HomeMy WebLinkAboutMINUTES - 10111983 - 2.1 (3) THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 11 , 1983 , by the following vote: AYES: Supervisors Powers , Fanden , McPeak , Torlakson, Schroder. NOES: None ABSENT: None ABSTAIN: None SUBJECT: Petition Objecting to Penthouse Structure on Property Located at 131 Lawson Road, Kensington A petition having been received from Ingrid Werner, and others ; neighbors of the property located at 131 Lawson Road, Kensington , objecting to the erection of a fourth story penthouse on said property and requesting that the Board reconsider its "decision of September 27th , 1983 , exempting this structure from the building height limitation in the zoning code based on Section 82-2 .0081f ; and It having been noted that the Board had made no such decision on September 27 but rather had requested the Director of Planning to review the ordinance code to determine whether the section governing building height restrictions should be amended; and Supervisor Powers having commented that by filing the petition the neighbors are attempting to indicate to the Board that it should take further action on this matter, and at his invitation the Board having heard comments from Ingrid Werner and from Robert Hansen (the latter speaking for the Kensington Improve- ment Club) , spokespersons for the petitioners ; and Supervisor Powers having recommended that in view of possible legal action on the matter this issue be discussed with County Counsel in Closed Session ; IT IS BY THE BOARD ORDERED that the recommendation of Supervisor Powers is APPROVED. hereby certify that this Is r tma and correct copy of an action, taken and cntaro d on `,a minutes of the Board of Buaer%11500rE C::i i@ dat-I a r EM: 1Z3 J.P. cr..,;: an tJ o(jIV By , Deputy Orig. Dept.: Clerk of the Board cc: County Counsel Planning Director Building Inspector County Administrator 158 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 11 , 1983 . , by the following vote: AYES: Supervisors Powers , Fanden , McPeak, Torlakson , Schroder NOES: None ABSENT: None ABSTAIN: None SUBJECT: Penthouse Building Height Exemption The Board on October 4 , 1983, at the request of Supervisor Powers , having asked County Counsel , the Planning Director, and the Director of Building Inspection to review Ordinance Code provisions relating to exemptions to building height restrictions and submit recommendations to the Board this day ; and County Counsel having reported in a memorandum dated October 10 , 1983, that he and the Planning Director have reviewed the matter and recommend that the Board consider amending Ordinance Code Section 82-2 .008 to delete the penthouse exemption included therein ; and County Counsel having suggested that the Board may also wish to consider other exemptions from the structure height limits of Title 8 of the Ordinance Code to determine whether all of the exemptions should be maintained; IT IS BY THE BOARD ORDERED that receipt of the aforesaid report of County Counsel is ACKNOWLEDGED.
