I. Recommended Action:
That the Board ratify the District Manger's authorization of up to $30,000 for Rogers/Pacific
Company (engineering geologists) for project BH 94/95-30.

III. Reasons for Recommendations and Background:
As reported in our first and second quarter financial reports for Fiscal Year 94-95, a year ago we
learned that several areas within the Blackhawk GHAD District were experiencing ground
settlement and, in some cases, distress to homes. Our budget for Fiscal Year 94-95 included an
increased allocation for geologic studies to determine the cause of this phenomenon.
Several property owners became concerned about distress,cracking and displacement within their
houses. These concerns resulted in three potential lawsuits. As a result of these lawsuits, we
accelerated the geologic studies to determine whether or not our District was responsible for
repairs. As a result, we invoked "emergency procedures" to enable the consulting geologists to
accelerate their studies, recognizing their total fees would probably exceed the standard
authorization limit of $20,000.
District Bylaws allow approval by the District Manager of projects up to $20,000, but require the
Board of Directors (Board of Supervisors') approval for projects over $20,000, unless the project
is deemed to be an "emergency project". In this case the project may proceed, but the Board
must ratify after the project is completed. The job is nearly complete and costs will total
approximately $30,000.
