SUBJECT: COLLECT AND CONVEY DRAINAGE REQUIREMENTS FOR PERMIT 2043-92,
(COMMUNITY BAPTIST CHURCH, WEST PITTSBURG AREA)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
1. ACCEPT the following report from the Public Works Director regarding a request from Mr.
Dapo Okupe on behalf of the Community Baptist Church for an alternative to the "collect
and convey" requirement on Permit No. 2043-92.
2. APPROVE the following as an alternative condition of approval to the "collect and convey"
requirement of Ordinance Code Section No. 914-2.
a. All drainage to and from the site shall be conveyed across said site in an
adequate, maintainable, open drainage way to the existing roadside ditch.
b. Developer shall execute a recordable agreement accepting unto himself and future
owners of the above drainage way all responsibility for future maintenance and
liability.
C. Developer shall contribute $1.25 per square foot of new impervious surface on the
parcel to the Drainage Deficiency Trust Fund (812100-0800). The fee amount for
the proposed building addition is calculated to be $2500. If any additional
impervious surface (e.g. parking lots, sport courts, or other paved surfaces) is
created on the parcel prior to the installation of the necessary drainage facilities
along Bella Vista Avenue, the Church shall be subject to an additional fee of$1.25
per square foot. Once the County has secured the installation of drainage
improvements along Bella Vista Avenue, this drainage fee shall no longer be
required.

I. Recommended Action: (Continued)
3. ADOPT the following findings pursuant to Chapter 92-6, "Exceptions," of the Ordinance
Code in order to approve the alternative condition of approval:
a. There are unusual circumstances or conditions affecting the property. The Bella
Vista Avenue area has long been urbanized with inadequate drainage facilities.
Extensive drainage improvements are necessary and only a few small parcels
remain which can be developed. Infill development of the remaining parcels in the
area cannot support the installation of drainage improvements as required by the
Ordinance Code.
The potential for land development activity to provide for orderly development of
the drainage system is unlikely in the near future. However, the Redevelopment
Agency has agreed to finance the installation of drainage improvements
downstream of the subject property, along Willow Pass Road to Bella Vista
Avenue. The plan for the drainage system has been designed and is on record
at the Public Works Department. The contribution of $1.25 per square foot of
impervious surface from future development will provide the additional funding
necessary to finance the installation of the drainage system along Bella Vista
Avenue.
b. The exception is necessary for the preservation and enjoyment of a substantial
property right of the applicant. Development of land in general, in the West
Pittsburg area, cannot occur without allowing developers to comply with drainage
requirements which are much less expensive per unit than those required by the
Drainage Division of the Subdivision Ordinance Code for this development.
C. The granting of the exception will not be materially detrimental to the public welfare
or injurious to other property in the area in which the property is situated. The
amount of storm water runoff from the new impervious surfaces, approximately
2,000 square feet, is minor in comparison to the size of the watershed.
II. Financial lmpact:
The financial impact to the County is unknown.
III. Reasons for Recommendations and Background:
The one-half acre in the Bella Vista Avenue area of West Pittsburg contains an existing
community church. Mr. Okupe proposes to construct an addition to the rear of the church,
approximately 2,000 square feet in area, and has agreed not to create any additional impervious
surface on the parcel other than the addition. If subsequent impervious surface is created on
the parcel, the applicant has agreed to pay the corresponding fee of $1.25 per square foot of
additional impervious surface created.
Unfortunately, drainage in this area depends on inadequate road side ditches to convey surface
runoff. The nearest adequate drainage facility is located approximately 1,500 feet away.
Several engineers have reviewed this development to determine the least costly drainage
solution that meets the requirements of "collect and convey." They have concluded that all of
the potential solutions are not economically feasible for this small development. Staff has
determined, however, that the drainage system can be installed with partial funding from the
Redevelopment Agency if all the potential future development contribute $1.25 per square foot
of impervious area.
A strict compliance to the "collect and convey" requirement places a hardship on the church.
There exists an unusual circumstance in that it would be impossible for the Community Baptist
Church to generate the necessary funding from this addition to design or construct any drainage
improvement that would have a significant impact in this area.

Staff recommends that the Board permit the alternative condition of approval in lieu of strict
application of "collect and convey." The proposed contributions to regional drainage from this
development represents its fair share of the future costs. The other monies collected from
previous development on Bella Vista Avenue will be added to the contribution from this
development to implement needed drainage improvements to service this area.
IV. Consequences of Negative Action:
If the alternative condition is not granted, the applicant will be required to meet the full collect
and convey requirements of the Drainage Code.
