SUBJECT: OAKLEY ROAD RECONSTRUCTION PROJECT - OAKLEY AREA

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contracts and ACCEPT Grant Deeds dated August 4, 1994, from
Jeanne DiMercurio.
B. AUTHORIZE Public Works Director to execute said Right of Way Contracts on behalf of
the County.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check in the amount of$24,000 payable to Stewart Title Company of Contra Costa,
1870 Olympic Blvd., Walnut Creek, California, 94596, Escrow Nos. 103916W and
103917W, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have above-referenced Grant Deeds recorded in
the Office of the County Recorder.
II. Financial Impact:
,Payment totalling $24,000 from Oakley/North Brentwood Area of Benefit funds.

III. Reasons for Recommendations and Background:
This acquisition is required for the horizontal and vertical alignment of Oakley Road between Live
Oak and Empire Avenue in the Oakley area.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with approved
plans and specifications.

Real property in the southwest quarter of the southeast quarter of Section 22, Township
2 North, Range 2 East, Mount Diablo Meridian, Contra Costa County, California, being a
portion of that parcel of land described as PARCEL ONE in the deed to Jeanne Di
Mercurio, recorded October 31, 1988 in Volume 14686 of Official Records at page 158,
described as follows:
PARCEL ONE: (Permanent R/W)
Commencing at the standard Contra Costa County street monument at the north quarter
corner of Section 27; thence along the north line of Section 27, south 89017'35"east 20.00
feet; thence north 00025'25" east 22.50 feet to the intersection of the north right-of-way
line of Oakley Road and the east right-of-way line of Live Oak Avenue, also being the
southwest corner of said Di Mercurio PARCEL ONE (14686 O.R. 158), the Point of
Beginning; said point shall hereinafter be referred to as Point A; thence from the Point of
Beginning, along the north line of Oakley Road, south 89017'35" east 220.00 feet to the
east line of said Di Mercurio PARCEL ONE (14686 O.R. 158); thence along said east line,
north 00°25'25" east 10.00 feet to a point which shall hereinafter be referred to as Point
B; thence leaving said east line, north 89017'35" west 110.00 feet; thence south 85030'37"
west 110.40 feet to Point A, the Point of Beginning.
Containing an area of 1,650 square feet of land, more or less.
PARCEL ONE-T: (Temporary Construction Easement - To expire June 30, 1994, or upon
completion of construction, whichever occurs first)
A 10.00 feet wide strip of land, described as follows:
The southerly line of said 10 feet wide temporary construction easement is the line
between Points A and B as described in PARCEL ONE above.
Containing an area of 2,204 square feet of land, more or less.
Bearings are based on the California Coordinate System Zone III (C.C.S.27).
