See various votes on motions below ------------------------------------------------------------------------------ ------------------------------------------------------------------------------ SUBJECT: Diamond Boulevard Extension Project The Board on August 16, 1994 continued its consideration on the above matter and referred to the Public Works Director and to County Counsel for review and report the issues raised by Mr. Hal Yeager in his presentation on that date, as well as those raised by Supervisor Torlakson with respect to the CEQA, environmental and legal issues and the source of funds which could be needed for this project. Maurice Shiu, Deputy Public Works Director, responded to the requests and issues referred to the Public Works Department on August 16, 1994, and noted that the project is still very competitive in the bid for MTC funding. Mr. Shiu also responded to some of the issues raised by the mobile home park residents, such as impacts from noise, and vibration, the impact on wetlands, possible mitigation and the fact the project limit is different from what they desire. Acting Chair Bishop invited those who had submitted cards to speak, and the following appeared: Hal R. Yeager, 89 Baylor Lane, Pleasant Hill, spoke in opposition. Dorothy Sakazaki, 737 Central Avenue, Martinez, spoke in opposition. Donna J. Davidson, 1000 Temple Drive, Pacheco, member of the Pacheco Town Council and the Pacheco Municipal Advisory Council, spoke in opposition. Joyce Jones, 45 Rutherford Lane, Pacheco, Pacheco Town Council, spoke in opposition. Don Mount, 1309 Gragg Lane, Concord, spoke in opposition. Barbara Allenza, 261 Magra Way, Pacheco, representing the Pacheco Municipal Advisory Council, spoke in opposition, and read a letter from Wally Wiggs, Pacheco Municipal Advisory Council Chair in opposition to the project. Roy Tomlin, 277 Sudan Loop, Pacheco, spoke in opposition. Grace Ellis, 1718 Via del Verdes, Concord, spoke in opposition. Joe Minck, 311 Floros Court, Pacheco, member of PMAC, spoke in opposition. Gerald Gommerman, 177 Medina, Pacheco, resident of Sun Valley Village, spoke in favor of the extension. Andrea Wise, 64 Baylor Lane, Pleasant Hill, spoke in opposition. Pello Walker, 1239 Raymond, Drive, Vice Chair of PMAC, spoke in opposition. The following persons left written comments indicating their opposition to the project, but not wishing to speak: Calvert Craft, 138 Damascas Loop, Sun Valley Village, Pacheco. Kelly Jones, 45 Rutherford Lane, Pacheco. Dobres Wiggs, 187 Freda Drive, Pacheco. Bobbie B. Machado, 138 Damascus Loop, Pacheco June Foster, 100 Sahara Drive, Pacheco. Jane Marie Davis, 283 Sudan Loop, Pacheco. Ruth Stuart, 262 Sudan Loop, Pacheco. Joseph Schneider, 137 Algiers Way, Pacheco. Supervisor DeSaulnier noted that he still had two problems with the project. First, the overwhelming majority of the neighborhood is against it and the greater global good is not of such significance that it outweighs the neighborhood's concern; and the second is a philosophical problem with spending money just because it is Federal money. Supervisor DeSaulnier moved to withdraw the prior authorization given by the Board of Supervisors on April 27, 1993 to submit the Diamond Boulevard Extension project for Intermodal Surface Transportation Efficiency Act funding. Supervisor Bishop seconded the motion, stating that her reasons were first, that it is Supervisor DeSaulnier's district, and, second, that she feels the project is problematic. She commented that tax dollars are tax dollars and that Federal funds come out of a different pocket but are still tax dollars. Supervisor Bishop also commented that she felt there were inconsistencies in the documents justifying this project. She commented that the quality of life for the 800 residents in the mobile home parks is important. Supervisor Smith commented that he had expected to have specific answers to issues raised by Supervisor Torlakson on August 16, 1994. He urged the Board to send these questions back to staff with a vigorous discussion to take place at the Transportation Committee meeting on Monday, October 3, 1994 and have the matter back to the Board on Tuesday, October 4, 1994. Supervisor Torlakson expressed appreciation for all who have been involved in this process for the past months. He suggested looking at alternatives that would respect and preserve the neighborhood, not have the kind of human impacts that the Pacheco Town Council has brought to the Board's attention. He commented that some of the questions might be able to be answered by staff between now and next week, the kinds of issues, if you had a modified project in some fashion, would you be able to mitigate some of the traffic and noise. He advised that he had received some calls and letters from individuals who support a project of some kind, and in the past there was some support from mobile home residents for a project of some kind. He advised that he would need to see the integrity of the dollars that are being applied for met under any alternative and if some scaled back version could not meet the integrity of those federal dollars for congestion