The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street no longer required for
street purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and
Highways Code, commencing with Section 8330.
This vacation request is for a portion of Garden Tract Road located in the
Richmond area. A description of the portion to be vacated is attached hereto as Exhibit
"A" and incorporated herein by reference.
This vacation request is for a portion of a street that lies within the property under
ohe ownership and that does not continue through such ownership or end touching
property of another. (S. & H. Code Section 8334).
This Board hereby FINDS that the proposed vacation will not have a significant
effect on the environment, and that it has been determined to be exempt from the
California Environmental Quality Act under State CEQA guidelines Section 15061 (b) (3).
This Board DIRECTS the Director of Community Development to file a Notice of
Exemption with the County Clerk, and DIRECTS the Public Works Director to arrange for
payment of the $25.00 handling fee to the County Clerk. The Planning Commission
having considered their general plan, FINDS pursuant to Government Code Section
65402 that this proposed vacation is in conformance with their general plan.
This Board declares that the hereinabove described proposed vacation area is
HEREBY ORDERED VACATED subject to any reservation and exception described in
attached Exhibit "A". From and after the date this Resolution is recorded, the portion
vacated no longer constitutes a public highway.

A portion of Lot 3 and 14 in the north half of the northeast quarter of Section 2, Township 1 North,
Range 5 West, Mount Diablo Meridian, in unincorporated area of Contra Costa County, California,
as shown on the map No. I Salt Marsh and Tidelands, filed in the office of the County Recorder of
Contra Costa County, described as follows:
All that portion of Garden Tract Road, a 30 foot wide road, bounded on the south by the westerly
prolongation of the northerly right of way line of Pittsburg Avenue and on the north by the
southwesterly right of way line of San Pablo Creek as shown on Contra Costa County Flood Control
and Water Conservation District Drawing No. ED-754.4.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and Highways
Code, the easement and right at any time, or from time to time, to construct, enlarge, maintain,
operate, replace, remove, and renew those existing and in place utilities, as of the date of recording
this instrument, in, upon, over and across any highway or part thereof proposed to be vacated,
including access to protect the property from all hazards, in, upon, and over the area herein before
described to be vacated.

#CP 93-41: The purpose of the activity is to vacate the County's interest in a portion of Garden Tract Road.
(Figures are available for review with the County's Public Works Department at the below-referenced
address.) The Traffic Engineering Division of the Public Works Department has determined that there is no
need for traffic circulation In this area. Therefore, this portion of Garden Tract Road is not necessary for
present or prospective~ public road purposes. The area will revert back to acreage and no new parcel will '
be created as a result of the vacation process. No sale of land is involved. Project Location: Garden Tract
Road Is located in a commercial area in the west county area of Richmond.
