I. Recommended Action:
DIRECT the Public Works Director in the future to notify property owners of new assessments and
to schedule public hearing dates as close to the publishing of the assessment roll as possible.
DIRECT the Public Works Director to work with the development community to make sure that
estimated landscaping assessments in disclosure statements reflects the true cost to maintain
such landscaping.
SET the annual assessment rate for County Landscaping District, LL-2 Zone 42 as follows:
For Fiscal Year 94/95: $100 per parcel
For Fiscal Year 95/96: Minimum $100 to a maximum of$165 per parcel
For Fiscal Year 96/97: Minimum $100 to a maximum of$210 per parcel
After Fiscal year 96/97: Maximum of$210 per parcel. This amount can
be exceeded only after a duly noticed public
hearing.

III. Reasons for Recommendations and Background:
On July 26, 1994, at the public hearing to set the annual assessment rates for all the zones in
County Landscaping District LL-2, the Board directed the Public Works Director to investigate,
report and recommend appropriate actions regarding the lapse in notifications of the public
hearing, cost estimate discrepancies for landscape maintenance, and the noticed annual
assessment for Zone 42.
Before a new assessment is levied or an existing assessment is increased, the governing board
of any local agency is required to hold public hearings, and send notices of the hearing to all
affected property owners whose names appear on the last certified assessment roll. In the past,
the public hearings have been scheduled in July, almost four months after the certified
assessment rolls were published. Because of the time lapse, many buyers of new homes during
this period do not receive the notices. Staff recommends that the public hearing be scheduled
as close to the publishing of the assessment roll as possible to reduce the chance of new owners
not receiving the notices. Staff also recommends that copies of the notices be sent to the sales
offices of the developments so that prospective buyers be made aware of the assessment.
The Board is also concerned about how the estimated landscape assessment is computed in the
disclosure statement of Zone 42. About six months ago, a committee of developers, consulting
engineers and public works staff was formed to streamline the land development process and to
insure the quality of the development. It is recommended that this matter be referred to this
committee for a recommendation to the Board in three months.
The Board also directed Public Works to investigate if the assessment for Zone 42 can be
reduced to the$100 estimated cost stated in the disclosure statement. Normally, for anew zone,
full assessment will be collected at the beginning of the fiscal year, even though it may be many
months before the County will take over the maintenance. The excess funds will then be put in
reserve to pay for extraordinary maintenance, or to defray future cost increases. It is possible to
reduce the initial assessment to $100 per parcel per year by removing all reserves. The
recommended assessment schedule has been reviewed and agreed to by the residents of Zone
42. It is important to point out that every time any extraordinary maintenance or major
replacement of playground equipment is needed, the Board will have to hold public hearings to
increase the assessment to cover the costs.
IV. Consequences of Negative Action:
Zone 42 will not be able to collect any assessment for the needed landscape maintenance work.
