AN ORDINANCE OF THE
CONTRA COSTA COUNTY FLOOD CONTROL
AND WATER CONSERVATION DISTRICT
IMPLEMENTING THE INFORMAL BIDDING
PROCEDURES OF THE UNIFORM PUBLIC
CONSTRUCTION COST ACCOUNTING ACT
The Board of Supervisors of Contra Costa County, as the governing
body of the Contra Costa Flood Control and Water Conservation
District, ordains as follows:
SECTION I. SUMMARY. This ordinance is adopted pursuant to
Public Contract Code Section 22034 for the purpose of implementing
the informal bidding procedures of the Uniform Public Construction
Cost Accounting Act.
SECTION II. DEFINITIONS. The following definitions shall apply
to terms used in this ordinance:
(1) "Commission" means the California Uniform Construction
Cost Accounting Commission.
(2) "Department" means the public works department.
(3) "Public project" means a project involving any of the
work defined in Public Contract Code Section 22002.
SECTION III. NOTICE INVITING INFORMAL BIDS. (a) Where a
public project is to be performed which does not exceed $50, 000, a
notice inviting informal bids shall be mailed by -the department to
all contractors for the category of work being bid, as shown on the
list developed under Section 1108-3.206, or to all construction
trade journals specified in Public Contract Code Section 22036, or
to both all contractors on the list for the category of work being
bid and all construction trade journals specified in Section 22036.
Notice may be sent to additional contractors or construction trade
journals at the discretion of the department. If there is no list
of qualified contractors maintained by the department for the
particular category of work to be performed, the notice inviting
informal bids need only be sent to the construction trade journals
specified by the commission.
(b) Notwithstanding the provisions of subsection (a) , if the
product or service is proprietary in nature such that it can be
obtained only from a certain contractor or contractors, the notice
inviting informal bids may be sent exclusively to such contractor
or contractors.

(c) All mailing of notices to contractors and construction
trade journals shall be completed no later than 10 calendar days
before bids are due.
(d) The notice inviting informal bids shall describe the
project in general terms, shall specify how to obtain more detailed
information about the project, and shall state the time and place
for submission of bids.
SECTION IV. CONTRACTORS LIST. For purposes of inviting informal
bids, the chief engineer shall develop and maintain a list of
qualified contractors, identified according to categories of work,
in accordance with the criteria promulgated from time to time by
the commission.
SECTION V. AWARD OF INFORMAL CONTRACTS. Pursuant to Public
Contract Code Section 22034, the authority to award informal
contracts for those public projects which do not exceed $50, 000 is
delegated to the chief engineer to be exercised in accordance with
all applicable laws and county policies.
SECTION VI. EXEMPT PROJECTS. The procedures set forth in this
chapter shall not apply in any of the following situations:
(1) Where a public project qualifies as an emergency under
Public Contract Code Section 22035, 21191, or other statutory
authority;
(2) Where a public project is otherwise exempt from bidding
requirements under Public Contract Code Section 22032 (a) or other
statutory authority.
SECTION VII. EFFECTIVE DATE. This ordinance becomes effective
thirty days after passage, and within fifteen days after passage
this ordinance shall be published once with the names of
supervisors voting for and against it in the Contra Costa Times, a
newspaper published in this county.

(Informal Bidding Procedures for Public Projects)
The Board of Supervisors of Contra Costa County ordains as follows
(omitting the parenthetical footnotes from the official text of the
enacted or amended provisions of the County Ordinance Code) :
SECTION I. SUMMARY. This ordinance is adopted pursuant to
Public Contract Code Section 22034 for the purpose of implementing
the informal bidding procedures of the Uniform Public Construction
Cost Accounting Act.
SECTION II. Chapter 1108-3 is added to the County Ordinance Code
to read:

1108-3 .202 Definitions. The following definitions shall
apply to terms used in this chapter:
(1) "Commission" means the California Uniform Construction
Cost Accounting Commission.
(2) "Department" means the public works department, the
general services department or the county administrator's office,
whichever one is soliciting bids for a particular public project.
(3) "Public project" means a project involving any of the
work defined in Public Contract Code Section 22002 .

1108-3 .204 Notice inviting informal bids. (a) Where
a public project is to be performed which does not exceed $50, 000,
a notice inviting informal bids shall be mailed by the department

trade journals specified in Public Contract Code Section 22036, or
to both all contractors on the list for the category of work being

in accordance with the criteria promulgated from time to time by

1108-3 . 208 Award of informal contracts. Pursuant to
Public Contract Code Section 22034 , the authority* to award informal
contracts for those public projects which do not exceed $50, 000 is
delegated to the public works director, the director of general

1108-3 .210 Exempt projects. The procedures set forth in

Public Contract Code Section 20134 (a) , 20395, 22035, or other
statutory authority;
(2) Where a public project is otherwise exempt from bidding
requirements under chapter 1108-2, Public Contract Code Section
20394, 20395, 22032 (a) , or other statutory authority;
(3) Where alternative procedures are available under Public
Contract Code Section 22031 or other statutory authority and the
county elects to use such alternative procedures.

UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT

ordains as follows:
