July 11, 1995 * SUBJECT: APPROVAL OF INTERAGENCY AGREEMENT #39-819 WITH MOUNT DIABLO UNIFIED SCHOOL•*DISTRICT SPECIFIC REQUEST(S)OR RECOMMENDATION(S)6 BACKGROUND AND JUSTIFICATION 1. RECOMMENDED ACTION: APPROVE and AUTHORIZE the Community Services Director or her designee to execute, on behalf of the County, Interagency Agreement #39-819 with Mount Diablo Unified School District in the amount of$53,467 for continuation of Social Caseworker Specialist II services for the School District's Foster Youth Program for the period from July 1, 1995 through June 30, 1996. II. FINANCIAL IMPACT: This Agreement will result in School District reimbursement of the Department's costs of providing services of a Social Caseworker Specialist II for District's Foster Youth Program. Funding will be reflected in the Community Services Department's proposed FY 1995-96 budget. No County funding is required. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: On September 13, 1994 the Board approved a contract between the County and Mount Diablo Unified School District which assigned a social worker to provide services for the District's Foster Youth Program. This caseworker serves as a liaison between the District and the County, offers training to District personnel and County staff, and works with foster youth and foster families regarding the child's needs in the school setting. Interagency Agreement #39-819 continues this service during FY 1995-96. The Community Services Department administers this agreement on behalf of the County. Contract Identification. Department: Community Services Subject: Interagency Agreement between Contra Costa County (Community Services Department) and Agency named below for Foster Care Caseworker Liaison 2. Parties. The County of Contra Costa, California (County), for its Department named above, and the following named School District mutually agree and promise as follows: Agency: MOUNT DIABLO UNIFIED SCHOOL DISTRICT (hereinafter "Agency") Capacity: Public Agency (School District) Address: 1936 Carlotta Drive, Concord, California 94519-9989 3. Term. The effective date of this Agreement is July 1, 1995 and it terminates June 30, 1996 unless sooner terminated as provided herein. 4. Payment Limit. Agency's total payments to County under this Agreement shall not exceed $53,467. 5. County's Obligations. County shall provide Social Caseworker Specialist services and carry out that work described in the Service Plan attached hereto which is incorporated herein by reference, subject to all the terms and conditions contained or incorporated herein. 6. Agency's Obligations. Agency shall pay County for its provision of the services as set forth in the attached Payment Provisions which are incorporated herein by reference, subject to all the terms and conditiq"ntained or incorporated herein. 7. Independent Contractor Status. This Agreement is between two independent contractors and is not intended to and shall not be construed to create the relationship of agent, servant, employee, partnership, joint venture, or association. 8. Legal AuthoritX. This Agreement is entered into under and subject to the following legal authorities: California Government Code Section 23008, 26227 and 31000, et seq. 9. Signatures. Payment Basis. Subject to the Payment Limit of this Agreement, and in consideration of the County's provision of services hereunder, Mount Diablo Unified School District shall reimburse County for the cost of one Social Caseworker Specialist II who shall be assigned to the School District under the terms of this Agreement. 2. Payment Amounts. Upon receipt of County's written demand for payment, the School District shall reimburse County quarterly an amount equal to County's cost for services provided under this Agreement, subject to the attached Budget of Estimated Program Expenditures which is incorporated herein by reference. No later than one hundred twenty (120) days following the termination of this Agreement, County shall complete a Final Reconciliation Report showing the costs that have actually been incurred by County under this Agreement. Initials: Agency County Dept. SERVICE PLAN ' Contract # 39-819 1. Purpose. The purpose of this Agreement is to set forth the responsibilities of the County and the Agency to provide social worker services for the Agency's Foster Youth Program. The County shall provide the services of a Social Worker, who will be assigned to Agency and who will provide services at one or more schools in the Mount Diablo Unified School District. Social Worker services under this Agreement will be governed by State and Federal laws and regulations as interpreted by County. 2. County's Obligations. County shall: a. Provide the services of a Social Caseworker Specialist II who will work solely with Agency's Foster Youth Program. The person holding this position shall be designated by the Community Services Department Director, or her designee. b. Assign specific duties to the Social Caseworker Specialist. Caseworker's duties shall be agreed to by consultation between the Community Services Department Director, or her designee, and the Agency. c. Administer this Agreement and obtain required County approvals. d. Administer the assignment of the Social Caseworker Specialist in accordance with applicable rules and regulations as set forth in agreements between County and County employee organizations. e. Determine the Social Caseworker Specialist's work schedule after consultation with the Agency. f. Maintain sole responsibility for supervision of the Social Caseworker Specialist. g. Assure that the Social Caseworker Specialist conforms to the rules and regulations of the Agency while providing services on Agency property. In case of conflict between County rules and regulations and Agency rules and regulations, County rules and regulations shall govern. h. Maintain confidentiality of records as required by all applicable laws and regulations. L Obtain weekly work history reports from the Social Caseworker Specialist. Said reports shall be submitted in writing to the Community Services Block Grant Program Manager. j. Provide services under this Agreement in accordance with the attached Budget of Estimated Program Expenditures which is incorporated herein by reference. 3. Agency's Obligations. Agency shall: a. Provide necessary work space and equipment for the Social Caseworker Specialist II, including a desk, chair, telephone, access to a photocopier, office supplies, etc. Initials: Agency County Dept. 1 SERVICE PLAN Contract # 39-819 b. Maintain confidentiality of records as required by all applicable laws and regulations. c. Abide by the provisions of the U.S. Civil rights Act of 1964, the Americaris with Disabilities Act, SASS MAP: Division 21, and Welfare and Institutions Code Section 1000, which prohibits discrimination against any service recipient on the basis of disability, race, national origin, ancestry, sex, religion, marital status, political affiliation, color, age, or medical condition. d. Provide all transportation related to services provided under this Agreement by reimbursing the Social Caseworker Specialist II for mileage at the County's rate of reimbursement. e. In accordance with Government Code Section 23008, Agency shall reserve from Agency funds the amount of $53,467 to cover payment to County for services performed under this Agreement. 4. No Third-Party Beneficiaries. Notwithstanding mutual recognition that services under this Agreement may provide some aid or assistance to members of the County's and the Agency's population, it is not the intention of either the County or the Agency that such individuals occupy the position of intended third-party beneficiaries of the obligations assumed by either party to this Agreement. 5. Compliance with Law. the parties shall be subject to and comply with all federal, state and local laws and regulations applicable with respect to its performance under this Agreement, including, but not limited to, licensing, employment, and purchasing practices, and wages, hours, and conditions of employment, including nondiscrimination. 6. Entire Agreement. This Agreement contains all the terms and conditions agreed upon by the parties. Except as expressly provided herein, no other understanding, oral or otherwise, regarding the subject matter of this Agreement shall be deemed to exist or to bind any of the parties hereto. 7. Indemnification. a. County shall indemnify and hold harmless Agency, its officers and employees, from County's share of all liability, losses, costs or expenses, including attorney's fees, arising out of the responsibilities of County, its officers, agents, or employees, as set forth in this Agreement. b. Agency shall indemnify and hold harmless County, its officers and employees, from Agency's share of all liability, losses, cost of expenses, including attorney's fees, arising out of the responsibilities of Agency, its officers, agents, or employees, as set forth in this Agreement. 8. Insurance. Both parties are self-insured. No other insurance is required.
