Martinez, Executive Director DATE: September 27, 1994 SUBJECT: AMENDMENT NO. 49 TO ANNUAL CONTRIBUTIONS CONTRACT SF-182 FOR COMPREHENSIVE GRANT PROGRAM (CGP) FEDERAL FISCAL YEAR 1994 ANNUAL SUBMISSION SPECIFIC REQUEST(S) OR RECOMMENDATIONN((S))&& BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: ADOPT Resolution No. 3721 authorizing the execution of Amendment No. 49 to Annual Contributions Contract No. SF-182 and AUTHORIZE the Executive Director of the Housing Authority of the County of Contra Costra to execute all necessary HUD. contract documents for the $2,729,371 Comprehensive Grant Program (CGP) funds, approved as Project No: CA39-PO11-70394, for Federal Fiscal Year 1994, as recommended by the Advisory Housing Commission. II. FINANCIAL IMPACT: Funding has been approved by the U. S. Department of Housing and Urban Development (HUD) under its Comprehensive Grant Program (CGP) in the total of amount of $2,729,371 to continue planned comprehensive improvement work, to implement management improvements, to offer security guards on a PHA-wide basis, to update agency policies and procedures and upgrade the Housing Authority's computer systems. III. REASONS FOR RECOMMENDATION/BACKGROUND: On September 2, 1994 the Housing Authority of the County of Contra Costa received a letter from Julian A. Fitzgerald, Acting Director, Office of Public Housing, San Francisco Regional Office of the Department of Housing and Urban Development, announcing that our final Comprehensive Grant Program application for Federal Fiscal Year 1994 CGP funding had been approved in the total amount of $2,729,371. The CGP final application was approved for submission to HUD by the Board of Commissioners on March 1, 1994. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not adopt Resolution No. 3721, authorizng the execution of Amendment No. 49 to the Annual Contributions Contract No. SF-182, the Department of Housing and Urban Development would withdraw its allocation of $2,729,371, thereby jeopardizing the Housing Authority's ability to continue much needed comprehensive improvement work and upgrades. SF-182 AND AUTHORIZING ITS EXECUTION WHEREAS, the Housing Authority of the County of Contra Costa (herein called the "Local Authority") entered into a Consolidated Annual Contributions Contract on February 24, 1962 (as amended) , with the United States of America (herein called the "Government") ; and, WHEREAS, it is deemed advisable by the Local Authority and the Government to amend the Consolidated Annual Contributions Contract in the particulars indicated in such Amendment: NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Housing Authority of the County of Contra Costa, as follows: 1. The Amendment to the Annual Contributions Contract is hereby approved and accepted. The Executive Director is hereby authorized and directed to execute seven counterparts of the Amendment on behalf of the Local Authority, and the Secretary is hereby authorized to impress and attest the official seal of the Local Authority on each such counterpart and to forward such executed counterparts, or any of them, to the Government together with such other documents evidencing the approval and authorizing the execution thereof as may be required by the Government. 2. This Resolution shall take effect immediately. This Comprehensive Plan is binding upon HUD and the PHA- until such time as the PHA submits, and HUD approves, an amendment to the. Plan. This approval of the Comprehensive Plan does not constitute an- endorsement of the PHA' s improvement strategies or funding ' priorities or' approval of the Section 504 needs assessment and, where necessary, transition plan. Please note that under -separate cover, Form HUD-52840, "COMPREHENSIVE GRANT PROGRAM (CGP) AMENDMENT" is being sent to you from our Office of Counsel. Please execute the document pursuant to the Office of Counsel ' s instructions and enter your Tax Identification Number (TIN) directly on the ACC Amendment, so that we can link-up your FFY 1994 CGP with the Letter of Credit Control System (LOCCS) . . In addition, a copy of the approved Annual Statement is attached. In reviewing the activities set forth in the Annual Statement, HUD has complied with the environmental requirements of 24 CFR Part 50 . The activities set forth in the Annual Statement shall be undertaken in accordance with the following implementation requirements set forth in the CGP Handbook 7485 .3 . Particular attention should be given to: 1. Resident and local government participation requirements during the implementation and monitoring of the Comprehensive Plan and Annual Statement in Chapter 5; f r. 2 2 . Amendments to Comprehensive Plan, including Action Plan in paragraph 6-14.; 3 . Amendments to the Annual Statement in paragraph 8-9; 4 . Conduct of approved activities in Chapter 11; and 5 .
