SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
Approve and authorize the Chair, Board of Supervisors, to execute on
behalf of the County, Standard Agreement (Amendment) #29-202-54
(State #91-12416-A5) with the State Department of Health Services,
effective February 1, 1993 , to amend Standard Agreement #29-202-48
(effective July 1, 1991 through June 30, 1994) for County's Family
Planning Services. This Amendment decreases the payment limit for
Fiscal Year 1992-93 by $13 , 065, from $143 , 965 to a new fiscal year
total of $130,900.
II. FINANCIAL IMPACT:
This Amendment reduces the maximum reimbursable amount of State
funding for FY 1992-93 by $13 , 065, from $143 , 965 to a new total of
$130, 900, to reflect the actual level of services provided by the
County's Family Planning Services during the fiscal year. No County
funds are required.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
For many years, the County has provided family planning services to
citizens of child-bearing age who would otherwise be unable to
obtain these services. The family planning services funded through
this Contract are available to persons who request such services
through County facilities. The County must bill any other possible
payment source, such as Medi-Cal, before seeking reimbursement from
the State for services provided.
The County has billed the State for Family Planning Services
actually provided during FY 1992-93 , and this Amendment is a method
for the State to disencumber unexpended funds.
The Board Chair should sign eight copies of the agreement. Seven
signed copies of the agreement and three certified copies of this
Board Order should be returned to the Contracts and Grants Unit for
submission to the State Department of Health Services.

1. In that certain agreement between this Department and County of Contra Costa
Health Services dated July 1, 1991 and amended on December 1, 1991 and on
January 1, 1992 and on July 1, 1992 and on January 1, 1993:
A. Paragraph 3.A. (2) is amended to read as follows:
" (2) The maximum amount payable under this contract for services
rendered during the fiscal year 1992-93 (July 1, 1992 - June 30, 1993)
shall not exceed $130,900. "
B. Paragraph 3.A. (4) is amended to read as follows:
"(4) The maximum amount payable under this contract shall not
exceed $319,800. "

1. The Contractor agrees to indemnify,defend and save harmless the State,its officers.agents and employees
from any and all claims and losses accruing or resulting to any and all contractors. subcontractors,
materia men.laborers and any other person.firm or corporation furnishing or supplying work services.
materials or supplies in connection with the performance of this contract.and from anv and all claims and
losses accruing or resulting to any person.firm or corporation who may be injured or damaged by the
Contractor in the performance of this contract.
?. The Contractor.and the agents and employees of Contractor.in the performance of the agreement.shall
act in an independent capacity and not as officers or empiovees or agents of State of California.
3. The State may terminate this agreement and be refiered of the payment of attyconsideration to Contractor
should Contractor fail to perform the covenants herein contained at the time and in the manner herein
provided. In the event of such termination the State may proceed with the work in any manner deemed
proper by the State. The cost to the State shall be deducted from any sum due the Contractor under this
agreement.and the balance.if any,shall be paid the Contractor upon demand.
3. Without the written consent of the State,this agreement is not assignable by Contractor either in whole
or in part.
=. Time is of the essence in this agreement.
6. No alteration or variation of the terms of this contract shall be valid unless made in writing and signed by
the parties hereto.and no oral understanding or agreement not incorporated herein.shall be binding on
any of the parties hereto.
7. The consideration to be paid Contractor. as provided herein. shall tie in compensation for ail of
Contractor's expenses incurred in the performance hereof, including travel and per diem. unless.
otherwise expressly so provided.

EXHIBIT C-3
PAYMENT PROVISIONS
OFFICE OF FAMILY PLANNING
JULY 1, 1992-JUNE 30, 1993
A. The contractor shall have general spending authority at rates not to
exceed those published in the Guidebook for Family Planning Services,
Part 3, entitled "Schedule of Maximum Allowances". These payment
provisions shall further be governed by the appropriate "Standards' in
the Guidebook, Division A.
B. The maximum amount payable under Exhibit C-3, shall be allocated
as follows:
1. The Contractor shall have spending authority for providing
contraceptive and pregnancy testing services. The maximum amount
shall not exceed $130,900.
There are no further subdivisions of this paragraph B.

C. Paragraph 4.B. is amended to read:
"B. The Guidebook for Family Planning Services (Guidebook) , consisting
of 163 pages numbered A.l.i through B.5.81, originally dated
July 1, 1986 and amended on July 1, 1987, September 1, 1987,
September 1, 1988, July 1, 1989, February 1, 1990, July 1, 1990,
July 1, 1991 and July 1, 1992, is hereby made a part of this
contract by this reference. Said Guidebook has been sent to the
Contractor prior to the Contractor entering into contract. By
signing .this contract, the Contractor acknowledges receipt and
review of said Guidebook. The Contractor further agrees to abide
by and comply with the standards, protocols, and procedures
established by the Department of Health Services and contained in
said Guidebook. Any amendments to the Guidebook shall be made in
accordance with Paragraph 24 of the Exhibit A(S) . The Contractor
agrees that the Office of Family Planning may make nonsubstantive
and grammatical changes to the Guidebook that do not affect the
substance or intent of this agreement, without contract amendment.
The Office of Family Planning will notify the Contractor of such
changes by written provider letter.
D. Subparagraph 2 of Paragraph 5.A, on page 5, is hereby amended to read:
12. Exhibit C-3, for fiscal year 7-1-92 to 6-30-93;
Upon the effective date of this amendment, all references to Exhibit C
for fiscal year 1992/93 in the body of this agreement, and in any
exhibits thereto, shall hereinafter be deemed to read Exhibit C-3 for
fiscal year 1992/93. "
2. The effective date of this amendment is February 1, 1993.
3. All other terms and provisions of said agreement shall remain in full
force and effect.
