MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: AUGUST 3, 1993 SUBJECT: PROPOSED REVISION OF PROPERTY ACQUISITION ACCEPTANCE PROCEDURES FOR REAL PROPERTY INTERESTS VALUED AT LESS THAN $25,000 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE the recommendation of the Public Works Director to establish cost saving procedures related to the acquisiton of real property rights and AUTHORIZE County Counsel to draft an ordinance pursuant to Government Code Section §25350.60 authorizing the Public Works Director or designee to perform all acts necessary to approve and accept any interest in real property which does not exceed $25,000 in value. II. Financial Impact: A substantial amount of time is currently spent processing routine property acquisitions (valued at less than $25,000) for approval and acceptance by the Board of Supervisors. If the proposed ordinance is adopted, this time will be cut dramatically as the Agenda process can be eliminated and all such approvals and acceptances can be processed by the Public Works Department. Transition costs to implement the new procedure are estimated to be nominal. III. Reasons for Recommendations/Background: The Government Code provides for the above stated procedure. Its implementation would eliminate the current formal weekly agenda processing and preparation that requires considerable time by many individuals within the Public Works Department, Board Clerk's office, and others, including the Board. Accounting Proposed Revision of Property Acquisition August 3, 1993 Page Two The public will be further served as well as the time period between receipt and processing of most documents, and in many instances the payment for same, could be reduced from 3-4 weeks to a matter of days. In almost all instances the property interests that could be processed in the proposed manner appear before the Board as consent items in the Agenda and are approved by the Board without comment. Items involving over$25,000 would continue to be brought to the Board's attention for approval and acceptance as presently done. Since approximately 80-90% of all property interest acceptances range between 0 and $25,000, most would be affected by this recommendation. Deeds of Development Rights, Easements, Consents to Offers of Dedication, Deferred Improvement Agreements, Deeds, Offers of Dedication, etc., all could be processed within the Public Works Department without Agenda preparation or Board time being required for review. In 1992, there were approximately 140 Agenda items that could have been handled as proposed. This proposal is one of many recently developed within the Public Works Department in response to the request of the County Administrator and the Board to involve all employees in seeking further efficiencies in County government. IV. Consequences of Negative Action: Continuance of a procedure that is not as responsive to the public nor as efficient in its use of County staff and the Board's time.
