SUBJECT: APPROVE CONSULTING SERVICES AGREEMENT WITH ENGEO INCORPORATED FOR
SEDIMENT SAMPLING AND TESTING OF THE LOWER WALNUT CREEK CHANNEL,
AVON AREA

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE and AUTHORIZE the Chief Engineer to execute the Consulting Services Agreement
with Engeo Incorporated to perform sediment sampling and testing for the lower Walnut Creek
Channel from Suisun Bay to the confluence of Grayson Creek. Engeo Incorporated has met the
requirements of the County's .Minority and Women Business Enterprise Service Contracts
Compliance Program.
II. Financial Impact:
The contract cost is $57,255. The cost will be funded by the Flood Control Zone 3B.
III. Reasons for Recommendations and Background:
The Flood Control District is developing a silt removal project in the lower Walnut Creek Channel.
The channel was improved by the Corps of Engineers in the mid-sixties and dredged in 1973.
The Corps of Engineers then turned over the channel maintenance responsibilities to the District.
The channel has accumulated approximately 800,000 cubic yards of silt and most of its length
is inundated by tidal waters from Suisun Bay. There are significant environmental and regulatory
agency requirements affecting such removal and disposal of the silt. This contract is a first step
to determine the sediments' composition, and to detect the presence of pollutants which may
restrict the ability to dispose the sediment.

IV. Consequences of Negative Action:
The Flood Control District has been directed by the Department of the United States Army Corps
of Engineers to arrange.for the removal of the sediment to restore the design capacity of the
Walnut Creek Channel. Failure to perform sampling of the sediment would delay the project and
may result in flooding of the area and be in violation of the Operations and Maintenance
Agreement with the Corps of Engineers.

At the request of Emma Kuevor, Contract Compliance Officer, this memo was prepared to
explain any misunderstanding there may be about the MBE/WBE goals used or obtained for
this project. The Consultant Services Agreement is set for approval on the September 14,
1993 Board of Supervisors agenda.
In March, 1992, a Request for Proposals was sent to consultants to provide the sampling and
testing of the sediment, as well as a biological assessment of the Lower Walnut Creek
Channel.
In June, 1992, Engeo Inc. was selected to perform the work. They met the current goals of
twenty percent MBE and seven percent WBE of the County's MBE/WBE Contract
Compliance Program.
In August, 1992, the arrangement for executing the Consultant Services Agreement was
suspended due to the uncertainty of available funds caused by the reduction of the State and
County budgets.
In November, 1992, the County's goals were changed to reflect a goal of 5 percent MBE and
10 percent WBE.
In April, 1993, the project was reactivated, but with a reduced scope to include only the soils
sampling and testing. Engeo has achieved 71 percent MBE and 7.3 percent WBE compli-
ance as required during the Spring of 1992. In light of the fact that the original Request for
Proposals was sent before the MBE/WBE goals were changed, Emma Kuevor, Contract
Compliance Officer, recommends that the 1992 MBE/WBE goals in assessing this project
for compliance be used.
