RESOLUTION NO. 94/ 439
SUBJECT: Determination of Property Tax )
Exchange for the proposed FUA-2)
Boundary Reorganization No. 2 )

WHEREAS, Section 99 of the Revenue and Taxation Code provides that in
the event of a jurisdictional change that would affect the service area or
service responsibility of one or more special districts, the Board of
Supervisors shall, on behalf of the district or districts, negotiate any
exchange of property tax revenues; and
WHEREAS, the FUA-2 Boundary Reorganization No. 2 involves the annexation
of territory to the City of Antioch and the Delta Diablo Sanitary District
which is covered by existing tax transfer agreements; and
WHEREAS, the FUA-2 Boundary Reorganization No. 2 also involves the
annexation of territory to the Contra Costa County Fire Protection District
and the concurrent detachment from the East Diablo Fire Protection District
which will affect the service responsibilities of the districts;
NOW,. THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA
COSTA COUNTY DOES HEREBY DETERMINE that 100 percent of the property tax
revenue accruing to the East Diablo Fire Protection District from the
affected .territory of the FUA-2 Boundary Reorganization No. 2 shall be
transferred to the Contra Costa County Fire Protection District. The terms
of this property tax exchange agreement shall be effective for the fiscal
year for which the State Board of Equalization makes the tax rate area
changes for this jurisdictional change and shall apply in subsequent years
unless changed by the mutual agreement of affected agencies or subsequent
jurisdictional changes . This resolution does not change the property tax
revenues accruing to other agencies servicing the subject territory or the
affected agencies ' right to collect taxes for existing bonded indebtedness .
The property tax exchange agreement discussed above shall apply to affected
territory as submitted or revised by the Local Agency Formation Commission.
