We are writing to express our concern about the ACME Fill proposal to
Karen Klaczynski remove the $6 per ton County surcharge at the Keller Canyon Landfill.

This proposal should not be given serious consideration.
This $6 charge represents a crucial condition that made a significant impact
on the approval process of Keller Canyon. It is required under Condition 35.1,
35.2 and 35.3 of the SPECIAL CONDITIONS OF APPROVAL of the Land Use
Permit covering the Keller Canyon Landfill.
We are also extremely concerned that, as of this date, no one in our
community has been contacted for input about this issue. According to press
reports, and additional documentation we have received, this proposal has
been under consideration since May. The letter proposing the rate reduction
was not only sent to the Contra Costa County Administrator, but to the city
managers of San Ramon and Walnut Creek.
It is disconcerting that the communities that are most greatly impacted by the
community mitigation fees have yet to be contacted.
These funds are important to our community. It would be extremely
unethical to promote community approval of the Keller Canyon site based
substantially on these fees, only to remove them shortly after the landfill is in
place.
We would like to urge ACME Fill and Browning Ferris Industries to look
elsewhere in their operation to find a way to reduce operating costs. We
would like the Board of Supervisors to recommend they do this as well.

It seems very unlikely that profitability projections were not made and
considered long before the Keller Canyon Landfill was even approved. Even
if that is the case, although highly unlikely, the "significant cost-saving
benefits to the citizens of the County" cited by Mr. Boyd Olney of the ACME
Fill Corporation, cannot and must not come at the expense of West Pittsburg
and Pittsburg residents.
We urge the Board to reject any rate reduction that impacts these fees. We
would also request that the Board of Supervisors keep this Council apprised
of any future proposals regarding issues of crucial community significance
such as this one.
