SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
1. Recommended Accton:
A. APPROVE Right of Way Contract and ACCEPT Temporary Construction Easement dated
July 29, 1994, from John H. Russell and Nancy H. Russell.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $900.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to John H. Russell and Nancy H.
Russell, 24970 Hesperian Blvd., Hayward, Ca., 94545. Check to be forwarded to the
Real Property division for delivery.

D. DIRECT the Real Property Division to have the above referenced Temporary Construction
Easement recorded in the office of the County Recorder.
II. Financiallmpact:
Payment of $900.00 is funded by S.T.P. (60%), A.O.B. (22%) and road funds (18%).
III. Reasons for Recommendations and Background:
These property rights are required for the Olympic Boulevard Widening project in accordance
with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTURE, made by and between JOHN H. RUSSELL and NANCY H. RUSSELL, or their.
successor(s), Trustee(s) under Revocable .Trust Agreement dated November 12, 1981, as amended,
hereinafter called the GRANTOR, and CONTRA COSTA COUNTY, a political subdivision of the State
of California, hereinafter called the GRANTEE,
WITNESSETH :
That the GRANTOR, for value received,, hereby grants to the GRANTEE, and its successors and
assigns, a temporary easement for the purpose of a construction work area, over and across that
certain real property in the County of Contra Costa, State of California, described as follows:
FOR DESCRIPTION SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF.
The easement herein granted shall include the right to enter upon said land with personnel, vehicles
and equipment, to remove all vegetation and landscaping thereon that interfere with the purpose for
which the easement herein is granted, by said GRANTEE, its officers, agents, and employees, and by
persons under contract with it and their employees in connection with the road construction project.
TO HAVE AND TO HOLD, all and singular, the rights above described unto the GRANTEE and the
GRANTEE's successors and assigns until completion of construction or December 31, 1995,whichever
occurs first.

completion of construction whichever occurs first).
Real property in an unincorporated area of Contra Costa County, California being a portion of that
parcel of land described in the deed to John H. Russell, et ux recorded November 23, 1981 in Book
10584 at page 690 Official Records of said County, described as follows:
Beginning at the intersection of the southerly line of PARCEL 2 as said parcel is described in the
deed to R. Norman Borgwardt, et ux recorded June 23, 1978 in Book 8893 at page 97 of Official
Records and a line parallel with and 42.00 feet westerly (measured at right angles) from the
proposed "centerline of Tice Valley Boulevard as shown on the map entitled "A precise section of
the streets and highways plan, Contra Costa County, Tice Valley Boulevard" recorded April 25, 1961
in Book 3853 at page 149 both Official Records of said County; thence along said parallel line south
3018'38" east 25.00 feet; thence leaving said parallel line south 86041'22"west 5.00 feet; thence north
3018'38" west 25.00 feet to the southerly line of said Borgwardt Parcel (8893 O.R. 97); thence along
said line north 86041'22" east 5.00 feet to the Point of Beginning
Containing an area of 125 square feet of land more or less.
Bearings and distances are based on the California Coordinate System Zone III (C.C.S. 27). To
