Spooner, Contracts AdministratoCOSta DATE: September 1, 1993 40 County SUBJECT: Amendment of Board Order Approving the Exchange of Use Contract #26-023-48 with the Department of Veterans Affairs SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Amend the Board of Supervisors Order, dated May 11, 1993 , which authorized the Health Services Director or his designee (Frank Puglisi, Jr. ) to execute on behalf of the County, Exchange of Use Contract #26-023-48 with the Martinez Veterans Administration Outpatient Clinic for the period from April 1, 1993 through March 31, 1994, to change the term of the Agreement to July 15, 1993 through June 30, 1994 , with fixed rates for Fiscal Years 1994-95 and 1995-96, for provision of certain specialized medical services by each party. II. FINANCIAL IMPACT: This Contract is funded in the Health Services Department's Enterprise I Budget. Under the . terms of this . Exchange of Use Contract, the County's Merrithew Memorial Hospital will provide certain medical services for VAOPC patients, and VAOPC will provide certain medical services for the County's patients. Each party will be paid a fee for service in accordance with the fee schedules incorporated in the Contract. The Department of Veterans Affairs has approved rates through June 30, 1996 for certain procedures. The services provided for the County's patients under this Contract are billable to patients and third party payors. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: For many years, the County maintained a contractual relationship with the Martinez Veterans Administration Medical Center, (U.S. Department of Veterans Affairs) through a mutual sharing agreement, which has made available to the County specialized medical services not available at Merrithew Memorial Hospital and Clinics due to lack of resources, equipment, and personnel. The prior agreement expired December 31, 1992 . Auditor-Controller Supervisors and County Administrator Contractor M362/7-e8 BY DEPUTY Amended Board Order Agreement #26-023-48 Page 2 The Martinez Medical Center closed and therefore inpatient services are no longer available, but under this new sharing agreement, the Department of Veterans Affairs Northern California System of Clinics (VAOPC) will continue to provide specialized laboratory testing, radiology services, nuclear medicine studies, CT scans, MRI's, dermatology, gastroenterology, urology, audiology and speech, and opthalmology services for the County. The County will provide Emergency Room treatment and inpatient care, including certain ancillary services, for VAOPC-referred patients. Contract documents have always been prepared by the Veterans Administration and require final approval from the Department of Veterans Affairs in Washington, D.C. At the time that your Board approved the sharing agreement on May 11, 1993, the local VA did not have final approval of the rates from Washington, and the VA was unable to provide services for the County during the time period originally approved by your Board. The VAOPC has now received Federal approval of fee rates for most of the services to be provided for the County, and in the Federal contracting process, the contract term changed from April 1, 1993 through March 31, 1994 to July 15, 1993 through June 30, 1994 . Federal approval of the rates for nuclear medicine studies has not yet been received, but upon receipt of those rates, the Department intends to request your Board's approval and authorization to contract for nuclear medicine studies for the time period designated by the Federal Department of Veterans Affairs.