management, then the County should abandon the project. He expressed concern about the question of cost, commenting that he would not support anything that would require additional money from the general fund. He commented on the issue of the terminal which he felt was a fear of the mobile home residents, and suggested that it be made clear that there is no intention to place a terminal on the West side of the Airport for 15 or 20 years. He inquired if there was a process or alternative for examining a scaled back project. V Maurice Shiu responded with the steps that would need to be taken to scale back or consider a modified project. He urged the Board to allow moving into the next stage of development for the current project, which would be to prepare the environmental impact report where they can analyze the potential impact, address concerns of the people in the mobile home park, and develop a project. If there are no viable solutions, Public Works would come back and recommend that they not proceed with the project, but until there is an opportunity to study it in detail, it becomes speculation to advise what the impacts would be. Mr. Shiu advised that the local match would come from funds in the Pacheco Area of Benefit. Supervisor Torlakson commented that he understood the intention of the motion is to protect the neighborhood, but he did not know if all the scientific facts were available and an analysis to show that there are not ways to do that and still have some improvement in the circulation. He suggested that the Town Council and some of the residents be involved in the selection of an independent EIR consultant. Val Alexeeff, Director of Growth Management and Economic Development Agency, responded that the EIR process can be structured any way the Board instructs, and it would be no problem to have the Town Council and some of the involved residents participate in the selection of the EIR consultant Mr. Alexeeff commented on the fact that the terminal keeps coming up and that the he could be perfectly comfortable in signing or preparing an agreement guaranteeing that there would be no terminal for twenty years. The Chair called for a vote on the motion on the floor to withdraw prior authorization for the project. The vote was as follows: AYES: Supervisors DeSaulnier and Bishop NOES: Supervisors Smith and Torlakson ABSENT: Supervisor Powers The motion failed to carry. Supervisor Smith moved to direct staff to come back in a week with the information previously requested and that there be a special meeting on Monday of the Transportation Committee to hear that information before the full Board has it. Supervisor Torlakson seconded the motion. The Chair called for a vote on the motion. The vote was as follows: AYES: Supervisors Smith and Torlakson NOES: Supervisors DeSaulnier and Bishop ABSENT: Supervisor Powers The motion failed to carry. Supervisor Smith asked that the Board reconsider agendizing this matter for next week with further information from staff. He commented there has been a lot of time and effort put into it, and he would not want to see a decision on this matter by default. He advised that to be comfortable with any decision on this matter, he would need more information, and he urged Supervisor DeSaulnier to ask that it be rescheduled next week. Supervisor DeSaulnier declined. Each time we have told them that we do not want the traffic from Diamond Blvd extended on to Marsh Drive because of the negative effect on the occupants in the mobile homes, ie, more traffic, more pollution, more noise, and the reduction of property values. We were especially concerned when we learned that they wanted to run four lanes from Concord ave through the golf course onto Marsh Drive and down to Sally Ride Drive. At Sally Ride Dr. ,the road is reduced from four lanes to two lanes which produces a bottleneck for all traffic not going into the airport. In July of 1993 PMAC voted to reject the DBE project unless the county could extend the four lanes to Solono Way or at least to the bridge east of the curve on Marsh Dr. We wrote a letter to Supervisor Sunne McPeak and I personally delivered it to her office. A short time later Mike Walford, Public Works Director, came to one of our meetings and told us that we didn't have to worry about the DBE project because there were no funds for it in the near future. Mr. Walford said that before a grant was obtained a traffic study would be done and PMAC would get copies to study and be able to protest if necessary. In the summer of 1993, Public works applied to the CCTA for ISTEA funds. In April 1994 the ISTEA application progressed to MTC for final approval. In his letter to TRANSPAC Members on May 25, 1994 Mr. Walford's traffic study map shows the four lanes extending only to Sally Ride Dr. Obviously he has no intention of keeping his promise to extend the four lanes north and beyond Vista Grande on Marsh Dr. Because of Mr. Walford's broken promise, and because we have reason to believe that some of the statistics in his application are bogus, PMAC. held a special meeting on May 25 and voted to oppose the Diamond Boulevard extension.
