HomeMy WebLinkAboutMINUTES - 08101993 - H.2 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on August 10, 1993 by the following vote: AYES: Supervisors Powers, Smith, Bishop, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 93/497 SUBJECT: Confirmation of Report, Ordering of Improvement and Levy of Assessments in Zones 40, 41 and 44 of County Landscaping and Lighting District AD 1979-3 (LL-2) for Fiscal Year.1993- 94. The Board of Supervisors of the County of Contra Costa resolves: 1. Pursuant to the Landscaping and Lighting Act of 1972, the Board directed the Engineer of Work for Landscaping and Lighting District AD 1979-3 (LL-2) to prepare and file a report for fiscal year 1993-94 for Zones 40, 41 and 44. The improvement is generally described as follows: installation, maintenance and servicing of landscaping, irrigation facilities, public lighting or electrical facilities, and park and recreational improvements, together with all appurtenances, and services of consultants as needed. 2. The Engineer of Work filed the report as directed on June 8, 1993, and the Board adopted its resolution of intention to levy and collect assessments within the above-numbered zones of the assessment district for fiscal year 1993-94 and set public hearings to be held on July 27 and August 3, 1993, in the Board chambers, County Administration Building, 651 Pine Street, Martinez, California. Notice of the hearings was given in the time and manner required by law, and the public hearing on August 3, 1993 was duly continued by the Board to August 10, 1993. 3. At the public hearings, the Board allowed public testimony regarding the proposed assessments and afforded to every interested person an opportunity to object to the proposed improvement, the extent of the assessment district and each zone thereof, or the proposed assessments. 4. At or before the times set for the hearings, certain interested persons made protests or objections to the proposed improvement, the extent of the assessment district or the proposed assessment. The Board hereby overrules each of these protests, written or oral, and finds that written protests against the proposed improvement have not been made by owners representing more than one- half of the area of the land to be assessed for the improvement in any of the above-numbered zones. The Board approves the Engineer's Report and each component part of it, including each exhibit incorporated by reference in the report. 6. The Board finds that the Engineer of Work, in the Engineer's Report, has fairly and properly apportioned the cost of the improvement to each parcel of land in Zones 40, 41 and 44 of the assessment district in proportion to the estimated benefits to be received by each parcel, respectively, from the improvement. The Board hereby confirms and levies each individual assessment as stated in the Engineer's Report. 7. The Board orders the improvement described above and as detailed in the Engineer's Report. 8. The Board directs the Clerk of the Board to file a certified copy of the diagram and assessment with the County Auditor/Controller by the third Monday in August, pursuant to Section 22641 of the Streets and Highways Code. The assessments shall be collected at the same time and in the same manner as county taxes are collected, and all laws providing for the collection and enforcement of county taxes shall apply to the collection and enforcement of the assessments, except as provided otherwise in Section 22646 of the Streets and Highways Code. The Board of Supervisors of the County of Contra Costa resolves: 1. Pursuant to the Landscaping and Lighting Act of 1972, the Board directed the Engineer of Work for Landscaping and Lighting District AD 1979-3 (LL-2) to prepare and file an annual report for fiscal year 1993-94 for Zone 7. 2. The Engineer of Work filed his annual report on June 8, 1993, and the Board adopted its resolution of intention to levy and collect assessments within the above-numbered zone of the assessment district for fiscal year 1993-94 and set public hearings to be held on July 27 and August 3, 1993, in the Board chambers, County Administration Building, 651 Pine Street, Martinez, California.
