SUBJECT: Hearing on Rezoning Application #3000-RZ and companion application
#3026-92 to rezone approximately 1.69 acres of land from Single Family

property into 9 lots located in the west Pittsburg area. Application
filed by DeBolt Civil Engineering (Applicant) and Castlewood

RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2 . Approve Rezoning Application #3000-RZ and Development Plan
3026-92 as recommended by the East County Regional Planning
Commission as shown on the attached Conditions of Approval
marked Exhibit A.
3 . Adopt the East County Regional Planning Commission's findings
as set. for in Resolution #26-1993 as the determination for
these actions.
4 . Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.

after taking testimony, recommended that the Board of Supervisors

JULY 20, 1993
The Chair convened the hearing on the recommendation of the East County
Regional Planning Commission on the request for approval of DeBolt Civil Engineering
(applicant) and Castlewood Properties (owners) to rezone 1.69 acres from Single Family
Residential District (R-20) to Planned Unit District (P-1) (3000-RZ) [a variance is
requested to reduce the minimum area for a P-1 development from 5 acres to 1.69 acres];
for approval of Development Plan#3026-92 for 9 single famile residential units; and for
approval of a vesting tentative map (Subdivision 7713)to divide 1.69 acres into 9 parcels,
West Pittsburg area.
Dennis Barry of the Community Development Department presented the
Department's recommendations on the attached report.

IT IS BY THE BOARD ORDERED that the recommendations of the
Community Development Department are APPROVED including rezoning application
3000-RZ and variance to reduce the minimum area for a P-I development from 5 acres to
1.69 acres, and Development Plan 3026-92.
IT IS FURTHER ORDERED that the Ordinance giving effect to the rezoning is
INTRODUCED, reading waived, and July 27, 1993, is FIXED for adoption thereof.

CONDITIONS OF APPROVAL FOR REZONING 3000-RZ AND FINAL DEVELOPMENT PLAN
3026-92 AS APPROVED BY THE EAST COUNTY REGIONAL PLANNING COMMISSION ON
JUNE 7, 1993
1. This approval is based upon the documents received by the Community Development
Department and listed as follows:
A. Vesting Tentative Map dated received by the Community Development
Department on December 14, 1992.
B. Final Development Plan dated received by the Community Development
Department on December 14, 1992.
C. Cultural resources study from Sonoma State University dated received by the
Community Development Department on March 23, 1993.
D. Tentative floor plans dated received by the Community Development Depart-
ment on December 14, 1992.
2. Prior to recording the final map for this development, the P-1 rezoning for the site shall
have been approved. Any amendment to the Conditions of Approval by the Board shall
take precedence over.the conditions of the subdivision approval.
3. Sewage disposal serving the properties concerned in this application shall be provided
by the Delta-Diablo Sanitation District. The sewers located within the boundaries of
the properties concerned shall become an integral part of the Delta-Diablo Sanitation
District system.
4. Water supply serving the properties concerned shall be by the California Cities Water
Company. Such water distribution, located within the boundaries of the properties
concerned in this application, shall become an integral part of the Water District's
overall water distribution system. Each individual living unit shall be served by a
separate water connection.
5. A phasing program for the development may be submitted for the review and approval
of the Zoning Administrator.
6. This approval is subject to adoption of an ordinance for the rezoning of the subject
property under application 3000-RZ. The final number and layout of units shall reflect
the Board's approval. The expiration date for this Final Development Plan shall be the
same as that for SUB 7713. One 3-year extension can be granted subject to proper
request.
7. The request to subdivide 1.69 acres parcel is approved for 9 lots subject to the vesting
tentative map dated received December 14, 1992 by the Community Development
Department. The conditions of approval require compliance prior to the filing of final
map unless otherwise indicated.
8. The guide for development including dimensional requirements anduoe provisions shall
bathe Single Family Residential District R'6' including the following subject toreview
and approval by the Zoning Administrator prior tnissuance of building permits.
A. Front Setback shall vary between 15feet and 20feet from back ofsidewalk.
Garages shall have a setback of 2Ofeet from back ofsidewalk.
B. Minimum Sid8yard shall be 5 feet with not |eea 15 feat between buildings.
Minimum rearyordshall be 15 feet.
C. Prior to recording the final map, submit a plot plan of proposed houses showing
varied setbacks.

