Resolution No. 27-1993 as the determination for these actions.
4 . Introduce the ordinance giving effect to the aforesaid rezon-
ing, waive reading and set date for. adoption of same.

BACKGROUND/REASONS FOR RECOMMENDATION:
The applicant on March 9, 1992, received approval for a two-lot
minor subdivision, with conditions of approval requiring him to
submit an application for rezoning the property from R-10 to R-6.
The applicant's request was heard by the County Planning Commiss-
ion on June 8, 1993 . The Planning Commission, after evaluating the
proposal and evidence submitted, voted unanimously to recommend
approval of the proposed rezoning to the. Board of Sup rvi rs:

RESOLUTION OF THE PLANNING COMMISSION OF THE COUNTY OF CONTRA
COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND . RECOMMEN-
DATIONS ON THE REQUESTED CHANGE IN ZONING BY CLYDE COLA (APPLICANT/
OWNER) , (2994-RZ) , IN THE ORDINANCE CODE SECTION PERTAINING TO THE
PRECISE ZONING FOR THE PACHECO AREA OF SAID COUNTY.
WHEREAS, a request by CLYDE COLA (Applicant/Owner) , (2994-RZ) ,
to rezone two parcels from Single Family Residential District (R-
10) to Single Family Residential District (R-6) , as required by
condition of approval #6 of Minor Subdivision 34-91, which
application was received by the Community Development Department
Office on August 17, 1992; and
WHEREAS, for purposes of compliance with the provisions of the
California Environmental Quality Act and the State and County CEQA
guidelines, the project was determined to be categorically exempt
from CEQA; and
WHEREAS, after notice having been lawfully given, a public
hearing was scheduled before the County Planning Commission on
Tuesday, June 8, 1993, whereat all persons interested therein might
appear and be heard; and
WHEREAS, on Tuesday, June 8, 1993 , the County Planning
Commission having fully reviewed, considered and evaluated all the
testimony and evidence submitted in this matter; and
NOW, THEREFORE, BE IT RESOLVED that the County Planning
Commission recommends to the Board of Supervisors of the County of
Contra Costa, State of California, that the rezoning request of
CLYDE COLA (Applicant/Owner) , (2994-RZ) , be APPROVED for change
from Single Family Residential District (R-10) to Single Family
Residential District (R-6) and that this zoning change be made as
is indicated on the findings map entitled:
BE IT FURTHER RESOLVED that the reasons for this recommendat-
ion are as follows:
A. The general plan for the subject property is Single Family
Residential-High Density with a density range of 5. 0 to 7.2
dwelling units per acre. The requested zoning to R-6 is
consistent with the general plan.
B. The uses within the R-10 District are compatible to those
within the R-6 District.
C. The subject property is within the City of Pleasant Hill's
sphere of influence. The City in their comments on
September 4, 1991 on MS 34-91 requested a rezoning of the
property from R-10 to R-6 to conform with the property's

size.
BE IT FURTHER RESOLVED that the Chairman and Secretary of this
Planning Commission will sign and attest the certified copy of this
resolution and deliver the same to the Board of Supervisors all in
accordance with the Government Code of the State of California.
The instructions by the Planning Commission to prepare this
resolution was given by motion of the Commission on Tuesday, June
8, 1993, by the following vote:
AYES: Commissioners - Terrell, Accornero, Sakai, Woo,
Gaddis, Clark, Frakes.
NOES: Commissioners - None.
ABSENT: Commissioners - None.

I. INTRODUCTION
CLYDE COLA (Applicant & Owner), County File #2994-RZ: The applicant requests
approval to rezone two parcels from R-10 to R-6 as required by Condition of Approval
#6 from MS 34-91 : Subject properties are located on the west side of High Street,
approximately 30 feet north of 4th Avenue, in the Pacheco area. (R-10) (ZA: H-13)
(CT 3211 .02) (Parcel #125-271-014, -015).
II. RECOMMENDATION
Staff recommends the Planning Commission adopt a resolution recommending approval
of the rezoning to the Board of Supervisors.
III. GENERAL INFORMATION
A. General Plan: Single Family Residential-High Density, 1991 County General
Plan.
B. Existing Zoning: R-10; 10,000.square foot minimum lot size.
C. Proposed Zoning: R-6, 6,000 square foot minimum lot size.
D. CEQA Status: This project is categorically exempt from CEQA.
E. Site Description: The subject property is a gentle sloping parcel located in an
existing high-density urban setting.
IV. AGENCY COMMENTS
A. Department of Fish & Game: . The Department had no comment on the
application.
B. Contra Costa County Fire Protection District: Roof coverings shall be a
minimum Class C rating.
C. Building Inspection Department: No comments.
D. Pacheco Municipal Advisory Council: Comments requested, none received.

