SUBJECT: LEGISLATION - AB 2268 (Caldera)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ADOPT a position in SUPPORT of AB 2268 by Assemblyman Caldera,
which would require any child under the age of 18 to wear an
approved :,elmet when riding a bicycle, and AUTHORIZE the Chairman
to send a letter of .support to the Governor, asking the Governor to
sign AB 2268.
BACKGROUND:
Existing law prohibits a person operating a bicycle on a highway
from allowing a person who is 4 years of age or younger, or weighs
40 pounds or less, to ride as a passenger on a bicycle unless the
passenger is wearing a helmet meeting specific standards .
Assemblyman Caldera has introduced AB 2268 which would, in
addition, prohibit a person under the age of 18 from operating, or
riding on a bicycle as a passenger, unless the person is wearing a
helmet meeting specified standards .
The bill provides that during 1994 a person who violates this
requirement shall be given a warning that it is a violation of law
to ride a bicycle without an approved helmet. Beginning in 1995,
a violation would be punishable by a . fine of $25 .
Of the revenue collected from these fines, 72 .5% is to be deposited
in a special account for the County Health Services Department, to
be used for bicycle safety education and for assisting low-income
families obtain bicycle helmets. Of the revenue collected from
these fines, 2 . 5% is to be used to administer this bicycle safety

within a city, the remaining 25% is transferred to the city. If
the violation occurs in the unincorporated area of the County, the
remaining 25% is to be used for the bicycle safety and helmet
assistance program.
AB 2268 has passed the Legislature and is currently on the
Governor' s Desk. Staff from the Prevention Program in the Health
Services Department have recommended that the Board of Supervisors
support AB 2268 and authorize the Chairman to send a letter to the
Governor urging him to sign AB 2268 .
