County Administrator DATE: August 2, 1994 SUBJECT: FIRE DISTRICT CONSOLIDATION AGREEMENT WITH THE CITY OF ORINDA Specific Request(s) or Recommendation(s) & Background & Justification RECOMMENDATIONS: 1 . AUTHORIZE Chair, Board of Supervisors to execute an agreement with the City of Orinda under the terms of which the Contra Costa County Fire District will implement a paramedic program in the Orinda area in return for support by the City for the annexation of the Orinda Fire District to the Contra Costa County Fire District. 2 . AUTHORIZE Supervisor Jeff Smith to sign the ballot argument in support of the Orinda Fire District annexation measure on the November ballot and coordinate obtaining other signatures from Orinda officials to the ballot argument. 3 . REQUEST the Orinda City Council to approve the agreement between the County and the City on August 9, 1994, authorize. an appropriate Council member to sign the ballot argument in support of this annexation of the Orinda Fire District and actively support the annexation to the fullest extent possible. REASONS FOR RECOMMENDATION/BACKGROUND: The Orinda Fire District was not included in the recent (effective July 1, 1994 ) County fire district consolidation because the voters of the District submitted a sufficient number of petition signatures to require voter approval of the proposed annexation of the Orinda Fire District. McGraw (646-4855) Attested: cc: County Administrator Phil B tchelor, Clerk of Auditor-Controller the Board of Supervisors County Counsel and County Administrator LAFCO Contra Costa County Fire By: , DEPUTY District United Professional Firefighters Local 1230 f The Orinda City Council opposed the annexation of the Orinda Fire District but authorized two council members to carry on a series of meetings with Supervisor Jeff Smith to attempt to develop conditions that would make the annexation acceptable to the City and would enable the City to support the annexation of Orinda Fire. After several meetings of Supervisor Smith and Council members, they reached an agreement regarding the annexation which they believe to be in the best interests in protecting the community and its citizens . The major provisions of the agreement are as follows : • Establishes an Urban/Wildlands Interface Zone coterminous with the present boundaries of the Orinda Fire District for three to five years . • Requires Contra Costa County Fire to initiate a paramedic program in the Zone. • Requires that property taxes generated within the Zone be used within the Zone for current services, capital and the paramedic program. • The Orinda City Council will serve as an advisory body to the Board of Supervisors fire district services in the Zone. • The Zone may be modified or eliminated within three to five years if the! paramedic program has been fully and permanently implemented. o The Orinda City Council will actively support the annexation of Orinda Fire to Contra Costa County Fire. Ballot arguments regarding the annexation measure must be submitted to the County Election Department before August 19, 1994 . Therefore, it proposed that the County Administrator's Office work with Supervisor Smith to prepare the ballot material for submission to the Elections Department. The Orinda City Council will consider the agreement on August 9, 1994 . It is recommended that the Council be urged to approve the agreement, authorize one of its council members to sign the ballot and begin supporting the annexation in every possible way within legal limits .
