Spooner, Contracts Administrator Costa DATE: County SUBJECT: Approve Standard- Agreement (Amendment) #29-396-4 with the State Department of Health Services, Chronic Disease Branch - Tobacco Control Section SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: . Approve and authorize the Chair, Board of Supervisors, to execute on behalf of the County, Standard Agreement (Amendment) #29-396-4 (State #89-97896-03) with the State Department of Health Services, Chronic Disease Branch - Tobacco Control Section, effective July 1, 1992, to amend Standard Agreement #29-396 (as amended by Standard Agreement [Amendments] #29-396-2 and #29-396-3) . II. FINANCIAL IMPACT: Approval of Standard Agreement (Amendment) #29-396-4 incorporates the County' s FY 1992-93 allocation, provides firm funding amounts through FY 1992-93 , and projected funding amounts for FY 1993-94 , as follows: ENCUMBERED FUNDS PROJECTED FUNDING FY 1989-90 $ 536, 615 FY 1993-94 $ 328, 041 FY 1990-91 $ 533 , 729 FY 1991-92 $ 368 , 619 FY 1992-93 $ 352 , 407 TOTAL $1,791, 370 TOTAL CONTRACT PAYMENT LIMIT $2, 119, 411 The final fiscal year allocation is an estimate that may increase, decrease or stay the same depending on fluctuations in future tobacco tax revenues. No County match is required. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: On June 19, 1990, the Board approved Standard Agreement #29-396 with the State Department of Health Services, effective January 1, 1990 through December 31, 1992 , which allocated to the County, a share of Proposition 99 Tobacco Tax revenues for tobacco education services. Subsequent actions (#29-396-1, #29-396-2 and #29-396-3) resulted in approval of the Preliminary Tobacco Control Plan and Budget, extended the term of the agreement through June 30, 1994 and provided firm funding amounts through FY 1991-92 . For the purposes of this Agreement, the Local Plan required under Health and Safety Code Section 24164 and the Supplement to such Local Plan required under the Welfare and Institutions Code Section 14148.95 shall hereinafter be referred to as the Comprehensive Plan. The approved Comprehensive Plan is hereby incorporated by this reference and made a part of this Agreement. The Comprehensive Plan shall be submitted in accordance with the guidelines issued on February 14, 1992 entitled Revised Comprehensive Tobacco Control Guidelines and Supplemental Perinatal Outreach Guidelines. CONTROLLER E Coarity of Contra Costa Contract Number 89-97896-03 The LLA agrees to expend funds received under this contract in accordance with the approved budget and budget documentation contained in its approved Comprehensive Plan. The LLA also agrees that the allocation of funds pursuant to the Agreement is contingent upon the Department's approval of the LLA's Comprehensive Plan and any amendments thereto. No funds shall be allocated, under subparagraph (c) of this paragraph, in any given fiscal year unless a Comprehensive Plan and any amendments thereto have been approved by the Department for that fiscal year. Amendments to the LLA Comprehensive Plan must be approved by the Department. The Department shall notify the LLA in writing of the effective date of such approvals. The LLA agrees that each amendment to a LLA Comprehensive Plan and any written documentation of approval by the Department shall be incorporated by this reference and made a part of this Agreement. b. The term of this contract shall be from January 1, 1990 to December 31, 1994. C. The maximum amount to be allocated under this Agreement from Fiscal Year (FY) 1989-90 is $536,615; from FY 1990-91 is $533,729; from FY 1991-92 is $368,619; from FY 92-93 is $352,407; and, from FY 1993-94 is $328,041. e. The maximum amount that shall be allocated under this contract shall not exceed $2,119,411. 2. Paragraph 2 (a) is amended to read: a. The Department shall make prospective quarterly allocations to the LLA to provide services and deliverables pursuant to paragraph 2 of this Agreement, upon receipt and Department approval of a prospective allocation invoice submitted by the LLA. The prospective allocation invoice shall be submitted in a form and format prescribed by the Department. The LLA agrees to submit cost reports and progress reports. The cost reports will specify actual expenditures for tobacco education and perinatal services previously provided by the LLA. The cost and progress reports shall be submitted in a form, format and schedule prescribed by the Department. The LLA agrees that subsequent prospective allocations shall be contingent upon receipt and Department approval of progress and cost reports. The LLA agrees that if, after review of a progress or cost report, the Department determines that all of the allocated funds have not been expended during the period covered by the progress or cost report, to provide the services identified in the LLA's approved Comprehensive Plan, the Department may offset the value of the services not rendered against future prospective quarterly allocations, and that such offsets shall not be considered withholds. Page 2 of 3 Col-Ahiy of Contra Costa Contract Number 89-97896-03 3. Paragraph 5 (b) is amended to read: b. No funds received under this contract shall be spent after December 31, 1994. Unspent funds shall be identified and returned to the State no later than April 30, 1995 to the address specified in paragraph 2 (b) above. The words "Unspent Tobacco Control Program Funds" and the contract number shall be written on the face of the check or warrant that the LLA has issued to return unspent funds. 4. The effective date of this amendment is July 1, 1992. 5. All other terms and conditions of said agreement shall remain in full force and effect. Page 3 of 3
