RECOMMENDATION: AWARD the contract W.A.Thomas Co.,Inc.,the lowest responsible bidder, for the EI Pueblo Administration Building and Handicap Unit Remodeling Project, CA011005,Pittsburg, in the amount of$430,000; DENY the appeal of the bid award by Three J's Development Inc. AUTHORIZE the Executive Director Of the Housing Authority to to execute a contract with W.A.Thomas Co.Inc. pending receipt of satisfactory performance and payment bonds and insurance certificates, as recommended by the Advisory Housing Commission. H. FINANCIAL IMPACT: This contract is funded by HUD's Comprehensive Improvement Assistance Program (CTAP). There are no County general funds involved in the funding of this contract. Ill. There were eight (8) bids received. Funding for this public housing modernization project is provided through the U.S. Department of Housing and Urban Development's Comprehensive Improvement Assistance Program. The Contract Representative determined that the lowest monetary bidder, Three J's Development Co., Inc. (Three J's) had failed to meet the MBE (14%)goal for this project, had failed to meet the WBE goal for this project (6%), and had failed to document adequate good faith effort to comply with said goals as required by the project specifications. Three J's,was notified in writing of the Contract Representative's determination on August 24, 1993. Three J's appealed this decision claiming that "your determination that our good faith does not exist is only an opinion not fact". I reviewed the matter and denied the appeal noting that Three J's had failed to take the steps required to demonstrate a good faith effort, specifically, they had failed to "identify, list and select specific items of the project to be performed by MBEs and/or WBEs and failed to solicit by certified letter the required number of MBEs and WBEs, and failed to follow up the initial solicitation". Review of the other bids submitted revealed that the other three lowest monetary bidders had also not met the MBE/WBE goals and also had not demonstrated satisfactory "good faith efforts" to obtain MBE/WBE participation. These three bidders were notified that their bids were being considered non-responsive but no appeal was received. The fifth lowest monetary bidder, W.A. Thomas Co., Inc., attained a 16.4% MBE participation and a 7.6% WB.E participation, achieving the stated M/WBE goals. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect not to approve the execution of a contract with W.A. Thomas Co., Inc. and deny the appeal of Three J's,the Housing Authority may experience scheduling delays which may jeopardize funding allocated to this project.
