THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

SUBJECT: Granting of a Franchise to Operate Pipelines in County
Roadways. 4500-2190SAS 6G5269
The Board of Supervisors of Contra Costa County Resolves that:
1. A written application has been made by Chevron USA, Inc. to the Board of
Supervisors for a franchise to continue to operate one (1) 12-inch natural gas
pipeline and one (1) 2-inch condensate gas pipeline obtained by purchase
from the Shell Pipeline Corporation. It is proposed to grant such franchise
in the manner provided by law, substantially in the form and upon the terms
and conditions set forth in the attached "Notice of Sale of Franchise" and
Ordinance No. 1827 (as amended by Ordinance No. 79/50 and Ordinance No.
92/64), and it is in the public interest to give this notice.
2. The Board of Supervisors hereby fixes October 5, 1993 at 11:00 a.m. as
hearing date and time and the Clerk of the Board is hereby authorized and
directed to advertise by publishing the attached "Notice of Sale of Franchise"
in the Contra Costa Times, a newspaper of general circulation, printed and
published in this County, at least once within fifteen (15) days after the
passage of this Resolution.

• NOTICE OF SALE OF FRANCHISE
(Pipelines in County Roads)
NOTICE IS HEREBY GIVEN THAT:
I. An application has been made to the Board of Supervisors of the County of
Contra Costa, State of California, by Chevron USA, Inc., for a franchise to continue to
operate one (1) 12-inch steel, dry natural gas pipeline, and one (1) 2-inch steel, condensate
gas pipeline along Nichols Road from it's intersection with Port Chicago Highway northerly
until exiting into the right-of-way of the AT & SF railroad (lineal distance approximately
1140 feet each). The Board proposes to grant this non-exclusive franchise for a term of
twenty (20) years in accordance with the terms set forth in Contra Costa County Ordinance
No. 1827 (as amended by Ordinance No. 79/50 and Ordinance No. 92/64).
II. The grantee of this franchise and its successors and assigns will, during the life
of the franchise, pay to the County an annual fee as specified in Ordinance No. 1827 (as
amended by Ordinance No. 79/50 and Ordinance No. 92/64). The fee shall be paid annually
from the date of the granting of the franchise. In addition, the grantee shall pay fees in
arrears from the date the pipeline was obtained from the Shell Pipeline Corporation. In the
event payments are not made, the franchise shall be forfeited.
III. A public hearing has been set for October 5, 1993, at 11:00 am. All persons
having any objection to the granting of this franchise may appear before the Board of
Supervisors and be heard. At any time not later than the hour set for the hearing of
objections, any person interested may make a written protest stating objections against the
granting of the franchise. Any protests shall be signed by the protestant and delivered to
the Clerk of the Board of Supervisors.
If no protest in writing is delivered to the clerk up to the hour set for hearing, or such
protests as are filed have been heard and determined by the legislative body to be
insufficient, or have been overruled or denied, the Board of Supervisors may grant the
franchise.
