance with FCC regulations with respect to this application. Deloitte & Touche reported no exceptions. The work I performed was not an audit of the data, however,based on the information provided by the Applicant, including the Deloitte & Touch report, it is my opinion that this application was prepared in accordance with the FCC's instructions and that the amounts appear reasonable. cc: Ken Corcoran, Auditor-Controller Sandra Winn, Principal Accountant cabop 14.doc