3. Should archaeological materials be uncovered during grading,trenching or other on-site
excavation(s), earthwork within 30 yards of these materials shall be stopped until a
professional archaeologist who iucertified by the Society for California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the find and suggest appropriate mitigation(s), if deemed
necessary.
10. Illuminated house numbers visible from m public or private roadway are required for
each residence.
11 . At least 30 days prior to recording of the final map, applicant shall submit landscape
plans for street setbacks, and a typical frontyanU' prepared in accordance with the
County's Water Conservation policies. Suitable drought-tolerant, California native
species shall be used to the degree possible. Landscape plans shall be subject to the
review and approval of the County Zoning Administrator. A street tree planting
program shall also be submitted atthis time. Each lot aheU have two street trees
except that corner lots shall have three (3} street trees planted. Street trees shall be
drought tolerant trees and ehoU be 15 gallon size.
12. The garage area ofeach residence ohoU be wired for electric car recharging subject
to the review and approval of the Zoning Administrator, and subject tnthe adoption
of final Board policy.

13. Prior to issuance of building perrnits, elevations and floor plans shall be submitted for
Zoning Administrator's review and approval.
14. At least 45 days prior to issuance of a grading porrnit, submit a preliminary geology,
soil, and foundation report meeting the requirements of Subdivision Ordinance Section
84-4.42Ofor review and approval ofthe Zoning Administrator. Improvement, grading,
and building plans shall carry out the recommendations of the approved report.

15. Comply with the following construction, noise, dust and litter control requirements:

through Friday, and shall be prohibited on State and Federal holidays. The
restrictions on allowed working days may be modified on prior written approval
by the Zoning Administrator.

be included. The list shall be kept current atall times and shall consist of
persons with authority to indicate and implement corrective action in their area
of responsibility. The names of the individual responsible for noise and litter
control shall beexpressly identified inthe notice. The notice shall boreissued
with each phase of nna'u/ grading activity.

Development Department. The notice shall be accompanied by a list of the
names and addresses of the property owners noticed, and a map identifying the
area noticed.
D. A dust and litter control program shall be submitted for the review and approval
of the Zoning Administrator. Any violation of the approved program or
applicable ordinances shall require animmediate work stoppage. Construction
work shall not be oUwvved to resume unb|, if nGnaaaary, on appropriate
construction bond has been posted.
16. The owner of the property shall participate in the provision of funding to maintain and
augment police services byvoting to approve a special tax for the parcels created by
this subdivision action. The tax shall be $200 per parcel annually (with appropriate
future Consumer Price Index [CP|) adjustment). The election t0 provide for the tax
must be completed prior tuthe filing of the Parcel Map. The property owner aheU be
responsible for paying the cost of holding the election. The fee for election costs will
be due at the time that the election is requested by the owner.

Child Care: $400 per residence

18. The applicant shall receive a "will Serve" letter from the Mt. Diablo Unified SCh0O\
District prior to recording the final map.
18. Pursuant toGovernment Code Section 66474.9.the applicant(including the subdivider
O' any agent thereof) shall defend, indemnify, and hold harmless the Contra Costa
County Planning Agency and its agents, officers, and employees from any c|oinn,
action, or proceeding against the Agency (the County) or its agents, officers, or
employees to attack, set aside, void' or annul, the Agency's approval concerning this
subdivision noup application, which action is brought within the time period provided
for in Section 66498.37. The County will promptly notify the subdivider of any such
claim, action, or proceeding and cooperate fully in the defense.
20. The following requirements pertaining to drainage, road' and utility improvements will
require the review and approval of the Public Works Department:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision Ordinance
[Title 3). Any exception therefrom must be specifically listed in this conditional
approval statement. COnfOrrnonCn with the Ordinance includes the following

requirements:
1} Constructing rood improvements along the frontage of Camino Andres.
Constructing curb, 4-foot 6-inch sidewalk (width measures from oVrU
face), necessary longitudinal and t(enmv8nye drainage, and pocesaory
pavement widening along the frontage will satisfy this requirement. The
curb face aheU be located 10'heet from the ultimate right of way line.
2) Installing o1naet lights on Camino Andres and tho.ru| de nac, and
annexing the property to County Service Area L lOU |nr maintenance of
the street lights. The final number and location of the lights shall be
determined by the Public Works Department, Road Engineering Division.
3) Undorgr0undiMg of all utility distribution facilities. This shall include the
distribution facilities along Camino Andres.

