The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Board on August 3, 1993, passed Resolution No. 93/476 and Notice fixing
August 17, 1993, at 9:00 a.m., in its Chambers, County Administration Building, Martinez,
California, as the time and place when it would meet to consummate the conveyance of
the real property described therein to TRIOND; said Notice was duly published in the
Contra Costa Times.
This Board, hereby finds, that said property is no longer required for present or
future County use and the exchange of real property with TRIOND for property adjacent
to County property is of equal value.
This Board hereby:
A. APPROVES the Right of Way Contract between Contra Costa County and
TRIOND and the conveyance of the property located in the Bay Point area,
to TRIOND upon TRIOND conveying adjacent property to the County;
B. ACCEPTS the deed dated July 16, 1993, from TRIOND;
C. AUTHORIZES the Public Works Director to execute. said Right of Way
Contract.
D. AUTHORIZES the Board Chair to execute a Grant Deed to TRIOND on
behalf of the County;
E. APPROVES payment of $86,700 as balance of acquisition and exchange
for said property rights;
F. AUTHORIZES the Auditor-Controller to issue a check in said amount
payable to Old Republic Title Company, 659 Main Street, Martinez, CA.,
94553, Escrow No.: 127914 to be forwarded to the Real Property Division
for delivery;

For Value Received, TRIOND, a California general partnership, does hereby GRANT to
CONTRA COSTA COUNTY, a political subdivision of the State of California, all that real
property in the County of Contra Costa, State of California,
FOR DESCRIPTION SEE EXHIBIT "A' ATTACHED HERETO AND MADE A PART
HEREOF.
The grantor further understands that the present intention of the grantee is to construct
and maintain a public highway on the lands hereby conveyed in fee and the grantor, for
itself, its successors and assigns, hereby waives any claims against Contra Costa County
for any and all damages to grantor's remaining property contiguous to the property
hereby conveyed by reason of the location, construction, landscaping or maintenance of
said highway within the property herein described.
This conveyance is made for the purpose of a freeway and the grantor hereby releases
and relinquishes to the grantee any and all abutter's rights of access appurtenant to
grantor's remaining property in that area shown -in blue on the attached Exhibit"B"

Notice is hereby given that the Board of Supervisors, of Contra Costa County, on August
3, 1993, declared its intention to convey to TRIOND the following described real property:
All that certain real property in the County of Contra Costa, described as follows:
PARCELS 51262-1 AND 512641:
Real property in the unincorporated area of West Pittsburg, Contra Costa County,
California, being a portion of the southeast quarter of the northwest quarter of Section 14,
Township 2 North, Range 1 West, Mount Diablo Meridian, described as follows:
A portion of PARCEL 51262 described in the deed to Contra Costa County recorded
October 22, 1992, in Volume 17958 at page 705, and a portion of PARCEL 51264
described in the deed to Contra Costa County recorded September 29, 1992, in Volume
17884 at page 246, Official Records of said County, further described as follows:
Beginning at the southeast corner of said PARCEL 51264 (17884 O.R. 246); thence from

The Board will meet on Tuesday,August 17, 1993, at 9:00 a.m. in the Board's Chambers,
County Administration Building, Martinez, California,to make such conveyance by at least
a four-fifths vote.
