Recommended Action: A. APPROVE Right of Way Contracts and ACCEPT Grant Deeds dated August 4, 1994, from Jeanne DiMercurio. B. AUTHORIZE Public Works Director to execute said Right of Way Contracts on behalf of the County. C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to issue a check in the amount of$24,000 payable to Stewart Title Company of Contra Costa, 1870 Olympic Blvd., Walnut Creek, California, 94596, Escrow Nos. 103916W and 103917W, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have above-referenced Grant Deeds recorded in the Office of the County Recorder. II. Financial Impact: ,Payment totalling $24,000 from Oakley/North Brentwood Area of Benefit funds. Reasons for Recommendations and Background: This acquisition is required for the horizontal and vertical alignment of Oakley Road between Live Oak and Empire Avenue in the Oakley area. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with approved plans and specifications.