V. DISCUSSION
The applicant was requested as a Condition of Approval #6 of MS 34-91 to submit an
application for rezoning the subject property from R-10 to R-6, to establish consistency
with the approved lot size of 6,000 square feet.
The zoning district within the surrounding area consists of R-10, R-7 and R-6. The
properties immediately adjacent to the subject property are zoned R-10 with a
progression into R-7 and R-6 to the northeast and a pocket of R-6 to the southeast.
.Section 26-2.1806 of County Ordinance Code requires specific findings to be made
by the planing agency when a request for change in a land use district is made. They
are as follows:
A. The change proposed will substantially comply with the general plan;
B. The uses authorized or proposed in the land use district are compatible within
the district and to uses authorized in adjacent districts;
C. Community need has been demonstrated for the use proposed, but this does
not require demonstration of future financial success.
Staff finds the following in regards to the above:
A. The general plan for the subject property is Single Family Residential-High
Density with a density range of 5.0 to 7.2 dwelling units per acre. The
requested zoning to R-6 is consistent with the General Plan.
B. The uses within the R-10 district are compatible to those within the R-6.
C. The subject property is within the City of Pleasant Hill's sphere of influence.
The City in their comments on September 4, 1991 on MS 34-91 requested a

I. INTRODUCTION
CLYDE & DONNA COLA (Applicant and Owners), County File # MS 34-91: The
applicant requests approval of a tentative map to subdivide 13,684 square feet into
2 parcels in a Single Family Residential District (R-10) with variances to have less than
the required parcel size of 6,000 t square feet each(10,000 square feet required) and
to have less than the required lot width and depth. Subject property is located on the
west side of High Street, approximately 30 feet north of 4th Avenue, in the Pacheco
area. (R-10) (ZA: H-13) (CT 3211.02) ( Parcel # 125-271-007).
II. RECOMMENDATION
Staff recommends approval of the two lot minor subdivision.
III. GENERAL INFORMATION
A. General Plan: Single Family Residential - High Density.
B. Zoning: R-10.
C. CEQA: A negative Declaration has been posted for the project.
D. Site Description: The subject property is a gentle sloping parcel located in an
existing high-density urban setting.
E. Agency Comments:
1 . Airport Land Use Commission: See attached.
2. Pacheco Town Council: No Comments.
3. City of Pleasant Hill: The City would prefer to see the property rezoned
to R-6 (6,000 square foot lot size) and review to decrease the number
of driveways.
4. Grading Inspection Dept: The Department recommends relocating panel
(B) access to the north property line, since a small cut and access
exists. This would also allow for better control of drainage.
IV. STAFF DISCUSSION
The applicant proposes to subdivide approximately 13,200 square feet into two lots.
The proposal will create two lots below the R-10 district standard of 10,000 square
feet per lot. Within the project vicinity. Three parcels have been subdivided in similar
manner.
Per staff's site visit and review of Grading Inspection comments, staff would concur
that access to parcel - B shall be provided along the north property line, where an
access currently exists. Additionally staff would recommend that access to parcel (B)
be held in fee by parcel (A), to eliminate the flag lot configuration. By staff's
calculations the rear property line of parcel (A) will have to be adjusted slightly to meet
the 6,000 square foot parcel size, and an easement granted to parcel (B).
Furthermore, the applicant's request for 6,000 square foot lots is below the R-10
District standards of the required 10,000 square feet in staff's opinion to justify the
6,000 square foot lot size the applicant should be required to rezone .the property to
R-6. Previous subdivisions in the project vicinity MS 181-79 and 30-87 were
permitted to subdivide below the R-10 District standards. However, the property for
MS 30-87 was rezoned from R-10 to R-6 following approval. It is unclear if the
approval was contingent of the rezoning. The parcels adjacent to the subject property,
and two parcel distance.to the north are approximately 7,000 to 8,000 square feet.
V. ROAD AND DRAINAGE CONSIDERATIONS:
The attached conditions of approval based on the July, 1991 tentative map include
road and drainage requirements. The applicant should be fully aware of the County
Subdivision Ordinance Code requirements as they pertain to this development.

