But we need your help and the help of all the citizens who have benefited from the smoke-free ordinances in Contra Costa County. If Prop. 188, the "Philip Morris initiative" passes in November, 93% of the County's population will find their smoking control laws replaced by a much weaker statewide law that brings smoking back into workplaces, restaurants and public places. This past spring tobacco industry giant Philip Morris, Inc. spent close to $2 million to qualify this initiative for the statewide ballot -- over $4 per, signature., Misnamed the "California Uniform Tobacco Control Act," Prop. 188 would overturn all existing and future local and state controls on tobacco. Written into the proposition are outdated indoor ventilation standards which require that only a percentage of the odor of tobacco smoke be removed. These standards do not address the cancer-causing and other toxic substances in environmental tobacco smoke. In August, many Contra Costa County voters received a pro-Prop. 188 slick four- color mailer that professes to protect non-smokers from secondhand smoke. In truth, the over 60 percent of Californians who now live in smoke-free cities will find that protection removed by Prop. 188. And most frightening of all, any changes to Prop. 188 can be made only with 2/3rds approval by the State Legislature. On behalf of the citizens of Contra Costa County who wholeheartedly supported passage of local ordinances, please consider taking the following actions: 1) Please pass a resolution (see enclosed) against Prop. 188 on or by the week of Oct. 17. We are planning "Save Our Local Ordinance" activities during that week. 22) After passage of a resolution, please send a copy to Serena Chen, ALA, 295 -- 27th St., Oakland, CA 94612. Scott President, Bd. of Directors American Lung Association of Contra Costa/Solano Counties Mats Wallin Executive Director American Heart Association N0 88 ON' 8 Coalition for a Healthy California Headquarters:5750 Wilshire Boulevard, Suite 561 /Los Angeles, California 90036 = 8 Telephone 213/937-5706 / Fax 213/937-9613 STOP PHILIP MORRIS Media/Field Office:Telephone 916/442-6287 / Fax 916/442-8585 SAMPLE RESOLUTION (City Council, Board of Supervisors,Board of Education or organization) WHEREAS, tobacco use is responsible for the death of over 400,000 people every year and is the number one cause of death in the United States; WHEREAS, Environmental Tobacco Smoke (ETS), or second hand smoke, has been categorized as a cancer causing substance by the Environmental Protection Agency; and exposure to ETS kills an estimated 40,000 persons every year; WHEREAS, the State of California as well as many counties and municipalities conduct aggressive public education campaigns to discourage tobacco use, particularly among children; WHEREAS, (Name of City) passed a smoking control ordinance in (date) which bans smoking in (describe impact of ordinance) in order to protect people against exposure to ETS; WHEREAS, Proposition 188, mistitled the "California Uniform Tobacco Control Act" would repeal the local smoking control ordinance passed in (Name of City) and replace it with a state wide law which could permit smoking in every restaurant and workplace in the State; WHEREAS, over 60% of the population of California lives in cities and counties which have tougher tobacco controls than contained in Proposition 188, and would suffer reduced protection from ETS if Proposition 188 passes; WHEREAS, Proposition 188 is being sponsored by Philip Morris, the largest cigarette manufacturing company in the world, and they do not deny it; WHEREAS, Proposition 188 prohibits local government from ever passing any tobacco control legislation in the future, and prohibits community organizations from monitoring the illegal sale of cigarettes to minors through tobacco purchase surveys or "sting' operations utilizing minors attempting to purchase tobacco; WHEREAS, the ventilation standards proposed in Proposition 188 for application to indoor smoking will remove the odor of smoke from the air, but not the cancer causing substances which pose a threat to public health; NOW THEREFORE BE IT RESOLVED that the (Name of City, County or organization) opposes Proposition 188; BE IT FURTHER RESOLVED that the (Name of City, County or organization) will take immediate steps to inform the residents of the negative impact of Proposition 188 on the community.
