RESOLUTION NO. 93/.461
SUBJECT: In the Matter of Approval of Revision
to the Policy on Procedures for Vacation
of Highways and Public Service Easements
The Board having considered the Public Works Director's recommended revisions
to the Board's Policy on Procedures for Vacation of Highways and Public Service
Easements (Streets and Highway Code Section 8300 et. seq.)
IT IS BY THE BOARD RESOLVED that,effective immediately,the Policy established
by Resolution 81/1180 on October 6, 1981, is hereby revised and the revised policy shall
be as follows:
1. The vacation application shall be in writing and submitted to the Public
Works Department. The Public Works Department will make an initial evaluation as to the
acceptability of the request. If acceptable, the Public Works Department will file the
request, and receive a deposit to defray the costs of processing. The deposit fee
schedule is set forth in Resolution No. 91/630. If a balance remains in excess of the
actual costs incurred by County Departments, the balance will be refunded to the
applicant.
2. Applications shall contain:
(A) Identification of the area proposed to be vacated;
(B) A statement as to the applicant's interest in the proposed vacation;
(C) The names and mailing addresses of the owners of abutting and all
other properties which may make use of the area proposed to be
vacated;
(D) The reasons for the requested vacation;
(E) Name, address, and telephone number of the applicant or his/her
representative familiar with the details of the request.
3. The Public Works Department will:
(A) Prepare the necessary vacation map and description or, if a map
and description are included with the application, will check the
same;
(B) Notify utilities and other interested parties; arrange for a review for
compliance with the California Environmental Quality Act and with the
County General Plan through the Community Development
Department; arrange for Planning Commission hearings as required;
and schedule a public hearing by the Board of Supervisors, as
required, through the Clerk of the Board;
(C) Arrange for publishing or posting of notices as required by law.
4. After final action by the Board of Supervisors, each department which has
incurred expenses in the processing of the application will report them to the Public
Works Department.
5. The Public Works Department will notify the applicant of the decisions of the
Board and will arrange• for the refund of the unexpended balance, if any, of the