CONDITIONS OF APPROVAL MS 34-91
1 . This application for a two-lot minor subdivision is approved subject to a revised map
being submitted for review and approval of the Community Development Department
relocating the property access to the north property line and eliminating the flag-lot
configuration,
2. Where a lot is located within 300 feet of a high voltage electric transmission line, the
applicant shall record the following notice:
"The subject property may be located near a high voltage electric
transmission line. Purchasers should be aware that there is ongoing
research on possible potential adverse health effects caused by the
exposure to a magnetic field generated by high voltage lines. Although
much more research is needed before the question of whether magnetic
fields actually cause adverse health effects can be resolved, the basis
for such an hypothesis is established. At this time no risk assessments
have been made."
When a Final Subdivision Public Report issued by the California Department of Real
Estate is required, the applicant shall also request that the Department of Real Estate
insert the above note in the report.
3. The applicant shall show proof that water and sewage service is available prior to
.recording the Parcel Map.
4. Should archaeological materials be uncovered during grading,trenching or other on-site
excavation(s), earthwork within 30 yards of these materials shall be stopped until a
professional archaeologist who is certified by the Society for California Archaeology
(SCA) and/or the Society of Professional Archaeologists (SOPA) has had an
opportunity to evaluate the significance of the find and suggest appropriate
mitigation(s), if deemed necessary.
5. Comply with the following recommendations of the Airport Land Use Commission:
A. A suitable aviation and noise easement covering the entire property shall be
dedicated to the County. A model ordinance for this purpose has been provided
to the applicant. At least 30 days prior to filing a final map, a proposed
easement instrument shall be submitted to the County Zoning Administrator for
review and approval. The approved instrument shall be dedicated concurrently
with the recordation of the parcel maps.
B. The applicant shall prepare a disclosure statement which shall be included in
any future offer or sale documents to read as follows:
"This property is in proximity to Buchanan Field, a public-use
airport. The property is subject to frequent aircraft overflight and
associated noise impacts."
The statement shall either be added to the parcel map or concurrently recorded
as a covenant to each of the lots with the recordation of the parcel map.
C. New residences or other new habitable structures shall be designed to comply
with the Sound Transmission Control Standards of the 1988 Uniform Building
Code Appendix with State of California 1989 Amendments.
6. Prior to filing the map submit an application rezoning the subject property from R-10
to R-6.
7. The Following requirements pertaining to drainage, road, and utility improvements will
require the review and approval of the Public Works Department.
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision Ordinance
(Title 9). Any exceptions therefrom must be specifically listed in this
conditional approval statement. Conformance with the Ordinance includes the
following requirements:
1 . Constructing road improvements along the frontage of High Street.
An exception to this requirement is granted provided a deferred
improvement agreement is executed requiring the owner(s) of the
property involved in Subdivision MS 34-91 to:
a. Construct curb,four-foot six-inch sidewalk(width measured from
curb face), necessary longitudinal and transverse drainage, and
necessary pavement widening along the frontage will satisfy this
requirement. The face of the curb shall be 20 feet from the
centerline of the road.
b. Underground the existing utility distribution facilities along the
High Street frontage.
C. At the time the deferred improvement agreement is called up,
submit improvement plans, if required, to the Public Works
Department, Engineering Services Division, for review; pay the
inspection fee, plan review fee and applicable lighting fees.
2. Additional street lighting is not required. This property has already been
annexed to County Service Area L-100 for maintenance of street lights.
3. Undergrounding of all new utility distribution facilities.
4. Conveying all storm waters entering or originating within the subject
property, without diversion and within an adequate storm drainage
facility, to a natural watercourse having definable bed and banks or to
an existing adequate public storm drainage facility which conveys the
storm waters to a natural watercourse.
5. Designing and constructing storm drainage facilities required by the
Ordinance in compliance with specifications outlined in Division 914 of
the Ordinance and in compliance with design standards of the Public
Works Department. The Ordinance prohibits the discharging of
concentrated storm waters into roadside ditches.
6. Submitting improvement plans prepared by a registered civil engineer,
payment of review and inspection fees, and security for all
improvements required by the Ordinance Code or the conditions of
approval for this subdivision.
7. Submitting a Parcel Map prepared by a registered civil engineer or
licensed land surveyor.
B. Conveying to the County, by Offer of Dedication, additional right of way on
High Street as required for the planned future width of 60 feet.
C. If both parcels access off the same easement, construct a 16 -foot paved
private roadway to County private road standards, within a 25-foot
easement, for that portion of the access road which will serve both parcels in
this proposed subdivision.
D. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across driveways.
E. Furnish proof to the Public Works Department, Engineering Services Division,
of the acquisition of all necessary rights of entry, permits and/or easements for
the construction of off-site, temporary or permanent, drainage improvements.
ADVISORY NOTES
1. Applicant shall comply with the Park Dedication Fee Ordinance.
2. Comply with requirements of the Central Contra Costa Sanitary District(see attached).
3. Comply with requirements of the Consolidated Fire Protection District (see attached).
4. The applicant will be required to comply with the requirements of the
Bridge/Thoroughfare Fee Ordinance for the Pacheco Area of Benefit as adopted by the
Board of Supervisors.

Our comments on the subject minor subdivision are as follows .
The Pleasant Hill General Plan conforms to the county general plan
and designates the property for high density single family
residential land use. The proposed division is consistent with
this designation.
Our concerns are twofold.
First is the fact that a number of variances are requested to the
R-10 zoning which are neither warranted nor listed on the
application. A rezoning to Single Family Residential District R-6
appears to be the preferred course of action.
Second is the fact that there appears to be a need to evaluate the
effect of future subdivisions on the circulation system and land
use pattern. There is no indication this has been done. For
example, driveways can be improved to serve adjacent parcels,
thereby increas-Ing driveway width an%".' halving the Ii:dltthEl' Of nevi
driveway connections to the public street .
We suggest that this property and the adjacent properties be
rezoned prior to subdivision.
