Recommended Action: INTRODUCE ordinance prescribing the process and procedures for obtaining informal bids as required by the California Uniform Construction Cost Accounting Act of the Public Contract Code, WAIVE reading, and FIX September 21, 1993 as date of adoption. II. Financial Impact: Reduces the cost of advertising projects. III. Background: This ordinance will prescribe the process and procedures for obtaining informal bids as required by law for the County to become subject to the California Uniform Construction Cost Accounting Act of the Public Contract Code. The advantages are that it (1) reduces the cost and simplifies the advertising of projects, (2) allows the negotiation of a contract if no responsive bids are received, (3) raises the informal bid limit to $50,000 and (4) allows the Director of General Services or Public Works Director to award informal contracts. IV. Consequences of Negative Action: Would result in more money spent on advertising of projects. THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on September 14, 1993, by the following vote: AYES: Supervisors Powers , Smith, Bishop, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Election To Become Subject ) To Uniform Public ) RESOLUTION NO. 93/ 528 Construction Cost ) Accounting Act procedures ) The Board of Supervisors of Contra Costa County, meeting in all its capacities pursuant to Contra Costa County Ordinance Code Section 24-2.402, RESOLVES THAT: WHEREAS, prior to the enactment of the Uniform Public Construction Cost Accounting Act (Chapter 2 [commencing with Section 22000] of Part 3 of Division 2 of the Public Contract Code) , existing law did not provide a uniform cost accounting standard for construction work performed or contracted by local public agencies; and WHEREAS, the Act establishes such a uniform cost accounting standard; and WHEREAS, the Commission established under the Act has developed uniform public construction cost accounting procedures for implementation by local public agencies in the performance of or in the contracting for construction of public projects; NOW, THEREFORE, the Board hereby ELECTS under Public Contract Code Section 22030 to become subject to the uniform public construction cost accounting procedures set forth in the Act and to the Commission's policies and procedures manual and. cost accounting review procedures, as they may each from time to time be amended. This election shall apply to the following Board- governed entities: Contra Costa County, Contra Costa County Flood Control and Water Conservation District, Bethel Island Fire Protection District, Contra Costa County Fire Protection District, Crockett-Carquinez Fire Protection District, East Diablo Fire Protection District, Moraga Fire Protection District, Oakley Fire Protection District, Orinda Fire Protection District, Riverview Fire Protection District, West County Fire Protection District, Contra Costa County Sanitation District No. 5, Contra Costa County Sanitation District No. 6, and Contra Costa County Sanitation District No. 19. In connection with said election, and in order to implement the provisions of Public Contract Code Section 22003, the Public.Works Director, the Director of General Services and the County Administrator, within their respective areas, may utilize the informal bidding procedures set forth in the Act when contracting for maintenance work or when contracting for any other work which does not fall within the definition of public project, as defined in Public Contract Code Section 22002. SECTION II. DEFINITIONS. The following definitions shall apply to terms used in this ordinance: (1) "Commission" means the California Uniform Construction Cost Accounting Commission. (2) "Department" means the public works department. (3) "Public project" means a project involving any of the work defined in Public Contract Code Section 22002. SECTION III. NOTICE INVITING INFORMAL BIDS. (a) Where a public project is to be performed which does not exceed $50,000, a notice inviting informal bids shall be mailed by the department to all contractors for the category of work being bid, as shown on the list developed under Section 1108-3.206, or to all construction trade journals specified in Public Contract Code Section 22036, or to both all contractors on the list for the category of work being bid and all construction trade journals specified in Section 22036. Notice may be sent to additional contractors or construction trade journals at the discretion of the department. If there is no list of qualified contractors maintained by the department for the particular category of work to be performed, the notice inviting informal bids need only be sent to the construction trade journals specified by the commission. (b) Notwithstanding the provisions of subsection (a) , if the product or service is proprietary in nature such that it can be obtained only from a certain contractor or contractors, the notice inviting informal bids may be sent exclusively to such contractor or contractors. (c) All mailing of notices to contractors and construction trade journals shall be completed no later than 10 calendar days before bids are due. (d) The notice inviting informal bids shall describe the project in general terms, shall specify how to obtain more detailed information about the project, and shall state the time and place for submission of bids. For purposes of inviting informal bids, the public works director shall develop and maintain a list of qualified contractors, identified according to categories of work, in accordance with the criteria promulgated from time to time by the commission. The procedures set forth in this chapter shall not apply in any of the following situations: (1) Where a public project qualifies as an emergency under Public Contract Code Section 22035 or other statutory authority; (2) Where a public project is otherwise exempt from bidding requirements under Public Contract Code Section 22032 (a) or other statutory authority. (2) "Department" means the public works department, the general services department or the county administrator's office, whichever one is soliciting bids for a particular public project. Pursuant to Public Contract Code Section 22034, the authority to award informal contracts for those public projects which do not exceed $50,000 is delegated to the public works director, the director of general services and the county administrator to be exercised in accordance with all applicable laws and county policies. The procedures set forth in this chapter shall not apply in any of the following situations: (1) where a public project qualifies as an emergency under Public Contract Code Section 20134 (a) , 20395, 22035, or other statutory authority; (2) Where a public project is otherwise exempt from bidding requirements under chapter 1108-2, Public Contract Code Section 20394, 20395, 22032 (a) , or other statutory authority; (3) Where alternative procedures are available under Public Contract Code Section 22031 or other statutory authority and the county elects to use such alternative procedures.
