SUBJECT: PROPOSED SMOKING LEGISLATION
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. Send a letter to Speaker Brown, Senator Pro Tem Roberti, and Senator Charles Calderon expressing
opposition to any state law, such as one recently reported in the Los Angeles Times (see attached),
which would increase the tobacco excise tax and dedicate the money to counties and would include
a total.State preemption in the area of the regulation of smoking.
2. Direct the Health Services Department to monitor the State Legislature for any potential legislation
that would include preemption clauses which would restrict local efforts to pass effective anti-smoking
legislation.
3. Direct the County Lobbyist and Health Services Department to oppose any legislation which includes
a restrictive preemption clause.
BACKGROUND:
On March 2, 1993, the Board of Supervisors voted to support AB 13,which prohibits smoking in any enclosed
space at a place of employment, and to monitor the bill for any preemption clauses which would restrict local
efforts to pass effective anti-smoking legislation.
On June 15, 1993, the Board of Supervisors voted to oppose AB 996, which would preempt local regulation
of smoking in public places and which would impose less stringent statewide regulations than currently exist
in Contra Costa County and many of its cities.
The tobacco tax proposal initially floated by Sen. Calderon and potentially being considered by other state
legislators would raise the tobacco excise tax by 17 cents: 15 cents to be allocated to counties, and two cents
to the Breast Cancer Research Fund. At the same time, this proposal would enact a law more restrictive
than AB 996, which the Board actively opposes, that would preempt all local tobacco control ordinances
throughout the state and provide significantly less public health protection than the model smoking ordinance
crafted by the City/County Relations Committee (see attached comparison of AB 1.3,AB 996, and 'New Bill"
being distributed by the American Lung Association).

In addition to the unincorporated areas of the County, the following cities have already adopted significantly
stronger smoking ordinances which would be preempted by legislation being proposed by Senator Calderon:
Clayton, Concord, El Cerrito, Hercules, Lafayette, Martinez, Orinda, Pinole, Pleasant Hill, and Walnut
Creek. The city of Antioch will be considering the model ordinance July 27; the city of Brentwood will be
hearing the model ordinance this summer. Other cities in which City Councils have been asked to hear the
ordinance by citizens include Richmond, Danville, and San Ramon.
Although Los Angeles County has taken a position in support of the proposal because of potential revenues,
it would drastically undermine the City of Los Angeles' new anti-smoking ordinance and undercut its
responsibility to protect the public health.
