Accept the applicant's request withdrawing the request for
reconsideration.

BACKGROUND/REASONS FOR RECOMMENDATIONS
The Board of Supervisors after taking testimony on June 15, 1993
approved the applicant's home designs with additional conditions
which required the applicant to provide landscape screening and
fencing along the Stewart/Russel property line. The applicant and
affected neighbor have entered into an agreement for installation
of the landscaping and construction of the fence, see Exhibit A.
The Deputy Director of the Community Development Department found
the agreements satisfactory in meeting the conditions and the
applicant, therefore, is requesting to withdraw the request for .
reconsideration.

LINDORF'S SOUTHERN PROPERTY LINE UNTIL THE FRAMING OF THE LOT B
HOME IS COMPLETED.
WITHIN 30 DAYS AFTER THE FRAMING INSPECTION IS COMPLETED MR.
STEWART AND MR. RUSSELL SHALL EITHER (1 ) APPROVE THE LANDSCAPE
PLAN PREVIOUSLY APPROVED BY COMMUNITY DEVELOPMENT, (2) DECIDE
THEY DO NOT WANT ANY LANDSCAPE ABOVE THE SIX FOOT FENCE ALONG
THE COMMON BOUNDARY, (33) APPROVE THE STAFF RECOMMENDATION OF
REDWOOD TREES (15 GALLON SIZE) PLANTED 25 FEET ON CENTER ALONG
COMMON' PROPERTY LINE, OR (4) SUBMIT ONE ALTERNATIVE LANDSCAPING
PLAN TO THE ZONING ADMINISTRATOR.
IF THE PARTIES CANNOT AGREE UPON A LANDSCAPE PLAN, THE FINAL

Fence Agreement C-q

We the undersigned, in accordance with the modified conditions of approval for MS-
32-91 set forth June 15, 1993 by the Contra Costa Board of Supervisors elect to place
the fence approximately 4 inches north of the retaining wall, on the Lindorf property.
The fence shall be constructed of redwood with either 4X4 or 4X6 posts set every 8
feet. The vertical IX6 boards shall be attached to each side of the horizontal
members and overlapping to prevent "gaps" as the boards shrink.
To construct the fence the area behind the retaining wall shall be excavated. The
posts shall then be set three feet below the retaining wall base, in natural soil. A
collar of concrete will be added to each post to prevent decay.
Prior to back-filling the drain pipe shall be reinstalled, and a silt barrier of fabric or
plastic will be added to the retaining wall, if approved by the project engineer, Vince
Cunha.
Along the four inch gap between the fence and the retaining wall a weed barrier
material will be installed and secured by a layer or rock or gravel.
The cost of the fence and excavation mentioned above will be paid for by the Lindorfs
and built by the Lindorfs and/or B.L. Williams Construction.
A two foot wide concrete drainage swale shall be installed along the common property
line just north of the new fence to empty into the drainage system. The swale will be
reinforced with wire and will contain expansion "spacers" to prevent cracking. The
swale will be built by B. L. Williams Construction prior to October 1, 1993. The
swale will be paid for by Stewart & Russell to a maximum of $600.00. Any cost
beyond $600.00 will be paid for by the Lindorfs.

Addendum to Fence Agreement
July 3, 1993
If it is determined to be in compliance with the conditions of approval and
does not delay in anyway, the permit process or construction of the Lindorf's
home (lot B), the fence will be built with posts extending approximately 2
feet above the IX6 planks and horizontal 2x4s.
If the parties.agree later, after the house is framed, to add a lattice top to the
fence, a variance for an 8 foot fence will be jointly applied for.

Dear Mr. Lindorf:
I have reviewed your agreement with Thomas Stewart and Daniel
Russel regarding landscaping and dated June 26, 1993, the fence
agreement among the same parties dated July 5, 1993 and the
addendum to the fence agreement dated July 3, 1993 and provide the
following comments.
The landscaping agreement provides satisfactory evidence of
compliance with the condition of approval for the design review for

Please also be advised that the proposed fence will be in
compliance with the applicable ordinance code provisions provided
that it is not placed directly on top of the retaining wall and
does not exceed 6 feet in height. Therefore, in the event that the
proposed fence is located approximately 6 inches behind the
retaining wall and does not exceed 6 feet in height, it will comply
with the County Code.
