MICHAEL WALFORD, CHIEF ENGINEER DATE: September 13, 1994 SUBJECT: Declaration of Emergency for Creek Bank Repairs at Site 5 in San Ramon Creek, Alamo Area Project No.: 7520-61391-03-93 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION 1. Recommended Action: 1. FIND and DECLARE that the work described below constitutes channel protection and maintenance work covered by Public Contract Code Section 21191. 2. FIND and DECLARE that the work described below is emergency work that is necessary to protect life and property from impending flood and erosion damage. 3. AUTHORIZE the Chief Engineer or his designee to proceed in the most expeditious manner to arrange for the work described below and to enter into one or more contracts therefore. 11. Financial Impact: The total cost of the work, including contract administration and inspection, is estimated to be $65,000. This project is funded by FEMA (75%), State OES (18.75%), and Flood Control Zone 313 (6.25%). Reasons for Recommendations and Background: On June 24, 1994, the Public Works Maintenance Division received informal bids for the bank repairs at Site 5 on San Ramon Creek. An award to the low bidder could not be made at that time because of the need for an Army Corp. of Engineers Permit and related Water Quality Certification Waiver from the Regional Water Quality Control Board. This permit and waiver were not obtained until late August. On August 24, 1994, the low bidder informed the Public Works Maintenance Division that they could no longer proceed with the work because of its heavy workload. The second bid ($55,200) is over the $50,000 informal bid limit preventing the Chief Engineer from executing a contract in accordance with Ordinance 93-59. The creek bank repairs are urgently needed before the rainy season to protect the creek improvements, State Highway(1-680) improvements, commercial and residential properties in the immediate vicinity. There is inadequate time to readvertise this project and make the repairs before the rainy season and before the Corps permit expires. It is essential that the Chief Engineer be given the authority granted by this declaration to expedite the bank repairs without the delay of formally rebidding this project. IV. Consequences of Negative Action: Without this declaration, the repairs cannot be made this year. The creek bank will be subject to further erosion and possible failure, endangering life and property next winter before repairs could be made next spring or summer.
