RECOMMENDATION
I. Define the nature and magnitude of problems in mobile home parks and
propose solutions to those problems which are identified.
The Special Mobile Home Task Force recommends that the Board of Supervisors adopt
a policy stating that:
Each mobile home park should have an established policy for ongoing
maintenance, how to report maintenance problems, and a response time within
which maintenance problems will be addressed. This policy should be adopted.
after input from residents to management and should be reviewed annually.
- Each park must have competent on-site management.
- Parks need to comply with all requirements of the Americans With Disabilities
Act in order to address the needs of those who are physically challenged.
A method should be identified and implemented for educating the public on
their rights regarding mobile homes and leases. This could include utilizing
public access television, providing educational material for distribution in
public libraries, speakers to various community groups, etc.
II. Identify laws which are currently in place for resolving disputes which would
be helpful in cases like mobile home rent control disputes; and
The Special Mobile Home Task Force could not reach a consensus on whether there
should be a rent control/stabilization ordinance. If the Board of Supervisors wishes
to implement such an ordinance, the following components could be considered as
part of any such ordinance:.
a moratorium on all rental increases while the issue of rent stabilization is
further considered.

BACKGROUND
On June 21, 1994, the Board of Supervisors established a Special Mobile Home Task
Force and on July 19, 1994, it appointments were made to the Task Force. The Task
Force has met every Tuesday evening since July 26, 1994 (with the exception of
September 6, 1994) to address the following directives of the Board:
I. Define the nature and magnitude of problems in mobile home parks and
propose solutions to those problems which are identified;
Ii. Identify laws which are currently in place for resolving disputes which
would be helpful in cases like mobile home rent control disputes; and
III. Identify and explore the feasibility of alternatives to rent control such
as long-term leases, shared expenses, shared management and others
which may come to the attention of the Task Force.
The attached report provides the background discussion and recommendations of the
Task Force.
REPORT OF THE SPECIAL MOBILE HOME TASK FORCE
September 20, 1994
SUMMARY
On June 21, 1994, the Board of Supervisors established a Special Mobile Home Task
Force and authorized the Internal Operations Committee to recruit, screen, interview
and recommend to this Board for appointment three individuals who reside in mobile
home parks, three individuals who own or manage mobile home parks, and one
individual who was an expert in conflict resolution. On July 19, 1994, the Board of
Supervisors appointed Albert Cordero, Patricia DeFrates, William Rickard, and
Joseph Schneider (Alternate) to the Resident positions (Ms. DeFrates has since
resigned due to unforeseen business scheduling conflicts, and Mr. Schneider now
sits in that position); Russ Harris, Stan Hansen and John Kniffen to the
Owner/Manager positions, and Stuart Safine to the Independent position.
The Task Force has met every Tuesday evening since July 26, 1994 (with the
exception of September 6, 1994) and has worked under the charge of this Board to:
I. Define the nature and magnitude of problems in mobile home parks and
propose solutions to those problems which are identified;
II. Identify laws which are currently in place for resolving disputes which
would be helpful in cases like mobile home rent control disputes; and
III. Identify and explore the feasibility of alternatives to rent control such
as long-term leases, shared expenses, shared management and others
which may come to the attention of the Task Force.
REVIEW and RECOMMENDATIONS
I. Define the nature and magnitude of problems in mobile home parks and
propose solutions to those problems which are identified.
The task force identified and ranked concerns as they relate to mobile homes,
whether as the owner of a unit or the owner of a park.
1. Low- and fixed-income residents
2. Increases with no perceived value attached
3. Reasonable increases
4. Vacancy decontrol
5. Impact on ability to get financing
6. Ability to relocate
7. Need for moratorium challenge
8. Lack of maintenance
9. Return on investment to owner
10. Impact on present mortgages
11. Lack of competent on-site management
12. Communications between resident and management
13. Fair means of dispute resolution
14. Residents with physical challenges
15. Lack of government response to Health & Safety Code violations
16. Types of leases
17. Ability to get insurance
As a narrative summary of the above items, the Task force found that many of these
issues overlapped and were interrelated. Any rental increases must be reasonable
and should be justified by management to residents. Rental increases impact the
ability to obtain financing on new and older mobile homes. This, in turn, impacts
the market for resale of mobile homes in parks known to have high rental increases.
Mobile home living provides an affordable housing base, particularly for those living
on low or fixed incomes.
Relocation of mobile homes to other parks is increasingly more difficult because new
parks are not being developed. Also, the cost to move a mobile home to another
location is very high and, therefore, it is becoming economically prohibitive to move
units to other parks. Residents in mobile home parks in many cases are truly a
"captive audience" and cannot relocate to other locations when rent is too high in
their current park.
The task force identified maintenance as a concern in mobile home parks. Lack of
maintenance in parks creates problems for residents in obtaining and/or retaining
insurance. In fact, an entire meeting was devoted to building and health and safety
code matters in order to have a clearer understanding of the responsibilities of
owner/managers and residents.
The task force also identified lack of communication between management and
residents as a problem. Equally important is the need for competent on-site
management. While this is a requirement under section 1606 of the Mobile Home Act,
the task force took public comment which indicates that not all parks meet this
requirement.
Recommendations
The Special Mobile Home Task Force recommends that the Board of Supervisors adopt
a policy stating that:
Each mobile home park should have an established policy for ongoing

