ACKNOWLEDGE that the Legislature has repealed all requirements for the County to have a Drug Abuse Advisory Board or Alcohol Advisory Board as well as legislation providing for a combined Substance Abuse Advisory Board, thereby leaving the establishment, size, composition, membership and all related provisions regarding the Substance Abuse Advisory Board optional with the Board of Supervisors . 2 . DETERMINE to voluntarily continue a Substance Abuse Advisory Board, pursuant to the Board' s action of August 11, 1992, consisting of 20 members, to be appointed as follows : * Three representatives to be nominated by each member of the Board of Supervisors . * Five at-large. members, to be nominated by the Internal Operations Committee, to insure geographic, racial and ethinc diversity on the Advisory Board. 3 . RECOGNIZE that, in voluntarily continuing an optional advisory board, we are dedicating some level of financial and manpower resources to staff and support the Substance Abuse Advisory Board and that the level of this commitment must be constantly evaluated. 4 . PROHIBIT any individual who is a paid employee of or a paid consultant to any agency which contracts with the County of Contra Costa on behalf of its Health Services Department for any drug or alcohol-related programs from serving on the Substance Abuse Advisory Board. DISCOURAGE any individual who is a volunteer member of the Board of Directors of any agency which contracts with the County of Contra Costa on behalf of its Health Services Department for any drug or alcohol-related programs from serving on the Substance Abuse Advisory Board, although this should not be considered an absolute prohibition on such service. This prohibition is . not intended to prevent community volunteers who serve on CASA' s', Regional Steering Committees or similar bodies from serving on the Substance Abuse Advisory Board. 6 . If such action has not already been taken, DECLARE vacant the seat on the Substance Abuse Advisory Board held by Margaret Dulaney-Phillips, representing District I and DETERMINE that the three seats representing District I are currently as follows : * Ruth Grogan, term expiring June 30, 1994 . * Vacant (the Marilyn Dillihant seat) , term expiring June 30, 1995 . * Vacant (the Margaret Dulaney-Phillips seat) , term expiring June 30, 1996 . 7 . ADJUST the term of office for the vacant (Charles Blue) seat representing District II, currently expiring June 30, 1996 to instead expire June 30, 1994, in order to maintain equity in the terms of office for the representatives from each Supervisorial District. 8 . APPOINT Constance Stein, 29 Canyon View Drive, Orinda, CA 94563, to the vacant seat on the Substance Abuse Advisory Board, term expiring June 30, 1995, representing District II . 9 . DETERMINE that the three seats representing District II are currently as follows : * Vacant (Charles Blue) seat, term expiring June 30, 1994 . * Constance Stein, term expiring June 30, 1995 . * Diana Rodger, term expiring June 30, 1996 . 10 . DETERMINE that the three seats representing District III are currently occupied as follows : * Marianne Eve Clark, term expiring June 30, 1994 . * Indra Huber, term expiring June 30, 1995 . * Rollin Klink, term expiring June 30, 1996 . 11 . MOVE Peter B. Burnett from his current seat representing District IV with a term expiring June 30, 1995 to the vacant (Frank Oliver) seat representing District IV with a term expiring June 30, 1994, in order to maintain equity in the terms of office for the representatives from each Supervisorial District. 12 . DETERMINE that the three seats representing District IV are currently occupied as follows : * Peter B. Burnett, term expiring June 30, 1994 . * Marlene Rebhan, term expiring June 30, 1995 . * Lucretia Jones, term expiring June 30, 1996 . 13 . ADJUST the term of office for Michael Burke, representing District V, currently expiring June 30, 1995 to instead expire June 30, 1994, in order to maintain equity in the terms of office for the representatives from each Supervisorial District. -2- 14 . ADJUST the term of office for the Rev. Curtis Timmons, representing District V, currently expiring June 30, 1995 to instead expire June 30, 1996, in order to maintain equity in the terms of office for the representatives from each Supervisorial District. 15 . ABOLISH the seat currently shown by the Clerk of the Board as previously occupied by Sue Hinds, representing District V, with a term expiring June 30, 1993. 16 . DETERMINE that the three seats representing District V are currently occupied as follows : * Michael Burke, term expiring June 30, 1994 . * David J. Travers, term expiring June 30, 1995 . * The Rev. Curtis Timmons, term expiring June 30, 1996 . 17 . DETERMINE that the following seats are the five at-large seats, to be appointed by the Board of Supervisors on the nomination of the Internal Operations Committee: * The vacant seat currently identified by the Clerk of the Board as belonging in District I with an expiration date of June 30, 1994 . ADJUST the term of office of this seat to expire June 30, 1996, rather than June 30, 1994 . * The vacant seat currently identified by the Clerk of the Board as belonging in District II with an expiration date of June 30, 1994 . ' * The seat currently occupied by Eleanora L. Johnston and identified by the Clerk of the Board as belonging in District III with an expiration date of June 30, 1994 . * The vacant (Peter Burnett) seat currently identified by the Clerk of the Board as belonging in District IV with an expiration date of June 30, 1995 . * The vacant (Craig Kleinman) seat currently identified by the Clerk of the Board as belonging in District V with an expiration date of June 30, 1995 . 18 . AUTHORIZE the Substance Abuse Advisory Board to assist individual Supervisors and the Internal Operations Committee to recruit for, interview, rank in order of preferred appointment and recommend to individual Board members and the Internal Operations Committee potential candidates for appointment to these and future vacancies on the Substance Abuse Advisory Board. BACKGROUND: As a result of legislation sponsored by the Board of Supervisors in 1990, it became possible to combine the former Drug Abuse Advisory Board and Alcohol Advisory Board, a step which was taken by the Board of Supervisors on August 11, 1992 . However, at that time, the Board of Supervisors simply combined the two boards and indicated that seats should be abolished as individuals resigned or as terms of office expired until the Substance Abuse Advisory Board' s total membership dropped to 20 members, at which time the Health Services Director was to return to the Board of Supervisors with the proposed eventual size, composition and manner of appointing members to the Substance Abuse Advisory Board. -3- As a part of the adoption of the State Budget and associated "Trailer Bills" for the 1993-94 fiscal year, the Legislature passed and the Governor signed into law SB 627 (Chapter 64, Statutes of 1993) . SB 627 makes the establishment of either a Drug Abuse Advisory Board or an Alcohol Advisory Board optional with the Board of Supervisors . It also repealed all of the language authorizing a combined Substance Abuse Advisory Board. We therefore believe that the Board of Supervisors now has complete discretion to establish a Substance Abuse Advisory Board or not to establish one, to have it whatever size the Board wishes and to select members in whatever way the Board wishes . On July 12, 1993, our Committee met with Chuck Deutschman and Jerry Nava and reviewed a report from the Health Services Director. We have determined to recommend the continuation of a Substance Abuse Advisory Board of 20 members . Three members would be nominated by each member of the Board of Supervisors . The Internal Operations Committee would nominate five members in an effort to insure that adequate geographic, racial and ethnic distribution is represented on the Advisory Board. We recognize that voluntarily continuing an advisory board which we could abolish will result in the dedication of some financial and manpower resources on the part of the Health Services Department. However, the Department's Substance Abuse Program Director strongly believes that the Substance Abuse Advisory Board should be continued as a mechanism for providing oversight of the County's drug and alcohol programs and as a means of providing citizen input to the Board of Supervisors on these important program areas . We have reviewed each seat on the Advisory Board in light of recent resignations and appointments and believe that the above actions are necessary in order to bring the composition of the Substance Abuse Advisory Board in line with the composition we are recommending.
