SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated June 21, 1994 from Pacific
Gas & Electric.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of the
County.
C. APPROVE payment of $17,375.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Old Republic Title Company, 3000
Clayton Road, Concord, CA., 94519, Escrow No. 192686-CD to be forwarded to the Real
Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded in the
office of the County Recorder.
ll. Financial lmpact:
Payment of $17,375 from Neroly Road widening project funds.

III. Reasons for Recommendations and Background:
These property rights are required for the Neroly Road widening project in accordance with the
approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in the southwest quarter of Section 22, Township 2 North, Range 2 East, Mount
Diablo Meridian, Contra Costa County, California, being a portion of Pacific Gas and Electric
Company parcel (granted to predecessor Standard Pacific Gas Line Incorporated) recorded April
1. 1943 in Volume 728 of Official Records at page 113, described as follows:
Bearings are based on the California Coordinate System Zone III (C.C.S. 27) taking south 89049'28"
east as the bearing of State Highway 4 between monuments VH-10 and VH-11 as shown on the
Precise Traverse of Victory Highway.

Beginning on the west line of said Pacific Gas and Electric Company parcel (728 O.R. 113) at the
southwest corner of that parcel of land described in the deed to the State of California recorded
March 8, 1968 in Volume 5576 of Official Records at page 262; thence along the boundary of said
Pacific Gas and Electric Company parcel, south 0°32'59"west 319.85 feet and south 89049'28" east
10.50 feet; thence leaving said boundary, north 0032'59" east 101.62 feet; thence south 89027'01"
east 5.00 feet to a point hereinafter referred to as "Point A'; thence north 0032'59" 194.31 feet;
thence north 45032'59" east 36.39 feet to a non-tangent curve concave to the north having a radius
of 22,058.00 feet to which a radial bears south 0008'03" west; thence along the arc of said curve,
westerly 5.88 feet, through a central angle of 0000'5511; thence non-tangent to said curve, south
86°46'04"west 27.94 feet, to an angle point on the south line of said State of California parcel (5576
