THE BOARD OR SUPERVISORS OF
CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on August 10, 1993 by the following vote:
SEE SEPARATE VOTES FOR VARIOUS MOTIONS
SUBJECT: BALLOT LANGUAGE FOR THE ADVISORY MEASURE ON FIRE
SERVICE CONSOLIDATION
The County Administrator advised the Board that in
response to its request to have an opportunity to review the
ballot language for the advisory measure on fire service
consolidation, the matter had been placed on today's agenda for
further consideration. The County Administrator reviewed the
language that the Board had agreed to on August 3 , 1993 .
Supervisor Bishop advised that she wished to reconsider
the actions taken last week and include in this discussion which
independent districts and city fire departments should have the
measure on their ballots, commenting that she had received input
from the City of E1 Cerrito and other West County communities
which indicated that they felt that they had not had adequate
input with respect to functional integration or consolidation.
Supervisor Bishop further advised that she felt the Board must
review what its plans are before going to LAFCO; and she felt
that the voters in the Contra Costa Fire Protection District
(Consolidated Fire) should have the opportunity to participate in
the November 2, 1993 ballot.
Supervisor Smith commented. that Supervisor Powers had,
two or three meetings with the West County communities and there
has been discussion on the issue.
Supervisor McPeak commented that she felt the whole
thing was confusing and before putting anything on the ballot,
the Board needs a plan, that proceeding without a definite plan
only creates fear and concern.
Supervisor Smith agreed and commented that the matter is
very complex and does not lend itself to a straight yes or no
answer, and that placing it on the ballot is premature, and that
he is not in favor of putting anything on the ballot in the
"Consolidated" Fire District until the voters can be told where
the money is coming from and what benefits there would be .
Mayor Mae Ritz of the City of El Cerrito expressed
disappointment that the City was not consulted before the ballot
measure was approved for El Cerrito, and requested the Board to
remove Advisory Measure G from the November 2 , 1993 ballot.
Ron Egherman, member of the Kensington Fire Protection
District Board, advised that his Board was very disappointed with
the lack of communication, and with the fact that the Board of
Supervisors voted on a issue the District had no knowledge of,
and that Kensington Fire District has had an enormous amount of
community input with respect to the ways to save money while
maintaining certain goals that are critical to the community,
which goals are: no increase .in property taxes, to maintain the
Kensington Fire House which represents a critical response time
to the community, and to maintain its independence for both fire
and police, and future control of their emergency services. Mr.
Egherman advised that Kensington has researched many options
including consolidation with the County and now is focusing on
contracting for services with both E1 Cerrito and Berkeley. Mr.
Egherman advised that he believed the matter was far too
complicated to place on the ballot and that the advisory measure
is unnecessary.
Floyd J. Cormier, Jr. , Fire Chief of the City of
Richmond Fire Department, expressed concern on the part of the
Richmond City Council that there was little advance notice, no
real communication of whether or not the City required or was
requesting Measure K on the November 2 ballot. Chief Cormier
advised that the Council did not want to raise premature
expectations on the part of the citizens regarding the cost
levels to the people in the City of Richmond. Chief Cormier
noted that the City Council is interested in retaining the
relationship it now has with the County in that they have joint
response, joint training and joint dispatch with El Cerrito,
Kensington and West County, and noted that the City would like to
look at the total package before putting the matter before the
citizens of the City of Richmond for a vote.
Sue Noe appearing as a private citizen and as the Mayor
of the Town of Moraga, and a Morga Fire Commissioner, suggested
the Board reconsider the action taken last Tuesday in agreeing to
put the matter on the ballot in certain areas, suggesting that it
is inappropriate for the County to place the advisory measure on
the ballots in the jurisdictions of certain Cities, even though
she is of the opinion that functional integration in this day and
age are essential. She suggested that at a future time, when it
is appropriate, that all dependent districts be asked the same
question at the same time.
Sherri Anderson, 2206 Sand Point Road, advised that East
County districts did not want to be locked into volunteer fire
departments and also that she was of the opinion that the ballot
measure language is too vague.
Supervisor Bishop again suggested that the Board
reconsider its August 3, 1993 actions, but that the Board
consider District by District whether to have an advisory vote.
County Counsel advised because the agenda item was to
review the language of the ballot measures, if the Board is going
to be removing measures from the ballot, since that item was not
expressly listed on the agenda, the Board by four votes must
allow that topic to be considered; and then, it requires only
three votes to take action on the specific items.
Supervisor Powers commented that he did not believe that
there is any new information, and he would oppose any motion to
reconsider.
Supervisor Bishop discussed the incremental cost to the
County for ballot measures in the independent districts, and the
costs to be borne by the individual dependent districts.