The Task Force reviewed a variety of materials, including ordinances from Fremont
and the proposed ordinance by the Contra Costa Mobile Home Owners Association.
Task Force member Stan Hansen also reviewed the history in Concord with the rent
control issue.
Recommendations
The Special Mobile Home Task Force could not reach a consensus on whether there
should be a rent control/stabilization ordinance. If the Board of Supervisors wishes
to implement such an ordinance, the following components could be considered as
part of any such ordinance:
a moratorium on all rental increases while the issue of rent stabilization is
further considered.
a fair means of dispute resolution by way of:

mediation

agreements setting forth a variety of conditions including rental adjustment charges,
arbitration, mediation, and mandatory negotiation by the parties.
Recommendations
The Special Mobile Home Task Force recommends that the Board of Supervisors
consider the following alternatives to rent control.

- Arbitration
- Mediation
- A rental increase or decrease which could be tied to the occurrence of a

ADDENDUM A
The Board on this date considered a report from the special
Mobile Home Task Force on Mobile Home Park issues .
Supervisor DeSaulnier suggested that the Board take public
comment on the issues and he thanked those who had served on the
Mobile Home Task Force .

The Chair also read cards from people who did not wish to
speak but had written comments on issues .
Supervisor DeSaulnier moved to direct this issue back to the
Mobile Home Task Force to develop a rent stabilization ordinance
or accord and to work with County Counsel to draft such an
ordinance or accord and to direct staff to report on the
financial consequences of that ordinance or accord and how it
will be paid for and he also moved to enact an immediate
moratorium on rents that will stay in effect until the task force
returns .
Supervisor Torlakson seconded the motion.
Supervisor DeSaulnier requested the report back from the
Mobile Home Task Force in thirty days, but expressed that the
moratorium would stay in effect until the recommendation is acted
upon.
Supervisor Smith requested clarification on the motion.
Supervisor DeSaulnier clarified the motion.
Supervisor Smith expressed concern with having details
before the Board before acting on this matter, and he expressed
his concerns with the moratorium and his opposition to the
motion.
Supervisor Torlakson suggested separating the two issues
involved, the moratorium and the preparation of the ordinance or
accord.
Supervisor DeSaulnier urged the Board to act on the motion
as stated.
Supervisor Smith concurred with bifurcation of the motion.
Supervisor Bishop expressed support with the motion as a
whole .
Supervisor Torlakson expressed support for bifurcation of
the motion and he expressed his support for the moratorium.
Supervisor DeSaulnier indicated that he would be willing ,to
change his motion to two motions, the first motion being on
everything excluding the moratorium, and the second motion on the
moratorium.
Victor Westman, County Counsel, advised the Board on the
necessary finding before the Board could consider a moratorium.
The vote on the motion including everything but the
moratorium was unanimous with Supervisor Powers absent .
The vote on the second part of the motion was to enact a
moratorium for thirty days on any rent increases in mobile home
parks or continuing until such time as there is a report back on
the language of the ordinance was :

NOES : Supervisor Smith
ABSENT: Supervisor Powers
ABSTAIN: None
Mr. Westman advised the Board that since the Board did not
take action sufficient to constitute an ordinance, that the
motion from a legal point of view is simply a direction of the
Board' s concern in the area but it has no force of law.
Supervisor DeSaulnier commented that the majority of the
Board was giving direction so that the moratorium would be
agendized as County Counsel had recommended, and that a
moratorium will go in effect but there is a question as to
whether it is in effect right now and also giving direction that
if there are rent increases in the interim whether it would be
possible to roll back to this date.
IT IS BY THE BOARD ORDERED that the Special Mobile Home Task
Force and County Counsel are DIRECTED to prepare a rent
stabilization ordinance or accord; staff is DIRECTED to report to
the Board on the financial implications to the County General
Fund of such an ordinance or accord; and staff is DIRECTED to
provide an update report to the Board of Supervisors by October
18 , 1994 on this direction;
IT IS FURTHER BY THE BOARD ORDERED that intent is EXPRESSED
in the interim to adopt a moratorium on mobile home rent
increases and County Counsel is DIRECTED to agenda the intended
moratorium.
