MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: August 2, 1994 SUBJECT: Approve Consulting Services Agreement with Kingston Cole & Associates for installation of Fibreoptic cables in the Southern Pacific Railroad Rights-of-Way, Alameda and Contra Costa County area. SPECIFIC REQUESTS) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Public Works Director to execute a consulting services agreement with Kingston Cole and Associates of Mill Valley effective May 9, 1994. The purpose of the consulting services agreement is to assist staff to prepare the request for proposals and subsequent negotiation for licensing agreements for non-exclusive licenses to install fibreoptics cables in the Southern pacific Railroad Rights-of-way (SPROW) in Alameda and Contra Costa counties. The payment limit of the agreement is $49,975 with cannot be exceeded without prior authorization from the Public Works Director. ll. Financiallmpact: NONE (39% SPROW trust account funds and 61% Alameda County funds). III. Reasons for Recommendations and Background: On September 20, 1993, the Board of Supervisors approved a consulting services agreement to Kingston Cole and Associates to explore the feasibility of licensing the rights of way of SPROW for fibreoptics cables. The report by the consultant indicated that the telecommunication industry is very interested in the corridor. The consultant further reported that the corridor will be more valuable if we join with Alameda County to offer a corridor from Concord to Livermore and Fremont. Reasons for Recommendations and Background: (Cont'd) On February 1, 1994 the Board of Supervisors approved a memorandum of understanding with Alameda County to jointly offer the SPROW for fibreoptics installation and direct staff to retain the service of an expert to assist with counties to prepare the request for proposal and to subsequently negotiate the licensing agreements. IV. Consequences of Negative Action: The potential revenue of$700,000 per year could be lost.