Supervisor Bishop moved that although it is not listed
on the agenda, the Board reconsider, as an urgency item, the vote
taken on August 3 , 1993 on the advisory measure for
consolidation, district by district, since this matter came up
after the agenda.
The motion was seconded by Supervisor McPeak.
The Chair ruled that the first vote would be whether to
add the matter to the agenda. The vote on adding the matter to
the agenda was unanimous.
Supervisor Bishop then moved that the Board vote on
whether to place this language as an advisory measure in each of
the Districts voted on last week, and to add Moraga, Orinda and
West County to the list, and to' vote on each District separately.
Supervisor McPeak moved to remove the ballot measure
from the ballots in Contra Costa County Fire Protection District
(Consolidated) , Kensington, E1 Cerrito and Richmond.
The Chair inquired if there was a second to Supervisor
Bishop's motion. Hearing none, he declared the motion died for
lack of a second.
Supervisor Bishop objected to hearing the two matters
together. She advised that she felt Consolidated should have an
opportunity to cast an advisory vote and she did not wish to
choose between that and involving Kensington and El Cerrito and
Richmond, and therefore she wished to consider each one
separately because she felt the issues were completely different.
The Chair declared there was no second at this time for
Supervisor McPeak's motion to remove all four districts,
Consolidated, Kensington, E1 Cerrito and Richmond, and therefore
the motion dies for lack of a second.
Supervisor Smith moved to remove the ballot measure from
the Contra Costa Fire Protection District ballot. Supervisor
McPeak seconded the motion.
The vote on the motion was as follows:
AYES: Supervisors Smith and McPeak
NOES: Supervisors Powers, Bishop and Torlakson
The Chair announced that the motion failed by a two to
three vote.
Supervisor Bishop moved to remove the measure from the
ballots for the City of Richmond, Kensington and E1 Cerrito.
Supervisor McPeak seconded the motion.
The vote on the motion was as follows:
AYES: Supervisors Bishop and McPeak
NOES: Supervisors Powers, Smith and Torlakson
The Chair announced that the motion failed by a two to
three vote.
Supervisor Powers advised that given the explanation of
the Chair with respect to budgets and his persuasive arguments,
he would agree to remove E1 Cerrito and Richmond, and would also
consent to concerns about Consolidated Fire and so moved.
The motion was seconded by Supervisor McPeak.
The Chair requested that the vote be separated into one
motion for E1 Cerrito and Richmond and then come back and vote on
Consolidated separately.
The vote on the motion to remove the ballot measure from
the El Cerrito and Richmond ballots was unanimous.
Supervisor Bishop moved a substitute motion to remove
the whole advisory measure from all ballots.
The Chair declared the substitute motion died for lack
of a second.
The vote on the motion to remove the ballot measure from

the Consolidated Fire ballot was as follows:
AYES: Supervisors Powers, Smith and McPeak
NOES: Supervisor Torlakson
ABSENT: Supervisor Bishop
The above actions leave the advisory ballot measure on
the ballots in the Kensington, Riverview, Bethel Island, Oakley
and East Diablo Fire Protection Districts.
At 12 :45 p.m. , the Chair announced that the Board is
recessing to meet with the Retirement Board, and will reconvene
at approximately 2 : 30 p.m. , and will, at that time, deal with
language for the ballot measure.
Upon reconvening the afternoon session, the Chair
announced that he wanted to clarify the approved language for the
ballot measure, which reads as follows:
"SHOULD EXISTING SEPARATE FIRE DISTRICTS IN CONTRA COSTA
COUNTY BE CONSOLIDATED TO THE GREATEST EXTENT POSSIBLE INTO ONE
FIRE DISTRICT IN ORDER TO PURSUE COST SAVINGS AND/OR IMPROVE
EFFICIENCIES?"
Supervisor Torlakson moved to approve the above language
for the advisory ballot measure. The motion was seconded by
Supervisor Powers.
The vote on the motion was as follows:
AYES: Supervisors Powers, Smith, McPeak and
Torlakson
NOES: None
ABSTAIN: Supervisor Bishop
The County Administrator advised that he had just
received word from the County Registrar of Voters that this was
the very last day ballot language can be amended and measures can
be removed from the ballot.

The following language for Board proposed ballot measures has been
submitted to the Elections Department. If you have any concerns
about the language, please call me at 646-4077 immediately so
appropriate changes can be made.
♦ Shall a County ordinance be approved in order to
continue in effect a 1/2 percent sales tax in the
County of Contra Costa to support County public
safety services (Sheriff, and District Attorney).
and other purposes, with the ordinance being
implemented only in the event that Proposition 172,
the proposed extension, of the State 1/2 percent
sales tax which appears on this ballot, is defeated
statewide.
