BACKGROUND/REASON(S) FOR RECOMMENDATION(S): On July 14, 1987, the County executed a fiscal agreement with the Clayton Redevelopment Agency which, in part, obligated $400,000 in redevelopment funds for County library purposes. The amended agreement increases the obligation to $500,.000 and provides for procedures for the County Librarian to spend the funds. Contact:Tony Enea,646-4094 ATTESTEDAugust 16 , 1994 PHIL BATCHELOR,CLERK OF THE BOARD OF SUPERVISORS cc: CAO AND COUNTY ADMINISTRATOR County Librarian City of Clayton County Redevelopment Director BY � ,DEPUTY r /r2- 4 a FIRST AMENDMENT TO AGREEMENT CONCERNING TAX INCREMENT FROM THE CLAYTON REDEVELOPMENT PROJECT AREA This First Amendment to Agreement Concerning Tax Increment From the Clayton Redevelopment Project Area (the "Amendment") is entered into as of this 17th day of August , 1994, by and among the Redevelopment Agency of the City of Clayton (the "Agency"), the City of Clayton (the "City"), the County of Contra Costa (the "County") and the Contra Costa County Library District (the "Library District"). RECITALS A. The Agency, the City, the County and the Library District entered into the Agreement Concerning Tax Increment From the Clayton Redevelopment Project Area dated July 14, 1987 (the "Agreement"), whereby, the Agency agreed to pay to the County and the Library District certain amounts of tax increment revenues to alleviate any financial burden or detriment suffered by the County and the Library District as a result of the adoption of the Clayton Redevelopment Plan (the "Plan"). B Pursuant to the Agreement the Agency agreed to pay for the construction of a library in the City of Clayton to mitigate the financial burden or detriment suffered by the County and the Library District as a result of adoption of the Plan. In the event the Agency failed to pay for the construction of the library, the Agreement provides for the Agency to pay to the Library District a comparable sum of money to compensate for the cost of the library. C. The City was awarded a State of California grant to construct the Clayton Community Library, which will be owned by the City and operated by the County under an agreement between the City and the County. D. In order to operate the Clayton Community Library, $500,000 is necessary to purchase and process the materials collection. E. The parties have agreed that in lieu of the payment to the Library District in the Agreement, the financial burden or detriment suffered by the County and the Library District can be mitigated by a payment by the Agency to the County in the sum of $500,000. F. The parties hereto agree to amend the Agreement as follows. 1 r' NOW, THEREFORE, the parties do hereby agree as follows. 1. The Agency, in lieu of constructing a library, will pay to the County the amount of Five Hundred Thousand Dollars ($500,000) to be used for acquisition and processing of the materials collection of the Clayton Community Library (the "Library Purposes Payment"). 2. The County hereby designates the City to act as its purchasing agent to purchase and process the materials collection and hereby directs the Agency to pay the Library Purposes Payment directly to the City for such purposes. 3. The Agency's payment of the Library Purposes Payment hereby discharges any and all obligations of the Agency pursuant to Section 1(B) of the Agreement. 4. This Amendment shall only amend Section 1(B) of the Agreement. All other provisions of the Agreement shall remain in full force and effect. COUNTY: AGENCY: COUNTY OF CONT A CO TA REDEVELOPMENT AGENCY OF THE CITY OF CLAYTON By: By: IC4-�- Chairm n, Board of Supervisors Chairman, Board of Directors CONTRA COSTA COUNTY CITY: LIB RY DIS IC By: By: Mayor ATTEST: Agency Secretary 2 RESOLUTION 50-94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLAYTON APPROVING THE FIRST AMENDMENT TO AGREEMENT CONCERNING TAX INCREMENT FROM THE CLAYTON REDEVELOPMENT PROJECT AREA WITH CONTRA COSTA COUNTY WHEREAS, the Clayton Redevelopment Agency and Contra Costa County propose discharging obligations concerning library purposes contained in the original tax increment financing agreement by committing to the purchase of an opening day book collection in the amount of $500,000.00; and WHEREAS, the process will be expedited and facilitated by contracting for the purchase through the City of Clayton administrative staff; and WHEREAS, the Agency will pay the obligation directly to the City on behalf of the County, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF CLAYTON as follows: 1. The City of Clayton agrees to act as purchasing agent for the acquisition and processing of the opening day book collection for the Clayton Community Library, and to waive any administrative fees or charges. 2. The City of Clayton agrees to receive and account for monies paid by the Clayton Redevelopment Agency on behalf of Contra Costa County, for the purpose of funding the book purchase. 3. The Mayor is hereby authorized to execute the "First Amendment to Agreement Concerning Tax Increment From The Clayton Redevelopment Project Area." Passed and adopted at a regular meeting of the Clayton City Council on August 16, 1994, by the following vote: AYES: Council Members Kendall , Manning, Vice Mayor Pierce, Mayor Laurence NOES: None ABSENT: Council Member Li ttorno Mayor ATTEST: City Clerk RESOLUTION 94-3 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CLAYTON APPROVING THE FIRST AMENDMENT TO AGREEMENT CONCERNING TAX INCREMENT FROM THE CLAYTON REDEVELOPMENT PROJECT AREA WITH CONTRA COSTA COUNTY WHEREAS, the Clayton Redevelopment Agency and Contra Costa County propose discharging obligations concerning library purposes contained in the original tax increment financing agreement by committing to the purchase of an opening day book collection in the amount of $500,000.00; and WHEREAS, the process will be expedited and facilitated by contracting for the purchase through the City of Clayton administrative staff; and WHEREAS, the community will benefit from the acquisition of an appropriate initial book collection, NOW, THEREFORE, BE IT RESOLVED BY THE REDEVELOPMENT AGENCY OF THE CITY OF CLAYTON as follows: The Chairman of the Board of Directors of the Clayton Redevelopment Agency is hereby authorized to execute the "First Amendment to Agreement Concerning Tax Increment From The Clayton Redevelopment Project Area."
