Additionally, provide copies of the letter to our congressional and state legislators . BACKGROUND INFORMATION: In 1988 the Liberty Union High School District acquired a 60-acre site in Oakley for the siting of a much needed second high school facility to serve the East County area. In 1994, Measure B was passed overwhelmingly (by 75% ) by residents of the District to raise funds for the construction of the high school itself . New federal regulations or interpretation thereof have now raised the possibility of delays in construction of the new high school campus . V STA C6- September 20, 1994 Liberty Union High School District 20 Oak Street Brentwood, CA 94513 Dear Liberty Union High School District Board.of Trustees: We have been working in cooperation with Liberty Union High School since 1988 to establish a new high school in the Oakley area. The subject site has been extensively farmed for years and is surrounded by the Oakley community. Construction of a high school has required the passage of a bond measure and has received 75% of the residential vote. The project has now been placed in jeopardy due to a broad interpretation of policy with respect to.kit fox habitat. It should be clear to everyone that no kit fox sighting has occurred. What has occurred has been an extension of federal authority into an area that had previously been within local land use prerogative. Ultimately, the site will be released because of the obvious lack of appropriate habitat characteristics. In the meantime, costs will escalate placing this project into jeopardy. It is important that: local, state and federal officials sit down and work to develop habitat programs rather than create a reactive posture that forces political solutions to environmental problems.
