SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated July 20, 1994, from
Maurice J. Bales and Marianne J. Bales.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $5,150.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Chicago Title Company, 590
Ygnacio Valley Road, Suite 300, Walnut Creek, Ca., 94596, Escrow No. 76100 to be
forwarded to the Real Property Division for delivery.

Payment of $5,150 is funded by S.T.P. (60%), A.O.B. (22%) and road funds (18%).
111. Reasons for Recommendations and Back-ground:
These property rights are required for the Olympic Boulevard Widening project in accordance
with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

PARCEL 3 (FEE TAKE)
Real property in an unincorporated area of Contra Costa County, California. Being a portion of that
parcel of land deeded to Maurice J. Bales and Marianne J. Bales as co-trustees of the M & M Bales
Trust recorded May 16, 1988 in Book 14332 of Official Records at page 796, records of said
County.
Commencing at the northwesterly corner of Lot 39 as shown on that Map titled "Dewing Park", filed
July 24, 1913 in Book 10 of Maps at page 242, records of said County; thence northeasterly along
the northwesterly line of said Lot 39 north 59039'22" east 24.11 feet to the northerly corner of that
parcel of land deeded to Contra Costa County, recorded January 16, 1964 in Book 4533 of Official
Records at page 415, said point being the Point of Beginning; thence from said Point of Beginning
continuing along the northwesterly line of Lot 39 north 59039'22" east 2.24 feet to a point which shall
hereinafter be referred to as Point "A"; thence leaving said Point "A" being a point on the
northwesterly line of Lot 39, south 03018'38" east 70.99 feet to a point on the easterly line of said
Contra Costa County parcel (4533 O.R. 415), from which a radial line of a non-tangent curve
concave to the east, having a radius of 558.00 feet, the center of which bears north 81050'02" east;
thence northerly along said curve, through a central angle of 04051 '20", an arc distance of 47.29
feet; thence continuing along said easterly line, north 03018'38" west 22.74 feet to the Point of
Beginning.
Containing an area of 110 square feet of land more or less.
PARCEL 3T: (TEMPORARY CONSTRUCTION EASEMENT to expire December 31, 1995 or at
completion of construction whichever occurs first).
Being a strip of land 3.00 feet in width measured at right angles and radially, lying east of the
following described line:
Beginning at Point "A" as described above; thence leaving said Point of Beginning south 3°18'38"
east 70.99 feet to a point on the easterly line of said Contra Costa County parcel (4533 O.R. 415)
said point also being the beginning of a non-tangent curve concave to the east having a radius of
558.00 feet, the center of which curve bears north 81050'02" east; thence southerly along the arc
of said curve through a central angle of 4°01'21" an arc length of 39.18 feet to the southerly
terminus of the herein described line. The side lines of the herein described strip to lengthen or
shorten to extend between the northwesterly and southeasterly lines of said Bales Parcel (14332
O.R. 796).
Containing an area of 330 square feet of land, more or less.