4) Conveying all storm waters entering or originating within the subject
property, without diversion and within an adequate storm drainage
facility, tqa natural watercourse, having definable bed and banks orto
an existing adequate storm drainage facility which conveys the storm
waters to a natural vvmtanzouraa.
The applicant shall not be permitted to discharge storrnvvater run-off
arriving at, or originating on this property, toeither the storm drain just

Ordinance in compliance with specifications outlined in Division 914 of

payment of review and inspection fees, and security for all ,

approval for this subdivision. These plans shall include any necessary
traffic signage and striping plans for review by the Public Works
Department, Road Engineering Division.
9) Submitting a Final K48p prepared by a registered civil engineer or
licensed land surveyor.

J. The applicant will be required to pay an environmental review fee of $1 ,250.00 for the
Department of Fish & Game at the end of the appeal period. Failure to do so will result
in fines. In addition, the approval iahot final or vested until the fee is paid. A check
for this fee shall be submitted to Contra Costa County for submittal with the final
environmental documents.

30. The following requirements pertaining to drainage, road, and ub|hv improvements will
require the review and approval ofthe Public Works Department:
A. In accordance with Section 92-2.008 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision Ordinance
(Title 9). Any exception therefrom must bespecifically listed inthis conditional
approval statement. Conformance with the Ordinance includes the following
requirements:

1) Constructing road improvements along the frontage of Camino Andres.
Constructing Curb' 4'foo15'inchsidewalk (width measures from curb
face), necessary longitudinal and transverse drainage, and necessary
pavement widening along the frontage will satisfy this requirement. The
curb face shall be located 10-feet from the ultimate right ofway line.
2) installing street lights on Camino Andres and dxe ruW de aac, and
annexing the property to County Service Area L-100 for maintenance of
the street lights., The final number and location of the lights shall be

3) UndergrOunding of all utility distribution t8oi|hi8s. This shall include the
distribution facilities along Camino Andrea.

4) Conveying all storm waters entering or originating within the subject
property, without diversion and within an adequate storm drainage
facility, to a natural watercourse, having definable bed and banks or to
an existing adequate storm drainage facility which conveys the storm
waters to a natural watercourse.
The applicant shall not be permitted to discharge stormwater run-off
arriving at, or originating on this property, to either the storm drain just
to the north of this property along Camino Andres or to that portion of
Line A of Drainage Area 48B in the vicinity of Carnino Andres.
5) Designing and constructing storm drainage facilities required by the
Ordinance in compliance with specifications outlined in Division 914 of
the Ordinance and in compliance with design standards of the Public
Works Department.
6) The Ordinance prohibits the discharging of concentrated storm waters
into roadside ditches.
7) Installing, within a dedicated drainage easement, any portion of the
drainage system which conveys run-off from public streets.
8) Submitting improvement plans prepared by a registered civil engineer,
payment of review and inspection fees, and security for all improve-
ments required by the Ordinance Code or the conditions of approval for
this subdivision. These plans shall include any necessary traffic signage
and striping plans for review by the Public Works Department, Road
Engineering Division.
9) Submitting a Final Map prepared by a registered civil engineer or
licensed land surveyor.
B. Convey to the County, by Offer of Dedication, additional right of way on
Camino Andres as required for the planned future width of 52 feet.,_
C. On all public roads with longitudinal slopes less than five percent, all public
pedestrian access ways shall be designed in accordance with Title 24(Handicap
access). This shall include all driveway depressions as well as handicap ramps.

of the acquisition of all necessary rights of entry, permits and/or easements for

environmental documents.
H. The applicant will be required to oVrnp|y with the requirements of the
Bridge/Thoroughfare Fee Ordinance for the West Pittsburg Area of Benefit asadopted
by the Board of Supervisors.
