Giddin s CITY CLERK CC-100 MAR 83 WHITE -ADDRESSEE CANARY -CITY CLERK PINK-ORIGINATING DEPARTMENT lg RESOLUTION NO. 94-80 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CERRITO CALLING FOR A SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING THE REDEVELOPMENT PLAN AMENDMENT TO THE VOTERS, REQUESTING THE COUNTY TO CONSOLIDATE THIS ELECTION WITH THE GENERAL STATEWIDE ELECTION AND TO PROVIDE THE SERVICES OF THE COUNTY CLERK IN CONDUCTING THE ELECTION AND AUTHORIZING THE FILING OF AN IMPARTIAL ANALYSIS AND WRITTEN ARGUMENTS WHEREAS, the City .Council of the City of E1 Cerrito adopted Ordinance No. 94-4 amending the E1 Cerrito Redevelopment Plan as a guide to future redevelopment activities within the City of E1 Cerrito; and WHEREAS, the City Council determined that this amendment shall not go into effect until Ordinance No. 94-4 is approved by a majority of the voters voting on this amendment at a special municipal election to be held on Tuesday, November 8, 1994; and WHEREAS,, the City costs for this special municipal election will be reduced considerably if the special election is consolidated with the statewide general election which will be held on November 8, 1994. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City .of E1 .Cerrito that: 1. A special municipal election is hereby called and shall be held in the City of El Cerrito on Tuesday, November 8, 1994 for the purpose of submitting to the qualified voters of the City of El Cerrito the measure specified in the following section. . 2 . The exact form of the measure to be voted on shall request the qualified voters of the City of E1 Cerrito to specify "Yes" or "No" to the following: MEASURE: REDEVELOPMENT PLAN AMENDMENTS Shall the E1 Cerrito Redevelopment Plan be amended as provided for in, Ordinance No. 94-4 to permit the El Cerrito Redevelopment Agency to continue to undertake redevelopment activities? 3 . Pursuant to California Elections Code Section 23302, the Board of Supervisors of Contra Costa County is hereby requested to consent and agree to the consolidation of this special municipal election with the statewide general election which will also be held on Tuesday, November 8, 1994 . 1 4. Pursuant to California Elections Code Section 22003 , the Board of Supervisors of Contra Costa County is hereby requested to permit the Contra Costa County Clerk to provide such services as -may be necessary to properly and lawfully conduct and hold the special municipal election in the City of E1 Cerrito on November 8, 1994, including, but not limited to; the providing and printing of ballots and polling cards, election supplies, voting booths, flags, registration lists and any other materials and services required to lawfully conduct the election. 5. The Board of Supervisors of Contra Costa County is hereby authorized and directed to canvass the returns of the special municipal election to be held in the City of E1 Cerrito on November 8, 1994, and to certify such canvass to the City Council of the City of El Cerrito. 6. The polls for this election shall be opened at 7: 00 a.m. of the day of this election, and shall remain open continuously until 8 : 00 p.m. of the same day, when the polls shall be closed except as provided in Section 14301 of the California Elections Code. 7. In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for the holding of municipal elections. 8. The E1 Cerrito City Clerk is hereby authorized to certify to the County of Contra Costa that any and all necessary costs and expenses incurred by the Clerk of the County of Contra Costa in conducting this special municipal election on November 8 , 1994 shall be reimbursed in full by the 'City of El Cerrito upon the presentation of statements therefor. 9. The E1 Cerrito City Clerk is directed to give further or additional notice of the special municipal election in the time, form and manner required by law. 10. The City Council authorizes Mayor Jane A. Bartke and Councilmember W. Mae Ritz, with such citizens and organizations as they may choose, to file a written argument in favor of the City measure in accordance with California Elections Code Section 5013 . 11. Arguments for or against the City measure shall not be longer than 300 words in length and shall be submitted to the E1 Cerrito City Clerk no later than 4: 00 p.m. on August 19, 1994 . 12 . The City Council hereby adopts the provisions of California 'Elections Code Section 5014, subd. (a) . Pursuant to that section, rebuttal arguments shall be permitted provided that the rebuttal arguments do not exceed 250 words in length and provided that these rebuttal arguments are submitted to the E1 Cerrito City Clerk no later than 4: 00 p.m. on August 29, 1994 . 2 13 . The El Cerrito City Clerk is hereby directed to submit to the City Attorney a certified copy of the City measure. The City Attorney is hereby directed to prepare an impartial analysis of the measure showing the effect of the measure on the existing law and existing operations. The City Attorney shall submit this to the Registrar of Voters, or other appropriate officer of the County of Contra Costa, for printing by August 19, 1994. This analysis shall not exceed 500 words in length and shall otherwise comply in all respects with the applicable provisions of the California Elections Code. 14. The E1 Cerrito City Clerk is hereby directed to file with the Board of Supervisors of Contra Costa County and with the Contra Costa County Clerk a certified copy of this Resolution, and to take all other actions necessary to effectuate the directives of this Resolution.
