& RECOGNIZE DEPU'T'Y SHEIRFFS' ASSN. AS MAJORITY REPRESENTATIVE
SPECIFIC REQUEST(P) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. In accordance with Section 34-12.008(d) (Unit Determination) of County
Employee Relations Resolution 81/1165, confirm the recommendation of the
Employee Relations Manager that a new bargaining unit composed of sworn
Management classifications in the County Sheriff's Department and called the
Sheriff's Management Unit, be established effective the day following Board
action. The classes to be included are:
Class Code
Captain 6XDA
Deputy Sheriff - Chief, Criminalistics Laboratory 6DDA
Lieutenant 6XHA
Deputy Sheriff - Supervising Criminalist 6DHA
2. In accordance with Section 34-12.014 (Optional Verification Procedure) of
County Employee Relations Resolution 81/1165, recognize the Deputy Sheriffs'
Association (DSA) as the majority representative of the Sheriff's Management
Unit based upon verification by the Employee Relations Officer that payroll
dues deduction cards are on file for this organization by at least 51% of the
employees in the unit. Such recognition to be effective the day following
Board action.
FISCAL IMPACT:
None.
REASONS FOR RECOMMENDATION/BACKGROUND:
On June 22, 1993, DSA filed a petition for formal recognition as majority
representative of sworn management classes including Assistant Sheriff, Captains
and Lieutenants. Proof of employee approval exceeded the minimum 30%requirement
for qualifying and the Board acknowledged receipt of the petition on July 20, 1993.
As required by the County Employee Relations Resolutions, a twenty-one day
posting period to allow other recognized employee organizations to intervene in the
unit determination process and/or appear on a representational election ballot has
been completed. No other recognized employee organization has intervened. Meet
and confer sessions between the County and DSA have reached agreement on
composition of the unit and proof of employee approval of at least 51% of the
employees represented has been verified.

SUBJECT: Approval of Bargaining Unit for Sheriff ' s Sworn Managers

Staff recommends that the Board adopt the attached Board Order on
September 21, 1993 which will ( 1) confirm a new bargaining unit
composed of four sworn management classifications in the Sheriff ' s
Department and (2) formally recognize the Deputy Sheriff 's
Association (DSA) as the majority representative for the unit.
On July 20, 1993, the Board acknowledged receipt of a petition
filed by the DSA for formal recognition as majority representative
of a unit composed of the classes of Assistant Sheriff, Captain and
Lieutenant. As required by the County Employer-Employee Relations
Resolution, a twenty-one (21 ) day posting period to allow other
recognized employee organizations to intervene in the unit
determination process and/or appear on a representational election
ballot has been completed. No other organization has intervened.
In discussions between the County, the Sheriff ' s Department and the
DSA, agreement has been reached on the final composition of this
unit. The classes to be included are:
Captain (6XDA)
Deputy Sheriff - Chief, Criminalistics Laboratory ( 6DDA)
Lieutenant ( 6XHA)
Deputy Sheriff - Supervising Criminalist ( 6DHA)
There are currently a total of five ( 5) Captains, one ( 1) Chief
Criminalist, one ( 1) Supervising Criminalist and twenty (20)
Lieutenants . Under the optional verification procedure allowed in
Section 34-12 . 014 of the Employee Relations Resolution 81-1165,
staff has ascertained that DSA qualifies as majority representative
by verification of dues deductions cards exceeding 51% of the
employees in the unit.
