Adopted this Order on September 14, 1993 by the following vote:

SUIRJECT: Vacancy on the Contra Costa County Fire Protection District Board of Fire
Commissioners
The Board received a July 19, 1993 letter from the City of Concord advising of the
untimely death of Donald J. MacIntosh, the City of Concord nominee to the Contra Costa
Fire Protection District's Board of Fire Commissioners, and requesting the Board to grant an
exception to its policy to hold in abeyance any appointments to fill vacancies on Boards of
Fire Commissioners.
IT IS BY THE BOARD ORDERED that the seat on the Contra Costa County Fire
Protection District's Board of Fire Commissioners held by Donald J. Maclntoch, a City of
Concord nominee, is DECLARED VACANT, and the vacancy is REFERRED to the Internal
Operations Committee.

Dear Supervisor McPeak:
We understand from Fire Chief Little that the Board has adopted a policy to hold in abeyance
any appointments to fill vacancies on the Boards of Fire Commissioners pending a determination
of fire district restructuring and related issues. Due to the untimely death of its Commissioner,
Donald J. MacIntosh, the City of Concord is inadvertently left without this representation at a
critical juncture in the discussion and resolution of these issues.
The City therefore asks-the Board to reconsider its policy, or to otherwise grant an exception
to it. While we await clarification of the City's representation on the Board of Fire
Commissioners, we plan to have staff representation at Fire Commissioners meetings.
